2. Decision on objection / Paul van Liempd
On March 15, 2021, the board decides to reject an application for the extension of home care. On April 26, 2021, the board receives an objection from the objector against the above decision. The objections committee recommends that the objection be declared unfounded and that the contested decision be upheld.
College Decision:
- Declare the objection unfounded;
- uphold the contested decision;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
3. Framework Memorandum for the Southeast Brabant Environmental Service (ODZOB) 2023 / Paul van Liempd
Pursuant to the Joint Arrangements Act, the ODZOB's executive committee must submit the framework memorandum to the councils and provincial councils of the participating parties before April 15 of the year preceding the year to which the budget relates. The ODZOB has decided to submit the 2023 framework memorandum to the board and participants significantly earlier, for the following reason:
- the policy document is a precondition for the draft budget;
- It is customary to provide participants with the draft budget in March, so that the councils have sufficient time to submit any opinions.
College Decision:
- take note of the ODZOB 2023 Framework Memorandum;
- Place the Framework Memorandum on the list of incoming documents for the council.
4. Report by the Audit Committee / Paul van Liempd
The Son en Breugel Audit Committee participated in the investigation into the implementation of the Government Information (Public Access) Act (Wob). In the report 'The practice of the Government Information (Public Access) Act (Wob) at the municipality of Son en Breugel', the Audit Committee provides an overview of the findings of the municipality of Son en Breugel. In addition, a comparison is made with the findings at the 83 other municipalities investigated. The Audit Committee has requested an administrative response to the report.
College Decision:
- take note of the report by the Audit Committee entitled "The Practice of the Government Information (Public Access) Act (Wob) at the municipality of Son en Breugel";
- Agree to the administrative response to the report.
5. Eindhoven Urban Area Administrative Platform dated February 11, 2022 / Hans Gaillard
The Administrative Platform of the Eindhoven Urban Area (SGE) is scheduled for February 11, 2022. With this advice, the agenda and underlying documents are submitted to the council for information.
The council takes note of the agenda and supporting documents for the Eindhoven Urban Area Administrative Platform dated February 11, 2022.
6. Lease agreement - Van de Ven / Jan Boerma
On February 2, 2021, the council decided to lease three cadastral parcels, namely Son en Breugel Section G number 232, Son en Breugel Section G number 478, and Meierijstad Section N number 452, to VOF Van de Ven - Dinter. This agreement expired by operation of law on December 31, 2021. VOF Van de Ven – Dinter has submitted a request to be allowed to use these parcels again until December 31, 2022.
College Decision:
- three cadastral parcels, namely: Son en Breugel Section G number 232, Son en Breugel Section G number 478, Meierijstad Section N number 452, to be leased to VOF Van de Ven – Dinter at a lease price of €2,376.48 for the period until December 31, 2022.
- to agree to the enclosed draft lease agreement for the cadastral parcels Son en Breugel Section G number 232, Son en Breugel Section G number 478, Meierijstad Section N number 452.
7. Acquisition of Thermae Son sewage pumping station / Jan Boersma
Approximately 21 years ago, a sewage pumping station was installed on behalf of and at the expense of Thermae Son. In retrospect, it appears that the municipality of Son en Breugel was responsible for the construction, maintenance, and use of this pumping station. The owner of Thermae Son was always of this opinion and therefore did not pay the rent to the municipality. During a meeting on January 19, 2022, Thermae Son and the municipality reached an agreement. The conclusion is that it is reasonable and fair to offset the costs incurred against the outstanding invoices.
College Decision:
- to take over the management and ownership of the sewage pumping station near Planetenlaan from Thermae Son;
- to offset the outstanding invoices from Thermae Son for an amount of €33,216.72 against the costs incurred by Thermae Son for municipal sewerage and thus effectively to waive the outstanding invoices;
- Include the loss of €33,216.72 in the 2021 financial statements and cover it from the sewerage provision.
8. Operational plan for Dommelhuis / Jan Boersma
The Dommelhuis is steadily approaching its completion date, and now that we have a better understanding of the possibilities and limitations, and interest in the Dommelhuis has taken shape, we have worked with the management foundation to further develop the concept operating plan based on our current knowledge. In this memorandum, we would like to inform you about the results of our joint efforts and the resulting operating plan.
College Decision:
- take note of the operating plan drawn up jointly with the management foundation;
- to agree to the distribution of this exploitation plan to the council.
