1. Decision list and public decision list B&W meeting dated March 10, 2020 / Hans Gaillard

The college adopts the decision list and the public decision list according to the drafts.

2. Renewal of waiver of residency requirement Alderman Paul van Liempd / Hans Gaillard

According to the Municipal Law, an Alderman must reside in the municipality where he or she is an Alderman . The City Council can waive this requirement for up to one year at a time. On May 9, 2019, Paul van Liempd, who lives in Eindhoven, joined us as Alderman and was granted a one-year waiver of residency from Son en Breugel. The purpose of this proposal is to propose to the City Council to extend this waiver from May 9, 2020 to May 8, 2021.

The college notes and concurs with the draft council proposal "Renewal of waiver of residency requirement of Alderman Paul van Liempd.

3. Decision on objection regarding request for compensation under Article 82 AVG / Hans Gaillard

Mr. Voorbach of removalrequest.com submitted a request for compensation under Article 82 AVG on behalf of the applicant. By decision dated October 29, 2019, the college denied this request. Mr. Voorbach filed a notice of objection against this decision. The Objections Committee recommends that the objection be declared inadmissible. It is proposed to follow the committee's advice.

The college decides:

  1. Declare the objection inadmissible;
  2. uphold the contested decision;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

4. Supervisory Review Housing Permit Holders 2nd half 2019 / Jan Boersma

Based on the criteria from the Policy Framework Intergovernmental Supervision 2016-2019, the Province of North Brabant assesses the supervision of housing of permit holders.
For the 2nd half of 2019, the province assessed our municipality as excusable. This means that we have not fully met the target, but the reason is that we have not had enough pairings from COA.

College Decision:

  1. To take note of the province's assessment regarding the housing of permit holders. For the2nd semester of 2019, the province assessed the municipality as excusable. Because not enough permit holders were linked to the municipality by COA, the target could not be met;
  2. Agree to the text for the council information letter and include the text in the next council information letter.

5. Policy rules for play and exercise facilities / Jos de Bruin

In recent years, the management of play and exercise facilities in Son en Breugel has been policy-poor. Existing facilities are inspected and maintained annually.
However, the needs in a neighborhood regarding play and exercise facilities can change. Various requests from residents indicate this. The policy rules for play and exercise facilities indicate the principles and process the municipality uses for the (re)design of facilities in the neighborhood.

College Decision:

  1. To adopt the Play and Exercise Facilities Policy Rules;
  2. To inform the Council of this through the next Council information letter.

6 Decision on objection regarding deletion request for personal data / Hans Gaillard

In the b&w meeting dated Oct. 1, 2019, the college decided to reject the removal request submitted by Mr. Voorbach of Removal Request.com on behalf of the applicant. The request relates to the removal of the applicant's personal data on the VNG forum. Mr. Voorbach filed a notice of objection to the rejection decision. The Objections Committee concluded that the objection should be declared inadmissible. Since this was also the municipality's conclusion in the reconsideration of the objection procedure, the college is advised to follow the advice of the Objections Committee.

The college decides:

  1. Declare the objection inadmissible;
  2. Revoke the contested decision with the proviso that the reasons be further
    supplemented and otherwise upheld;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

7. Draft zoning plan "Son Zuid; Begoniastraat" incl. supplement / John Frenken

On December 4, 2019, the college approved the final development of the building initiative of nineteen homes on the "Kanaaldijk Noord" (Begoniastraat) subarea.
The required draft zoning plan has been prepared for the realization of the nineteen row houses on the subarea "Kanaaldijk Noord (Begoniastraat).
As part of the adoption procedure, the draft zoning plan must be released for the period during which views may be submitted. As of that time, the initiator has commissioned an outside party to prepare the required draft zoning plan. This draft zoning plan is attached.

The college decides to:

  1. on the basis of the "Notification Memorandum Form-Free EIA Assessment Son Zuid; Begoniastraat" submitted by the (on behalf of the) initiator, to determine that there is no reason to go through an EIA procedure;
  2. To take note of the draft zoning plan "Son Zuid; Begoniastraat";
  3. To release the draft zoning plan "Son Zuid; Begoniastraat" for further adoption procedure (publication for views).

8. SGE: portfolio holders' meeting Economy, dated March 19, 2020 / Jan Boersma

Pending the guidelines regarding the COVID-19 virus (Corona), the portfolio holder consultation Economy of the Urban Area Eindhoven is scheduled for March 19, 2020. Through this advice, the agenda and underlying documents are submitted to your college for notification.

9. Pilot "Environmental Plan Sciencepark"; adoption "Outline memorandum on Environmental Plan Sciencepark / John Frenken

In 2018, the translation of the "Vision Sciencepark" into a "(pilot) environmental plan Sciencepark" (formally a zoning plan with broadened scope) was started. To this end, a number of substantive working sessions were organized in 2018 and 2019 with the companies located at Sciencepark and the internal policy fields. The ambitions in areas such as sustainability, development space, design of outdoor space, expansion of functions, ambitions, energy, etc.) were examined as a translation of the development principles from the "Vision Sciencepark". The progress of this project has progressed so far that now, as a result of all the working sessions and bilateral consultations, the draft "Starting Points Memorandum Environmental Plan Sciencepark" (d. March 06, 2020) is available.

This because the "Outline Memorandum of Principles Sciencepark Environment Plan" is the foundation for the now to be drawn up draft "Environment Plan Sciencepark" as a translation of the "Vision Sciencepark" and anticipating the possibilities of expansion of activities under the Crisis and Recovery Act (as a pilot forerunner of the Omgevingswet).

College Decision:

  1. To take note of the "Memorandum of Principles for the Environmental Plan Sciencepark" as the outline for the "Environmental Plan Sciencepark" to be drafted (effectively a zoning plan with broadened scope);
  2. To propose to the council to adopt the "Outline Memorandum of Principles for the Sciencepark Environment Plan" as the outline for the (pilot) "Sciencepark Environment Plan" in accordance with the draft council proposal and draft council decision;
  3. To seek the advice of the council land area committee.
