1. Non-public decision list and public decision list dated June 1, 2021 / Hans Gaillard
The college adopts the decision lists.
2.Compensation for procedural costs of objection proceedings / Hans Gaillard
A new decision on the objection was issued on May 11, 2021, regarding the objection of the Platform Keelbos Foundation. By mistake, no advice was given on the request for reimbursement of legal costs in accordance with Article 7:15 of the Awb.
The college decides to award the foundation a litigation fee in accordance with statement of foundation dated July 9, 2020.
3. Ordinance amending for the second time the General Local Ordinance 2019 municipality of Son and Breugel / Hans Gaillard
Sales and use of nitrous oxide are on the rise. Nitrous oxide is increasingly, and increasingly, being used by young, inexperienced users. Users face significant health risks. In addition, the use of nitrous oxide creates nuisances and nuisances. Currently, the possession and use of nitrous oxide is not prohibited. It is therefore difficult to take enforcement action against it. By amending the General Local Ordinance, enforcement action can be taken against the use of nitrous oxide.
The college decides to submit the council proposal "Ordinance for second amendment of the General Local Ordinance 2019 municipality of Son en Breugel" to the city council.
4. Redevelopment Ruysdaelstraat 2, adjustment of preconditions and principles and final response to letter Woonstichting 'thuis / John Frenken
On February 23, 2021, in response to the letter from Woonstichting 'thuis dated January 29, 2021, the college provided a draft response to a number of questions. One question, regarding what housing program is allowed at this location, was submitted by your college for a response to the council's Land Affairs and Civic Affairs committees dated April 08, 2021. The outcome of this consultation is that it has been advised that at least 20 housing units in the social rental sector will be realized at the location by Woonstichting 'thuis and will be rented out, which on the 1st letting will go to clients with a 24-hour permanent care need with WLZ indication as known to Doorpakken Wonen Foundation. The remaining development space is for the benefit of "regular" social housing. At the same time, a number of other issues have been provided that call for an addition/adjustment of the 'preconditions and principles' adopted by the college on July 7, 2020 that apply to the plan development by Woonstichting 'thuis. With this input, the college is asked to make a decision on a final response to the letter from Woonstichting 'thuis and the adjusted/added 'preconditions and principles'.
College Decision:
- Finalize the answers to the questions of Woonstichting 'home in the letter dated Jan. 29, 2021;
- To agree to the amended and supplemented "preconditions and principles" for the redevelopment of the Ruysdaelstraat 2 development site;
- Inform Housing Foundation 'Home in writing of the responses in response to the letter of Jan. 29, 2021, and the modified "preconditions and principles" and request that they come up with a developed plan that fulfills them.
5. Financial statements 2020 / Jan Boersma
The college prepares annual financial statements (consisting of the annual report and financial statements) each year. These are made available to the auditor for review in mid-April. The auditor presents her findings in a report and any amended version of the financial statements then goes to the council for adoption. In the auditor's report, the auditor has stated that the financial statements have been prepared fairly and lawfully. The council proposal also includes a proposal for profit appropriation.
The college accepts the draft auditor's report of findings and agrees and submits to the council for adoption:
- annual report and financial statements 2020;
- council proposal;
- response college to audit report.
6. Decision on objection rejection of application for IOAW benefit / Paul van Liempd
On December 3, 2020, the college decides to reject the application for benefits under the Income Support for Older and Partially Disabled Unemployed Workers Act (IOAW) at the standard for a single person. On January 8, 2021, the college receives a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded, that the contested decision be upheld and that the request for reimbursement of legal costs be rejected.
College Decision:
- Declare the objection unfounded;
- uphold the contested decision;
- Reject the request for reimbursement of legal costs;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
7. Optimization Agreements Urban Area Eindhoven 2021 / Hans Gaillard
On June 11, 2021, the Administrative Platform of the Urban Area Eindhoven (SGE) is scheduled. Through this recommendation, the agenda and underlying documents are submitted to the college for notification. Furthermore, prior to the Administrative Platform, the Optimization Agreements 2021 should be discussed in the individual colleges. In the June 11, 2021 Administrative Platform, each member will provide feedback on this discussion.
The College decides:.
- To take note of the agenda and underlying documents for the Administrative Platform of the Urban Area Eindhoven dated June 11, 2021;
- to discuss the Optimization Agreements Urban Area Eindhoven 2021;
- to inquire from the college members how they perceive their involvement in the cooperation of the Eindhoven Urban Area.
8. GFT/PMD collection frequencies upon accession to Joint Arrangement Blink per 1-1-2022 / Paul van Liempd
On March 18, 2021, the City Council approved a request for accession toward the Blink Joint Arrangement. It was agreed to investigate possible reductions within the bandwidth presented at the time. In addition to the current one, two new scenarios have emerged:
B. reduction PMD (PMD 1x per 2 weeks, GFT unchanged);
C. reduction PMD and VGF (PMD 1x per 2 weeks, VGF 3 months 1x per week and 9 months 1x per 2 weeks).
The college submits the choice to the council, but expresses its own preference for reducing both PMD and GFT collection. The college decides:
- Inform the City Council in an image-forming meeting about 3 scenarios for the collection frequency for GFT and PMD from 1-1-2022, namely:
A. current service (PMD 1x per week, GFT 9 months 1x per week and 3 months 1x per 2 weeks);
B. reduction PMD (PMD 1x per 2 weeks, GFT 9 months 1x per week and 3 months 1x per 2 weeks);
C. reduction PMD and GFT (PMD 1x per 2 weeks, GFT 3 months 1x per week and 9 months 1x per 2 weeks), with the college expressing preference for scenario C. - consult residents via a survey prior to the image-forming meeting.
9. Rejected application Tozo 3 / Paul van Liempd
The college decides to:
- Uphold the decision on the appeal, against the decision to reject the application for temporary living allowance (Tozo 3).
- To allocate to the person in question a sum of money from the corona fund and to grant a settlement mandate for this purpose to Alderman Van Liempd.
