Building Quality Assurance Act
Are you going to build a new home? Or another new structure, for example a warehouse at a store, that falls under consequence class 1 of the Building Quality Assurance Act (Wkb)?
If so, you will need an environmental permit for the spatial part of your plan and you must file a construction notification for the technical part of your plan.
What is it?
The Building Quality Assurance Act (Wkb), known as the Quality Assurance Act for short, deals with assessing the building requirements of a structure. This law does not yet apply to all structures, but is being introduced in phases.
Purpose of the Quality Assurance Act
The Wkb aims to improve construction quality.
The test beforehand on building plans is replaced by the test in practice. This test in practice is carried out (initially for structures in consequence class 1) by independent quality assurance agencies. The quality assurance officer watches from beginning to end. From the creation of the plan to the completion of the structure. The quality assurance officer checks all technical rules and quality requirements.
In addition, the Wkb increases the builder's liability for construction errors.

- The Wkb will only apply to new construction in 2024 (see also which structures are covered by the Wkb). Conversion of buildings will follow at a later stage.

What should I do if my structure falls under the Wkb?
If your structure falls under Wkb, you must hire a quality assurance contractor and file a construction notification (it involves several notifications).
Engaging quality assurance contractor
You must, before you can build, hire an independent quality assurance contractor.
Your quality assurance contractor must, in advance
- Review whether your building plan meets the technical regulations;
- record what risks are involved;
- record what measures must be taken to ensure that your building plan ultimately complies with the rules;
- take into account local conditions.
To do this, the quality assurance contractor must draw up an assurance plan. In a quality assurance plan, the quality assurance officer indicates what must happen so that your building plan ultimately meets all the technical building regulations. He or she then watches the construction site with the contractor. If everything is in order when the construction is finished, he or she will draw up a declaration.
A quality assurance professional is always independent. So you are not supposed to use someone who plays a role in the building plan. You can find an overview of quality assurance companies via the Register Quality Assurance.
Construction notification
Once the assurance plan and risk assessment has been prepared by the quality assurance contractor, you (or your architect, contractor or consultant) must submit a construction notification through the environment counter.
NOTE Health make sure you submit a complete construction notification, otherwise we cannot accept it.
You may not start building until the permit is granted AND the building notification is approved.
During construction
- During construction, the quality assurance engineer will monitor the construction work.
- Your contractor must keep records during construction that record exactly what he is building and demonstrate compliance with the rules and the assurance plan.
- The quality assurance contractor and the contractor must ensure that any defects are corrected during construction.
Finish notification
Once your building plan is complete and meets all the rules, the quality assurance contractor will prepare a statement.
You must send this statement to the municipality along with the contractor's file (including drawings and calculations of the structure, uses, materials used, manuals and maintenance guidelines for plant/equipment, etc.) as a completion notice.
The file must include the following documents, among others:
- Drawings and calculations of the structure;
- uses;
- materials used;
- plant/equipment manuals and maintenance guidelines.
NOTE Health make sure the completion notice is complete, otherwise we cannot accept the notice and you will not be able to occupy the building.
The process and various reports
- Construction notification, at least 4 weeks before start of construction work
- Start of construction, at least 2 working days before the start of construction work
- Notice of completion, at least 2 weeks before taking the structure into use
- End of construction, on the first working day after all construction work is completed.
All these notifications are done at the Environment Counter
- For the construction notification, you must hire an independent quality assurance contractor. The quality assurance contractor makes a assurance plan, in which he records the risk assessment and control measures. With this assurance plan, you or your authorized representative will submit the construction notification. You must then also indicate which quality assurance provider you have and which instrument they use. You must file this construction notification no later than 4 weeks before you plan to build.
- Once the permit is granted AND the construction notification is accepted, you may start construction. Report the start of construction at least 2 working days before the start of construction work.
During construction, the quality assurance contractor will inspect the construction work.
Your contractor must keep a file during construction. In it he records exactly what he is building. The quality assurance officer and the contractor must make sure that any mistakes are corrected during construction. - Before you start using the structure, you must file a completion notice. You must then submit the contractor's dossier together with the quality assurance officer's statement with the notification of completion. You must submit this notification of completion no later than 2 weeks before you want to put the structure into use.
- Is all construction work complete? Report the end of construction work no later than the first working day after construction is completed.
Which structures are covered by the Wkb?
Construction works are divided into consequence classes. The greater the consequences if something goes wrong with the structure, the higher the consequence class. The Wkb goes into effect on January 1, 2024 for new structures in consequence class 1. This includes the following structures:
- ground-mounted dwellings including garage and office, apartments, care homes and dwellings for room rental, among others, do not fall under consequence class 1;
- houseboats and other floating dwellings;
- ground-mounted vacation homes or other vacation accommodations;
- structures of up to 2 storeys with an industrial function. For example, warehouses, cattle sheds, production halls, warehouses, greenhouses and workshops, including offices and canteens.
Office buildings and retail premises do not fall under consequence class 1; - structures of up to 2 storeys with an industrial function built near another use function. For example, a warehouse near a store. The warehouse falls under consequence class 1 but the store does not;
- bridges for slow traffic up to 20 meters span. For example, small bridges for cyclists, pedestrians, wheelchair users and mopeds;
- Other structures that are not buildings, up to a maximum height of 20 meters. For example, small transmission masts, antennas and retaining walls. Water retaining structures do not fall under consequence class 1.
The structures that do not fall under consequence class 1 and are excluded for the Wkb.
Local conditions
When building under quality assurance, specific local conditions or risks should be considered as a starting point for the risk assessment and assurance plan.
The specific local conditions for the municipality of Son en Breugel are included in the Environment Plan. This Environment Plan currently consists of the existing zoning plans, ordinances and other policies.
