2. Decision on objection / Paul van Liempd
On March 15, 2021, the college decides to deny an application to extend home support services. On April 26, 2021, the college receives an objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.
College Decision:
- Declare the objection unfounded;
- uphold the contested decision;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
3. Framework memorandum Omgevingsdienst Zuidoost-Brabant (ODZOB) 2023 / Paul van Liempd
Pursuant to the Act on Joint Arrangements, the ODZOB Executive Board must submit the framework memorandum to the councils and states of the participating parties before April 15 of the year preceding the year to which the budget relates. ODZOB chooses to submit the framework memorandum 2023 to the board and participants significantly earlier for the following reason:
- the framework memorandum is preconditions for the draft budget;
- it is good practice to provide the draft budget to participants as early as the month of March so that councils can submit any views in time.
College Decision:
- To take note of the ODZOB 2023 Framework Memorandum;
- To place the Framework Note on the list of items received by the council.
4. Audit committee report / Paul van Liempd
The Son en Breugel Court of Auditors Committee participated in the investigation into the practice of the Government Information (Public Access) Act (Wob). In the report "The practice of the Government Information (Public Access) Act at the municipality of Son and Breugel", the Court of Audit commission gives an overview of the findings of the municipality of Son and Breugel. In addition, a comparison is made with the findings at the 83 other municipalities investigated. The audit committee has requested an administrative response to the report.
College Decision:
- To take note of the report of the Court of Auditors Committee 'The Practice of the Public Access Act (Wob) at the Municipality of Son and Breugel';
- Agree to the administrative response to the report.
5. Urban Area Eindhoven Administrative Platform dated February 11, 2022 / Hans Gaillard
The Administrative Platform of the Eindhoven Urban Area (SGE) is scheduled on February 11, 2022. With this recommendation, the agenda and underlying documents are submitted to the college for notification.
The college takes note of the agenda and underlying documents for the Administrative Platform of the Urban Area Eindhoven dated February 11, 2022.
6. Lease agreement - Van de Ven / Jan Boerma
On February 2, 2021, the college decided to lease three cadastral parcels of land namely, Son en Breugel Sectie G number 232, Son en Breugel Sectie G number 478 and Meierijstad Sectie N number 452 to VOF Van de Ven - Dinter. This agreement expired by operation of law on 31-12-2021. VOF Van de Ven - Dinter has requested to be allowed to use these plots again until 31-12-2022.
College Decision:
- To lease three cadastral plots namely: Son en Breugel Sectie G number 232, Son en Breugel Sectie G number 478, Meierijstad Sectie N number 452 to VOF Van de Ven - Dinter at a lease price of €2,376.48 for the period until 31-12-2022.
- Agree to the attached draft lease agreement for the cadastral parcels Son en Breugel Sectie G number 232, Son en Breugel Sectie G number 478, Meierijstad Sectie N number 452.
7. Takeover of Thermae Son sewage pumping station / Jan Boersma
Approximately 21 years ago, a sewage pumping station was commissioned and installed on behalf of Thermae Son. In retrospect, it appears that the municipality of Son en Breugel was responsible for the realization, maintenance and use of this pumping station. The owner of Thermae Son was always of this opinion and therefore did not pay his rent to the municipality. During a consultation on January 19, 2022, Thermae Son and municipality reached an agreement. The conclusion is that it is reasonable and fair to set off the costs incurred against the outstanding invoices.
College Decision:
- Take over management and ownership of the sewage pumping station near Planetenlaan from Thermae Son;
- Set off the invoices outstanding at Thermae Son in the amount of €33,216.72 against the municipal sewerage costs incurred by Thermae Son and thus effectively cancel the outstanding invoices;
- include the disadvantage of €33,216.72 in the 2021 financial statements and cover it from the sewerage provision.
8. Operating plan Dommelhuis / Jan Boersma
The Dommelhuis is steadily approaching the completion date and now that we have a better understanding of the (im)possibilities and the interest in the Dommelhuis has also taken shape, the draft operating plan has been further developed with the management foundation with the knowledge of today. Through this memorandum we inform you about the results of the joint efforts and the resulting exploitation plan.
College Decision:
- To take note of the operating plan prepared jointly with management foundation;
- Agree to distribute this operating draft to the council.
