1. Non-public decision list and public decision list b&w meeting dated May 6, 2020 / Hans Gaillard 

The college adopts the decision list and the public decision list according to the drafts.
 

2. Enforcement / Jan Boersma

A piece of municipal land, adjacent to the backyards belonging to the houses on De Klerkstraat 1 and 3, is unlawfully in use by the residents. Also, the piece of land with the destination 'Traffic' is laid out as a garden. It is proposed to sell the piece of land in question to the owners of these residences and to positively zoning the existing use as 'garden' in the coming zoning plan revision, thus eliminating the unlawful situation. Due to the principle of equality, similar plots in the neighborhood are also marked as saleable on the sale map that is also published on the municipal website.

College Decision:

  1. To sell a piece of municipal land, adjacent to the rear garden belonging to the house on De Klerkstraat 1, to the owners of this house for a land price of € 100, - perm2;
  2. To sell a piece of municipal land, adjacent to the rear garden belonging to the house on De Klerkstraat 3, to the owners of this house for a land price of € 100, - perm2;
  3. legalize the conflicting use of these lands by positively zoning the existing use as "garden" in the upcoming zoning review for this area;
  4. To avoid unequal treatment, designate similar strips in this district as saleable and mark them as such on the sale map.


3. Regional integration procurement 2020 - 2025 / Paul van Liempd

On July 1, 2021, a new civic integration system will start. Due to the low number of persons integrating in the smaller municipalities, the Ministry of Social Affairs and Employment gives the explicit assignment to procure regionally. To meet this assignment, the Municipality of Eindhoven, as central partner, has been asked to draw up a Service Provision Agreement (DVO) for the joint procurement of two learning routes (B1 and Education Route) of the new civic integration system, for the municipalities in Southeast Brabant.

College Decision:

  1. Agree to regional procurement and the Service Agreement for the period from May 1, 2020 to July 1, 2025, including Appendix 1 "Offer for Procurement of Civic Integration" and Appendix 2 "Mandate Decision on Civic Integration.
  2. Mandate the Municipality of Eindhoven to carry out the procurement described in the DVO;
  3. To provide an implementation budget of €2,872 for 2020, €1,577 for 2021, €1,704 for 2022, €1,704 for 2023, €1,704 for 2024 and €852 for 2025;
  4. To request the Mayor to authorize Alderman P. van Liempd to sign the DVO and interim amendments for said period on behalf of the College of Son and Breugel.

4. Rental agreement storage art collection / Jos de Bruin

Currently, two storage boxes are rented from Merkson where the municipality's art collection is stored. In order to properly perform the work and store the art collection in a safe manner, it is necessary to use a larger storage box.

The college decides to adopt the lease agreement private Box/store number 5 +2 as per the draft.
 

5. Decision on objection rejection of grant application / Jos de Bruin

On November 5, 2019, the college decides to reject the grant application. On November 21, 2019, the college receives an objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.

College Decision:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

6. Committee agendas and lists of commitments for May / Hans Gaillard

The college discussed agendas and lists of commitments from the May committee meetings.

On November 28, 2019, the college decides to reject the grant application.
On December 12, 2019, the college receives an objection to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld with the correction to the ground for refusal.

College Decision:

  1. Declare the objection unfounded;
  2. uphold the contested decision with the proviso that the grant application be rejected under the provisions of Article 2 of the Policy Rules on One-Time Grants for Social Welfare;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

8. Presentations 'the zoning Wonen in Son en Breugel' and 'enriched area vision & spatial program' for the council committee Grondgebiedzaken of May 18, 2020 / John Frenken

The committee was promised to explain via a presentation how "Housing" is regulated in our zoning plans. As a fulfillment of this commitment, the committee will be informed via a presentation. According to the "Samenwerkingsagenda 2018-2025" of the Stedelijk Gebied Eindhoven (SGE), within the theme Space, "in what way we can enrich the area vision Brainport City and the related adaptive program into a region-wide and regionally supported agenda and implementation program". This exploration and enrichment took place in 2019. This has resulted in an "enriched Area Vision Brainport City" as well as an "enriched Spatial Program Brainport". Both documents have been adopted at the end of 2019 by the portfolio holders' consultation Space of the SGE and now adopted by all colleges (on March 31, 2020 in Son and Breugel) with the aim of having these documents serve as a new starting point for cooperation on the theme Space. As a fulfillment of the agreements, the committee will be informed through a presentation.

The college decides to take note of the presentations "the zoning for housing in Son and Breugel" and "enriched area vision & spatial program" for the May 18, 2020 council committee on Territory Affairs.
 

9. Omgevingswet; state of affairs incl. supplement May 2020 / John Frenken

As of February 2019, work is underway on the Omgevingswet Implementation Program. Funds for this have been made available by the council in the budget for the period 2017 to 2020. Much has already been done, but much remains to be done as well. There is increasing insight and understanding of the things that must be arranged in order to work with the Omgevingswet and to continue to offer citizens the minimum level of service.
For the purpose of this advisory report, we have provided insight into where we are, what we have done in the meantime, what things employees need, what commitment is needed to meet the municipal ambition level and what minimum statutory matters must be arranged. In April 2019 the implementation program Omgevingswet Son en Breugel started. On April 1, 2020, the Minister announced that the entry into force of the Omgevingswet will be delayed (not postponed). Together with the circumstance that not enough time could be deployed in working sessions of the environmental vision and the environmental plan, the evaluation of the past year and the things that still need to be done, this has been reason to study a number of alternatives "how to proceed".

The college decides to:

  1. take note of the impact if the approach to the implementation of the Omgevingswet is adjusted;
  2. adjust the municipal ambition level, such that the municipal work on the environmental vision and the environmental plan is suspended until
    October 1, 2020, under the condition that by then the necessary replacement capacity has been arranged and a full team can tackle the work;
  3. Continue the work of the design team implementation program unabated but change the frequency to a biweekly activity;
  4. thereby establish that municipal ambitions are adjusted, such that adoption of the environmental vision can be scheduled for the end of 2021 (instead of the end of 2020) and adoption of the environmental plan can be scheduled for the second half of 2022 (instead of the second half of 2021);
  5. during the breathing space until October 1, 2020 (for the work on the environmental vision and the environmental plan) to ask the Omgevingswet Program Team, in consultation with the external consultants, to prepare a once again new work plan based on the continuation of municipal work from October 1, 2020;
  6. To take note of the insight offered by the Omgevingswet Program Team in the context of the implementation of the Omgevingswet in the annex on the activities carried out and steps still to be taken;
  7. To propose to the council to make available the additional budget required for the Omgevingswet Implementation Program in accordance with the draft council proposal and council decision;
  8. ask the council general affairs committee for its opinion and prior to this inform them of the state of affairs through a presentation.
