2. General Board MRE dated February 23, 2022 / Hans Gaillard

On February 23, 2022, the next meeting of the General Board of the Eindhoven Metropolitan Region will take place. Through this advisory note, the agenda and documents are submitted to the college for notification.

The college takes notice of the agenda, related documents and annotations made for the consultation of the General Board of the Metropolitan Region Eindhoven on February 23, 2022.

3. Self-evaluation Basic Registration of Persons and Travel Documents 2021 / Hans Gaillard

The security manager of the Basic Registration of PersonsBRP) and the Uniform Standards Single Information Audit (ENSIA) coordinator conduct an annual self-assessment of the set-up, operation and information security of the BRP. The results of this are the responsibility of the college. There is also a self-evaluation on the Travel Documents component. The mayor is responsible for the results. For both the BRP and the travel documents, the self-evaluation is divided into a quality monitor for the organization and operation and the ENSIA for the information security component. With this, we meet the legal standards set for us.

The College decides:
1. to adopt the results of the Self-Assessment BRP 2021;
2. to accept the results of the Travel Documents Self-Assessment 2021 for notification.

4. Draft amendment plan Lieshoutseweg 3 / Jan Boersma

On July 14, 2021, the college approved the request in principle to split the property at Lieshoutseweg 3 into two residences. This under a number of Requirements. Initiator has elaborated the request into an amendment plan, in which the Requirements have been incorporated. It is now up to your college to release the plan for the procedure.

The college decides:
1. enter into the anterior agreement with reference 1042309 with initiator and publish the business content of the agreement;
2. to make the draft amendment plan "Buitengebied; Lieshoutseweg 3" with plan IDN NL.IMRO.0848.BPW830BUITENGEBIED-ON01 available for public inspection for a period of six weeks, after the agreement has been signed by all parties.

5. Principle request for spatial development Wolfswinkel 4 / Jan Boersma

The new owner of Wolfswinkel 4 has asked to be allowed to use the amendment authority to convert this agricultural zoning to residential and thereby deviate from the rules to demolish excess farm buildings. Given the cultural-historical values of the stables, we propose to cooperate in principle with this under Requirements

The college decides:
1. to grant approval in principle, under Requirements to convert the zoning from agricultural to residential, leaving the surplus farm buildings standing due to cultural-historical values.

6. Motion to keep Ekkersrijt and Sciencepark vital / Jan Boersma

On November 11, 2020, the City Council unanimously adopted a motion "Keeping Ekkersrijt and Sciencepark Vital. The college is requested to continue to sustainably develop business park Ekkersrijt and Sciencepark as an economic and sustainable top location. Enclosed you will find the motion and a state of affairs expressed in a draft text proposal for the next council information letter.

The college decides to continue fulfilling the motion "Keeping Ekkersrijt and Sciencepark vital" and agrees with the text proposal for the next council information letter.

7. Viewpoint Notitie Reikwijdte en Detailniveau MER, wijziging Luchthavenbesluit Eindhoven / Paul van Liempd

On Jan. 21, the Ministries of Defense and Infrastructure & Water Management published the Notitie Reikwijdte en Detailniveau MER (NRD) for the amendment of the Eindhoven Airport Aviation Decree. The Plan MER aims to give substance to the recommendations of the Van Geel pilot case. Views can be submitted until March 3, 2022. Regionally, the regional municipalities submit one view on the NRD. In addition to the regional view, there is a local view that zooms in on the flight route that flies over Son en Breugel. The local opinion is an addition to the regional opinion and has been coordinated with the regional municipalities.
The college decides:

1. to adopt the regional outlook on the NRD of the Eindhoven Airport Airport decision;
2. to grant the municipality of Eindhoven the mandate to submit the outlook also on behalf of the municipality of Son en Breugel;
3. to adopt the local view on the NRD of the Eindhoven Airport Airport Airport Decision;
4. to send the views to the municipal council for information.

8. Green Deal Offices / Paul van Liempd

From January 1, 2023, every office building of more than 100 m2 must have at least an energy label C. With the Metropolitan Region Eindhoven (MRE) Green Deal Offices, the municipality encourages office owners to take a step further and renovate their office buildings to energy label A. On the other hand, they get 2.5 years more time for this renovation. During this period there will be no enforcement of the energy label and
other sustainability measures. In addition, the municipality offers professional guidance. Offices that do not participate in the Green deal will be inspected for the energy label requirement starting in 2023.

The College decides:
1. agree to participate in the MRE Green Deal Offices;
2. to make arrangements in the work program of the Environment Service to inspect the NOT participating office owners within 1.5 years after January 1, 2023. Participating offices will not be monitored.

9. Decentralized Implementation Plan Clean Air Agreement / Paul van Liempd

In the Clean Air Agreement, it was agreed that "Municipalities and provinces develop specific measures in decentralized implementation plans and commit to them." A format has been prepared for the decentralized implementation plans. This format will also be used for monitoring the agreement and as preparation for calculating exposure to air pollution and health gains achieved. The measures completed in the format stem from the municipality's existing policy. There are no new measures in it.
The college decides to adopt the Decentralized Implementation Plan Clean Air Agreement Son en Breugel.

10. Regional policy vision "The Groene Dommelvallei, dat zijn wij en dat blijven wij" / Paul van Liempd

Within the Eindhoven Urban Area, the Dommelvallei municipalities (Son en Breugel, Nuenen and Geldrop-Mierlo) have a joint task to shape the green task. To specify this further, the regional policy vision "The Green Dommelvallei, that's us and that's what we'll stay" was drawn up. This includes both joint and individual green projects.

The college decides:
1. adopt the regional policy vision "De Groene Dommelvallei, dat zijn wij en dat blijven wij";
2. adopt the text for the Council Information Letter on the regional policy vision "The Green Dommel Valley, that's us and we'll stay that way" and add it to the Council Information Letter of February 25.

11. Visual art management plan in public spaces 2022-2031 / Jos de Bruin

There is currently no management plan for the visual art objects in the public space owned by the municipality of Son en Breugel. These art objects are therefore not currently being maintained on a systematic basis. Maintenance is obviously necessary to keep the works of art in good condition so that they continue to beautify the public space. The draft management plan describes how we can maintain the art objects in the coming years.

The College decides:
1. adopt the management plan "Visual art in public spaces 2022-2031";
2. agree to offer the image-forming memorandum to the City Council.

12. Decision on appeal decision penalty payment for failure to decide on time / Hans Gaillard 

On Sept. 9, 2021, the college decides that no penalty for failure to make a timely decision is owed to Platform Keelbos Foundation due to the lack of an application to make a traffic decision. On September 16, 2021, the college receives a letter of objection from Platform Keelbos Foundation against the above decision. The Objections Committee recommends that the objection be declared unfounded, that the contested decision be upheld, and that the request for reimbursement of travel and leave expenses be rejected.

The College decides:
1. declare the objection unfounded;
2. uphold the contested decision;
3. reject the request for reimbursement of travel and subsistence expenses;
4. refer to the opinion of the Objections Committee for the reasons for the decision.

13. Founding meeting K80 / Hans Gaillard

Last year, the college expressed interest in participating in the yet-to-be-formed K80. This is a platform/networking organization uniting small municipalities in the Netherlands. The founding meeting of the K80 will take place on Friday, February 25, 2022.
The college decides:
1. accept the agenda and related documents of the inaugural meeting of the K80 on Friday, February 25, 2022, for notification;
2. to become a member of the K80.

14. (Re)development Kanaalstraat 31-33; decision in principle incl. preconditions and principles / John Frenken

On September 2, 2021, 2R+ Projectontwikkeling (hereafter initiator) submitted a request in principle for the redevelopment of the plots Kanaalstraat 31-33 in Son en Breugel. The initiator wishes to enable a residential development at the site of the store and the adjacent plot. The initiative consists of two phases, of which only phase 1 is relevant now. Phase 1 consists of the transformation of the store into 2 residences, the realization of 3 ground-connected row houses and on the part directly behind it the realization of 6 ground-connected row houses. The preconditions and principles have been outlined on the basis of the existing policy during an environmental meeting. The college is requested to agree with the 'preconditions and starting points redevelopment Kanaalstraat 31-33' for the elaboration by the initiator of the initiative proposal. The initiator and his advisors are therefore invited to present a detailed plan based on these conditions.


The college decides:
1. to agree to the 'preconditions and principles for redevelopment Kanaalstraat 31-33' for the redevelopment of the development site Kanaalstraat 31-33;
2. to inform the initiator in writing of the 'preconditions and starting points for the redevelopment of Kanaalstraat 31-33' and to request him to come up with a detailed plan to meet them.
Mayor Gaillard did not agree with the decision.

15. Draft Houtens 11 zoning plan / Jan Boersma

The college wishes to implement "Frameworks as Heading". The Houtens 11 development site is in the picture for this purpose. An agreement has been concluded between Woonveste Projectontwikkeling and the municipality to develop this location for 14 homes, of which 7 will be low-priced owner-occupied homes and 7 medium-priced owner-occupied homes. A mix of young and elderly people is envisioned. This zoning plan provides the legal framework to build the homes on this location.

The College decides:
1. not to prepare a (further) environmental impact assessment for the change of function and redevelopment of Houtens 11 and the amendment of the zoning plan required for that purpose;
2. To declare Crisis and Recovery Act applicable to zoning plan Son-Zuid; Houtens 11;
3. to release the draft zoning plan Son-Zuid; Houtens 11 for public inspection for a period of 6 weeks;
4. to release the draft decision on higher limit values for location Houtens 11 for public inspection for a period of 6 weeks;
5. to publish these decisions in the Staatscourant and the MooiSonenBreugelKrant.

16. Report Further Traffic Analysis and RIB 2nd connection Ekkersrijt / Jan Boersma

After an intensive process together with the Municipality of Eindhoven, the consultancy firm Movares has completed the Further Traffic Analysis to arrive at a second connection Ekkersrijt. To this end Movares has delivered a final report, which is presented for adoption. The report is also the prelude to start the exploration phase.
The college decides:
1. take note of the report;
2. inform the city council about this with the Council Information Letter (RIB) and the report under 1.

17. Gouvernance structure regional approach to domestic violence and child abuse / Paul van Liempd

In order to improve the regional approach to 'violence belongs nowhere', a proposal for organizing regional governance of this approach has been developed on behalf of the center municipalities of Helmond and Eindhoven. The 19 regional municipalities are asked to endorse the proposed governance structure. The financial consequences of implementing this proposal will be provided by the two center municipalities.

The college decides to express support to organize the steering of the regional approach to domestic violence and child abuse in Southeast Brabant by:
a. developing the existing steering committee 'Violence has nowhere to go' into a steering committee 'domestic violence and child abuse', with permanent delegation from the central municipalities, regional municipalities and partners from the Health and safety domain;
b. set up an official expert team with structural capacity from the municipalities, partners from the Health and Safety domain and experts by experience to prepare proposals;
c. make use of the existing structure of the Health and Safety House to positively endorse proposals in those situations that require decision-making by the 21 municipalities or other bodies (see Appendix 1).
