Building or remodeling: do I need a permit?
What is it?
Are you going to build or renovate? Then you will have to deal with rules that include safety, health, the environment and neighbors. These rules can be found in the Omgevingswet in the Decree on construction works in the living environment) and the environmental plan (including the building code).

Then check if:
- you need a permit.
- you need to file a construction notification.
- Your structure fits into the municipality's environmental plan.
- Your structure complies with the municipality's building standards.
- your structure meets the building requirements of the Omgevingswet.
And don't forget to inform your neighbors!
1. Do you need an environmental permit or not?
Using the permit check on the Environment Counter, you can find out if you need an environmental permit for your structure. Sometimes you also need a permit for other activities. For example, for cutting down a tree/trees. You cannot apply for an environmental permit to build or change an exit. For this you have to report it via the municipal website, see "Driveway or entrance".

No permit required!
Does the permit check show that you do not need an environmental permit? Then you may start construction work.
This does not mean that your structure does not have to comply with regulations. Your structure must still comply with building regulations. You can find these regulations in the Building Works Decree for the Living Environment (Chapters 3 through 7).

Do you need an environmental permit for your structure?
We recommend that you first submit a draft request. We will then review your building plan for permit requirements and against the environmental plan and the aesthetics requirements (appearance of the structure).
With a draft request, you will find out more about the chances of success of your building plan. Then you know exactly where you stand. We aim to give you an initial response to your plan within 4 weeks. If we evaluate the concept request positively, you can apply for the environmental permit.
For a draft request you need to supply less information and the (fees) are (much) lower than for an application. See "What information must I supply if I want to renovate or build?" and "What will it cost?". In addition, we deduct the costs of this draft request from the costs of the environmental permit. You will not pay any additional fees because of this.
2. Construction notification: Are you going to build a new home or homes?
Are you going to build a new home? Or another new structure, such as a warehouse at your store, that falls under consequence class 1 of the Building Quality Assurance Act?
If so, you will need an environmental permit for the so-called spatial part and you must submit a construction notification for the technical part (Building Works Environment Decree / Wkb).

3. Environmental Plan
If you want to build or renovate, you must take into account the environmental plan. In the environmental plan we have laid down what may happen to the space in Son en Breugel. For example, where houses or businesses may be built and what dimensions they may have.
4. Welfare requirements
You must also take into account the municipality's building standards. These can be found in the building regulations memorandum. This memorandum contains the Requirements that your building plan must meet. For example, whether your building is architecturally or aesthetically in keeping with its surroundings. The Spatial Quality Committee will check your plan against these requirements.
5. Building code requirements of the Omgevingswet
All structures that are built or rebuilt must comply with building regulations. These regulations can be found in the Building Works Decree (Besluit bouwwerken leefomgeving). This decree contains regulations on (re)construction of structures, on the condition and use of structures, on demolition and on safety during construction and demolition.
Inform your neighbors about your (re)construction plans
We recommend that you discuss your building plan and construction work with your neighbors in advance. This may help you avoid unpleasant situations.
Directly regulate
You can arrange applications, a draft request and notifications online via the environment counter. For this you need DigiD (individuals) or eHerkenning (companies). Do you not yet have a DigiD? Then you can apply for one via DigiD. You can apply for eHerkenning via eHerkenning.nl.
