3 Inform the Council about the delay in amending the GR Dienst Dommelvallei
The Joint Arrangements Act (Wgr) was amended in 2022. As a result, all joint arrangements must be amended, including the GR Dienst Dommelvallei. The discussion about governance has led to preparations being made to amend the legal form. This will exceed the deadline of July 1, 2024, set in the Wgr. However, there are no consequences for failing to meet this deadline. With this council information letter, we are informing the council about the delay in the process surrounding the amendment of the GR Dienst Dommelvallei.
The council decides to adopt the text 'Delay in amendment of GR Dienst Dommelvallei' and to include it in the next council information letter.
4 European Parliament elections June 6
The European Parliament elections will be held on Thursday, June 6, 2024. For each election, the Municipal Executive must appoint polling station officials and reserve officials and determine the polling locations.
College Decision:
- To determine the polling locations;
- To appoint the members and reserve members of the polling stations for the European Parliament elections;
- Authorizing the mayor and municipal secretary to appoint any new candidates for these elections.
5 (Re)development of Kanaalstraat 31-33; adoption of zoning plan and opinion memorandum
On November 28, 2023, your council decided to make the draft zoning plan "Driehoek; Kanaalstraat 31-33" available for inspection for the period of public consultation for the redevelopment of the Kanaalstraat 31-33 site. No opinions were submitted during the consultation period. However, a number of ex officio changes were proposed. Proposals for amendments to the draft zoning plan are indicated in the consultation memorandum. These amendments have been incorporated into the zoning plan. To complete the process, the zoning plan "Driehoek; Kanaalstraat 31-33" and the opinion memorandum must be submitted to the municipal council for adoption. After the council's adoption decision, the appeal procedure will commence.
The council decides:
- declare the Crisis and Recovery Act applicable to the zoning plan "Driehoek; Kanaalstraat 31-33";
- take note of the "Opinion Memorandum on the Draft Zoning Plan for Driehoek; Kanaalstraat 31-33";
- take note of the zoning plan "Driehoek; Kanaalstraat 31-33";
- propose to the council that it adopt the "Opinion Memorandum on the Draft Zoning Plan for Driehoek; Kanaalstraat 31-33" and the zoning plan "Driehoek; Kanaalstraat 31-33."
6 (Re)development of St Genovevastraat; adoption of zoning plan and opinion memorandum
On November 28, 2023, your council decided to make the draft zoning plan "Breugel; Sint Genovevastraat ong." available for inspection for the period of public consultation for the redevelopment of the Sint Genovevastraat site. The consultation period yielded one opinion. A number of ex officio desired changes also emerged. In addition to a summary of the opinions, the response/reply is also included in the opinion memorandum. Proposals for amendments to the draft zoning plan are indicated in the opinion memorandum. These amendments have been incorporated into the zoning plan. To complete the process, the zoning plan "Breugel; Sint Genovevastraat ong." and the opinion memorandum must be submitted to the municipal council for adoption. After the council's adoption decision, the appeal procedure will commence.

7 Council proposal for approval of amendment to GR GGD BZO
The Joint Arrangements Act was amended on July 1, 2022. This necessitates an amendment to the Joint Arrangement of the Brabant-Zuidoost Municipal Health Service (GGD). After the councils were given the opportunity to express their views, the GGD's Executive Board amended the draft version of the Joint Arrangement. The council is now being asked to approve the Joint Arrangement 2024. The Joint Arrangements Act stipulates that councils may only amend an arrangement after obtaining the consent of the municipal councils. Consent may only be withheld on the grounds of conflict with the law or the public interest.
The council decides to propose the following to the municipal council by means of the council proposal Amendment to the Joint Arrangement GGD Brabant-Zuidoost:
- To take note of the Joint Regulation GGD Brabant-Zuidoost 2024 after review as determined by the AB of the GGD.
- To authorize the board to adopt the amendment to the Joint Regulation GGD Brabant-Zuidoost 2024.
After obtaining permission from the council to agree to the Joint Arrangement GGD Brabant-Zuidoost 2024 and to inform VRBZO of this by means of a draft letter.
8 Woo request AZC Breugel
On March 26, 2024, the council receives a request from the AZC Breugel Core Group under the Open Government Act (Woo). The request is for information regarding the municipality's intention to establish a reception center for up to 70 asylum seekers at Van den Elsenstraat 36 in Breugel, on the site of the former Boerenbond. It has been assessed that the requested information will be made partially public, with the exception of personal data (pursuant to Article 5.1(2)(e) of the Woo), financial data (pursuant to Article 5.1(2)(b) of the Woo), and personal policy opinions (pursuant to Article 5.2(1) and (3) of the Woo).
College Decision:
- to make a decision on the Woo request from Kerngroep AZC Breugel dated March 26, 2024;
- the documents with the corresponding serial numbers 1 to 8, 10 to 12, 12a, 13, 14, 16 to 19, 21, 21a, 22 to 27, 27a, 28, 29, 29a, 30, 31, 31a, 31b, 32 to 34, 34c, 35, 35a, 36 to 39, 39a, 40 to 42, 44 to 48, with the exception of personal data pursuant to Article 5.1(2)(e) of the Woo;
- the documents with the serial numbers corresponding to the inventory list 6a, 19, 20, 21a, 22 to 25, 27, 27a, 29, 29a, 31a, 31b, 35, 36, and 43, with the exception of financial data pursuant to Article 5.1(2)(b) of the Woo;
- to disclose the documents with the serial numbers 4, 5, 6a, 7, 7a, 8a, 9, and 10 corresponding to the inventory list, with the exception of personal policy opinions on the basis of Article 5.2, paragraphs 1 and 3, of the Woo;
- to disclose in full the documents with the serial numbers 14a, 14b, 14c, 15, 34a, and 34b corresponding to the inventory list.
9 Redevelopment of Planetenlaan - End; higher noise value, zoning plan, and opinion memorandum
The procedure for the draft zoning plan "Breugel; Planetenlaan – Eind" has been completed. This resulted in 14 opinions. A number of ex officio desired changes have also been put forward. The opinions prompted the initiator to have a water management plan drawn up and to take the archaeological research a step further. Completion of the procedure had to wait for this. In addition to a summary of the opinions, the opinion memorandum also contains the response/reply. Proposals for amendments to the draft zoning plan are indicated in the opinion memorandum. These amendments have been incorporated into the zoning plan. The procedure for the draft decision on higher values for Planetenlaan – Eind (noise) has also been completed. The opinion submitted against this does not give cause to amend the draft decision. Prior to the adoption of the zoning plan, the municipal executive must take the decision to grant higher noise values. To complete the process, the zoning plan "Breugel; Planetenlaan - Eind" and the opinion memorandum must be submitted to the municipal council for adoption. After the council's adoption decision, the appeal procedure will be initiated.
The council decides:
- pursuant to Article 110a of the Noise Abatement Act, to set higher values for the Planetenlaan - Eind location in accordance with Appendix A, for the 46 homes to be built;
- declare the Crisis and Recovery Act applicable to the zoning plan "Breugel; Planetenlaan - Eind";
- take note of the "Opinion Memorandum on the draft zoning plan for Breugel; Planetenlaan - Eind";
- take note of the zoning plan "Breugel; Planetenlaan – Eind";
- to propose to the council that it adopt the "Opinion Memorandum on the Draft Zoning Plan for Breugel; Planetenlaan - Eind" and the zoning plan "Breugel; Planetenlaan - Eind."
10 Request for a ruling on a matter of principle Hooijdonk 5
On January 20, 2020, the municipality received an initiative proposal (Appendix 1) for the (re)development of the Hooijdonk 5 site. The initiative concerns the preservation of an old company house and the creation of a B&B in that house. The request was discussed at the neighborhood roundtable. It is recommended that the initiator be advised to further develop the initiative, taking into account the preconditions and principles set out.
College Decision:
- Not to follow the advice of the monuments committee regarding Hooijdonk 5 and not to designate the building as culturally and historically valuable;
- to Requirements in principle with the proposal to preserve the former company residence and convert it into a bed and breakfast, subject to certain Requirements ;
- to establish the preconditions and principles for Hooijdonk 5;
- to request the initiator, taking into account the preconditions and principles, to further develop the plan and carry out the necessary studies, so that it becomes clear whether the plan is definitively feasible.
11 Extension of service agreement with the Southeast Brabant Environmental Agency
The current service agreement with the Southeast Brabant Environmental Agency expires on July 1, 2024. The current agreement is a well-functioning framework of agreements. The service agreement will be extended until July 1, 2025.
The council decides to extend the service agreement with the Southeast Brabant Environmental Agency until July 1, 2025.
12 College proposal to convert cash loan
At the beginning of May, the current cash loan of €18 million will be converted into a long-term loan. Despite this conversion, the cash limit will also be exceeded in the second quarter of 2024. In accordance with the Fido Act (Local Government Financing Act), we will inform the province of this. By taking out the long-term loan, there will no longer be any overspending of the cash limit in the third quarter of 2024.
College Decision:
- At the beginning of May, convert the cash loan of €18 million into a long-term cash loan of up to €20 million with a term of 10 years;
- To authorize the Finance Portfolio Holder to determine the amount of the long-term loan and to take out this long-term loan.
13 Draft council proposal for public inspection (route) participation policy and regulation
The municipality of Son en Breugel wants to increase residents' involvement in municipal decision-making. A number of options for developing a participation policy through a participation process have been explored. Preference has been given to implementing the participation process based on the 'informed resident' option. During this process, civil servants and representatives of interest and advisory groups from Son en Breugel from various domains were consulted. This policy and the accompanying regulation are now before the mayor and aldermen for decision-making. Once adopted, the policy will be made available for public inspection. This is when residents can give their opinion. Their input will be incorporated into a final version, which will be submitted to the municipal council for decision-making.
College Decision:
- To release the draft policy framework "Samen Son en Breugel" for public inspection;
- Release the draft regulation on involvement and the right to challenge in the municipality of Son en Breugel 2024 for public inspection.
14 Opinion on the first amendment to the 2024 budget and draft budget for 2025 GGD
The GGD BZO has sent the first budget amendment for 2024 and the draft budget for 2025 to the participating municipalities. Under the Joint Arrangement GGD Brabant-Zuidoost, the municipal councils are given the opportunity to express their views on this. It is proposed that the council does not submit any views.
College Decision:
- To take note of the first budget amendment for 2024 and the draft budget for 2025 of the GGD Brabant-Zuidoost (Municipal Health Service for Southeast Brabant);
- To propose to the City Council:
- No opinion to be submitted against the first amendment to the 2024 budget of the GGD Brabant-Zuidoost;
- No opinion to be submitted against the draft budget for 2025 of the GGD Brabant-Zuidoost;
- The financial consequences of the first budget amendment for 2024 to be incorporated into the first Berap 2024;
- Incorporate the financial implications of the draft budget into the 2025-2028 Framework Memorandum.
