1. Decision list and public decision list B&W meeting dated March 24, 2020 / Hans Gaillard

The college adopts the decision list and the public decision list according to the drafts.

2. Street naming / Hans Gaillard

On the site of the former elementary school "de Gentiaan", (IJssellaan/ Amerikalaan/ Afrikalaan/ Rijnlaan) construction of 28 housing units will begin in the 2nd quarter of 2020. The new street in this project should be named. The college is authorized to give a name.

The college decides to agree to the proposal to name it: the Linge.

3. Exemption for loading and unloading supermarkets / Hans Gaillard

The college decides to grant the supermarkets in Son en Breugel exemption from the provisions of Article 5.8 of the General Local Bye-Laws. This dispensation means that the supermarkets are permitted to park 24 hours a day (Monday through Sunday) a vehicle that, including any load, has a length of more than 6 meters and/or a height of more than 2.4 meters, for the purpose of loading and unloading. This exemption is valid for the period until May 1, 2020.

4. Policy framework for housing labor migrants / John Frenken

It was recently established that the process surrounding the creation of a policy framework for housing labor migrants for the municipalities of Nuenen and Son en Breugel was not well embedded in our organization. Your board has previously recognized the urgency for the preparation of a policy framework and appointed Alderman Frenken as administrative leader. However, for a good embedding, an updated plan of approach needs to be established as well as a new official principal appointed. This proposal provides for that.

College Decision:

  1. To approve the plan of action "policy framework for housing labor migrants Nuenen and Son and Breugel";
  2. Adopting the project structure described therein whereby for son and Breugel Alderman John Frenken is appointed administrative lead and Roel Welten is appointed official lead.

5. Subsequent payment of service charges Municipal portion CMD / Jan Boersma

Based on current data, Zuidzorg has looked at the service costs for the years 2014 - 2018. This shows that the costs charged were underestimated and ZuidZorg wishes to still charge these costs to the municipality of Son en Breugel, based on the general Requirements to the lease. In consultation, agreement was reached.

College Decision:

  1. To agree to an additional recovery of €12,769.58 including VAT for the years 2014 - 2018;
  2. To adopt the letter from ZuidZorg;
  3. Cover the costs from the "Unforeseen Incidental" line item.

The mayor assigned the signing to Alderman Jan Boersma for approval.

6. Adjusting rate of outpatient emergency care youth / Paul van Liempd

The rate for the deployment of outpatient emergency care youth was determined in 2018. This assumed an hourly deployment of 35 hours per month. It turned out that the average hourly deployment is lower, namely 25 hours. The rate that municipalities pay for outpatient emergency care youth is therefore reduced.

College Decision:

  1. Reduce the rate for outpatient emergency care 0-18 (product 46B01) and outpatient emergency care 18-23 (product 46J00) from €4,148.15 to €2,401.94 effective April 1, 2020.

7. Municipality's powers in relation to antennas and 5G / Paul van Liempd

At the January 15, 2020 meeting of the General Affairs Committee, it was promised that the committee would be informed by a memo about a municipality's powers regarding antennas and 5G.

The colleges resolve to:

  1. To approve the memo ''Powers of the Municipality in relation to antennas and 5G'' and send it to the General Affairs Committee.

8. Continuation of solar panel project The Green Zone / Paul van Liempd

The regional solar panel project The Green Zone (DGZ) started on April 1, 2018. The duration of the project is 2 years with the possibility of extending the contract with the Service Provider once by one year. To finance the regional solar panel project, on June 22, 2017, the council decided to take out a loan from the Province of North Brabant totaling €2,535,844, with which 507 homes can be equipped with solar panels. Up to week 7 of this year, loans totaling € 960,505 had been granted for a total of 150 PV installations. The college is proposed to continue the contract until April 1, 2021.

College Decision:

  1. Agree to continue the solar panel project The Green Zone until April 1, 2021;
  2. Agree to extend the application period for the period April 1, 2020 to April 1, 2021.

9. Financial security providers youth aid and wmo during Corona crisis / Paul van Liempd

The guidelines due to the coronavirus affect the way care providers Youth and Wmo can carry out their support to residents. The care providers may not be able to (fully) meet the contract agreements. The VNG and the State call on municipalities to continue to pay the care providers according to the contractual agreements until June 2020. The additional costs incurred by municipalities for this will be reimbursed by the State.

College Decision:

  1. Bears Health for the funding of turnover by the municipality towards youth and social support providers during the period from March 1 to June 1, 2020, even if the support is provided in a different way;
  2. Reimburse additional costs resulting from the additional measures due to the Corona crisis to providers of youth aid, youth protection, youth probation and social support from March 1 to June 1, 2020. This applies to both contracted providers and providers working through personal budgets;
  3. provides space around providers' contractual accountability requirements from March 1 to June 1, 2020.

10. Binding nomination of member Supervisory Board PlatOO / Jos de Bruin

The Supervisory Board of School Board PlatOO consists of five members. For a vacancy, PlatOO nominates a new member.

The college decides to approve the appointment of Mr. J. Boerenkamp as a member of the Supervisory Board of School Board PlatOO.

11. Extension board agreement Dommel Valley Library / Jos de Bruin

Library work in the municipalities of Geldrop-Mierlo, Nuenen c.a. and Son and Breugel is carried out by Dommeldal Library on the basis of a board agreement. This describes the quantitative and qualitative agreements between the four parties and was concluded for the period 2016-2019. As stipulated in the agreement, in the past year 2019, official preparations have started to arrive at a new joint management agreement for the period 2020-2023 with municipalities Geldrop-Mierlo, Nuenen and possibly Heeze-Leende. It is desirable to first establish a vision for library work prior to entering into a new agreement. An extension of the current board agreement by one year is necessary for this purpose.

 College Decision:

  1. Extend the current 2016-2019 board agreement for one year to Jan. 1, 2021;
  2. To agree to draft a new joint library vision in cooperation with Dommeldal Library, municipality of Geldrop-Mierlo, municipality of Nuenen and municipality of Heeze-Leende and to enter into the new agreement based on the vision.

12. Request for retail enforcement at location Planetenlaan/Olen in Breugel / Hans Gaillard

A request for enforcement has been filed. The request relates to retail activities at Planetenlaan and Olen in Breugel, which, according to the applicant, violate the zoning plan. The recommendation is to agree to this.

College Decision:

  1. initiate the enforcement process and also engage in discussions with the individual to remove the conflict in his business operations;
  2. sending an intention to the individual; 
  3. inform the applicant by sending a copy of the intention.

13. Adopt 'enriched area vision Brainport City' and 'enriched spatial program Brainport' / John Frenken

According to the "Collaboration Agenda 2018-2025" of the Eindhoven Urban Area, within the Space theme we are exploring "how to enrich the area vision Brainport City and the related adaptive program into a region-wide and regionally supported agenda and implementation program." This exploration and enrichment has taken place over the past year. This has resulted in an "enriched Area Vision Brainport City" as well as an "enriched Spatial Program Brainport". Both documents have been adopted at the end of 2019 by the portfolio holders' consultation Space of the Urban Area Eindhoven and are now offered for adoption to the 9 colleges with the aim of having these documents serve as a new starting point for cooperation on the theme Space. In doing so, the intention is to continuously develop both the vision and the spatial program.

College Decision:

  1. Adopt the Enriched Area Vision Brainport City and the Enriched Spatial Brainport as a common basis for cooperation on the theme of Space within the Urban Area Eindhoven;
  2. Inform the City Council of the adoption of the Enrichment Area Vision Brainport City and the enriched Brainport Spatial Program by means of the Council Information Letter included in the advice.

14. Mandate application SDE+ HetEnergieBureau / Jan Boersma

Subsidy applications for the SDE+ scheme can be made until April 2. For the total of 139 solar panels on the combination building and the town hall phase 2 we want to apply for a subsidy. The Energy Office will do the application for the municipality of Son and Breugel and will be given the mandate to do so.

The college decides to mandate HetEnergieBureau B.V. to apply for the subsidy of the SDE+ scheme with the RFO for 139 solar panels to be installed on the combination building and town hall phase 2.

15. Maintenance contract town hall / Jan Boersma

The new construction and renovation have little maintenance in the initial period and the focus here is on proper coordination to direct the various subcontractors.
The municipality's contact person regularly receives requests for repairs and/or maintenance. We are looking for a party that can relieve the municipality of these concerns. We have accommodated this in a maintenance contract. The purchasing strategy and the contract have been discussed with Bizob and the municipal buildings manager.

College Decision:

  1. To take note of the abbreviated procurement strategy and maintenance contract;
  2. enter into the proposed contract with the addition of a term of 2 years (with an extension option of 1x 1 year, this with a review after 2 years);
  3. de kosten (< € 10.000,00/jaar) voor het 1e jaar ten laste brengen van de post onvoorzien (zie financiële paragraaf);
  4. costs for 2021 will be included in the 2021-2024 framework note.

16. Stormwater disconnection evaluation 2019 / Jan Boersma

A request has come from the General Affairs Committee to evaluate stormwater disconnection for the year 2019. This evaluation will be presented to the college.

The college decides to approve the memo "Stormwater Disconnection Evaluation 2019" and offers it to the General Affairs Committee for notification.
 

17. Measures market due to Coronavirus / Jan Boersma

Because there was uncertainty about the continuation of the weekly markets, a unified decision was made Thursday by the three Brabant Safety Regions. The weekly markets in Brabant can continue in modified form from Monday, March 23. Only vendors of foodstuffs (primary necessities of life) can enter the markets. No food may be consumed and a modified market layout will temporarily apply.

College Decision:

  1. to allow the weekly market to continue subject to measures against the coronavirus as listed in items 2 through 4 and for as long as these measures are necessary;
  2. allowing only food vendors and prohibiting non-food vendors from taking their place in the market;
  3. prohibiting the consumption of food in the marketplace;
  4. Agree to the temporary market layout where market stalls are placed further apart so that visitors are given the opportunity to keep their distance from each other;
  5. not charge non-food vendors for the missed market days;
  6. Adopt item 1 and item 2 retroactively through March 23, 2020.
