3 Inform Council of delay in amendment GR Dienst Dommelvallei
The Common Arrangements Act (Wgr) was amended in 2022. As a result, all joint arrangements must be adjusted, including the GR Dienst Dommelvallei. The discussion on governance has led to preparations being made to adjust the legal form. Hereby, the deadline of 1 July 2024 set in the Wgr is exceeded. However, there are no consequences attached to not meeting that deadline. With this council information letter we inform the council about the delay in the process surrounding the modification of the GR Dienst Dommelvallei.
The college decides to adopt the text "Delay modification GR Dienst Dommelvallei" and to include it in the next council information letter.
4 European Parliament elections June 6
Thursday, June 6, 2024 is the European Parliament elections. For each election, the Board of Mayor and Aldermen must appoint polling station members and reserve members and determine voting locations.
College Decision:
- To establish the voting locations;
- To appoint the members and reserve members of the polling stations for the European Parliament elections;
- Mandate the Mayor and City Clerk to nominate any new filers for this election.
5 (Re)development Canal Street 31-33; adopt zoning plan and views memo
On November 28, 2023, your college decided to submit the draft zoning plan "Triangle; Kanaalstraat 31-33" for public inspection for the period of views for the redevelopment of the location Kanaalstraat 31-33. During the period of views no views were submitted. However, a number of ex officio desired changes have emerged. Proposals to adjust the draft zoning plan have been indicated in the note on views. These adjustments have been incorporated in the zoning plan. To complete the process, the zoning plan "Driehoek; Kanaalstraat 31-33" and the note of views must be presented to the city council for adoption. Following the council's adoption decision, the appeal process will be initiated.
The college decides:
- Declare the Crisis and Recovery Act applicable to the "Triangle; Kanaalstraat 31-33" zoning plan;
- To take note of the "Notice of views draft zoning plan Triangle; Kanaalstraat 31-33";
- To take note of the zoning plan "Triangle; Kanaalstraat 31-33";
- To propose that the council adopt the "Notice of views draft zoning plan Triangle; Kanaalstraat 31-33" and the zoning plan "Triangle; Kanaalstraat 31-33".
6 (Re)development of St Genovevastraat; adoption of zoning plan and statement of views
On November 28, 2023, your college decided to make the draft zoning plan "Breugel; Sint Genovevastraat ong." for the redevelopment of the Sint Genovevastraat site. for public inspection for the period of views. The period of views produced one view. A number of ex officio desired changes also emerged. In addition to a representation of the views, the response/response is presented in the views memo. 7 Council proposal authorizing amendment GR GGD BZO
As of July 1, 2022, the Common Regulations Act has been amended. This makes it necessary to amend the GGD Brabant-Zuidoost Joint Scheme. After the councils have been given the opportunity to present an opinion, the Municipal Executive Board of the GGD has amended the draft version of the GR. The college is now asked to approve the Joint Scheme 2024. The Joint Arrangements Act stipulates that colleges do not proceed to amend an arrangement without the consent of the municipal councils. The consent may only be withheld because of conflict with the law or the public interest.
The college decides to propose to the municipal council by means of the council proposal Adjustment of the GGD Brabant-Zuidoost Common Scheme:
- To take note of the Joint Scheme GGD Brabant-Zuidoost 2024 after views as adopted by the GGD's AB.
- To authorize the College to adopt the amendment to the Common Regulation GGD Brabant-Zuidoost 2024.
After obtaining the consent of the council to agree to the Joint Scheme GGD Brabant-Zuidoost 2024 and to notify VRBZO by means of a draft letter.
8 Woo request AZC Breugel
On March 26, 2024, the college receives a request under the Open Government Act (Woo) from Kerngroep AZC Breugel. Information is requested regarding the intention of the municipality to establish a reception location for up to 70 asylum seekers at the address Van den Elsenstraat 36 in Breugel, the plot of the former Boerenbond. It is assessed that the requested information is partially disclosed with the exception of personal data (pursuant to Article 5.1 paragraph 2 under e of the Woo), financial data (pursuant to Article 5.1 paragraph 2 under b of the Woo) and personal policy views ( pursuant to Article 5.2 paragraph 1 and paragraph 3 of the Woo).
College Decision:
- Make a decision on the Woo request of Kerngroep AZC Breugel dated March 26, 2024;
- disclose the documents with serial numbers 1 through 8, 10 through 12, 12a, 13, 14, 16 through 19, 21, 21a, 22 through 27, 27a, 28, 29, 29a, 30, 31, 31a, 31b, 32 through 34, 34c, 35, 35a, 36 through 39, 39a, 40 through 42, 44 through 48 corresponding in the inventory with the exception of personal data pursuant to Article 5.1(2)(e) of the Woo;
- disclose the documents with the serial numbers 6a, 19, 20, 21a, 22 to 25, 27, 27a, 29, 29a, 31a, 31b, 35, 36 and 43 corresponding in the inventory list with the exception of financial data pursuant to Article 5.1(2)(b) of the Woo;
- To disclose the documents with the serial numbers 4, 5, 6a, 7, 7a, 8a, 9 and 10 corresponding in the inventory list, with the exception of personal policy statements pursuant to Article 5.2(1) and (3) of the Woo;
- Disclosing in full the documents with serial numbers 14a, 14b, 14c, 15, 34a and 34b corresponding in the inventory.
9 Redevelopment Planets Avenue - End; higher value noise, zoning and views memo
The procedure of the draft zoning plan "Breugel; Planetenlaan - Eind" has been closed. This resulted in 14 views. A number of ex officio desired changes also emerged. The views prompted the initiator to have a water management plan drawn up and to take the archaeological investigation one step further. Completion of the procedure has had to wait for this. The memorandum of views includes the response/answer in addition to a representation of the views. Proposals for amending the draft zoning plan are indicated in the memorandum of views. The zoning plan incorporates these adjustments. The procedure for the draft decision on higher values for Planetenlaan - Eind (noise) has also been completed. The views expressed here do not give cause to amend the draft decision. The college must take the decision to grant higher noise values prior to the adoption of the zoning plan. To complete the process, the zoning plan "Breugel; Planetenlaan - Eind" and the statement of views must be presented to the municipal council for adoption. Following the council's adoption decision, the appeal procedure will be initiated.
The college decides:
- To adopt higher values under Article 110a of the Noise Abatement Act for the Planeten Avenue - End site in accordance with Appendix A, for the 46 dwellings to be built;
- Declare the Crisis and Recovery Act applicable to the zoning plan "Breugel; Planetenlaan - Eind";
- To take note of the "Viewpoints memo draft zoning plan Breugel; Planetenlaan - Eind";
- To take note of the zoning plan "Breugel; Planetenlaan - Eind";
- To propose that the council adopt the "Zienswijzennotitie ontwerpbestemmingsplan Breugel; Planetenlaan - Eind" and the zoning plan "Breugel; Planetenlaan - Eind".
10 Principle request Hooijdonk 5
On January 20, 2020, the municipality received an initiative proposal (Appendix 1) for the (re)development of the site Hooijdonk 5. The initiative is about preserving an old company house and realizing a B&B in that house. The request has been dealt with at the environment table. It is advised to indicate to the initiator to further develop the initiative, taking into account the set preconditions and starting points.
College Decision:
- Not to follow the opinion of the Monument Committee on Hooijdonk 5 and not to designate the property as having cultural-historical value;
- To grant cooperation in principle and under set Requirements to the proposal for the preservation of the former company residence and the realization of a B&B therein;
- Adopt the preconditions and principles Hooijdonk 5;
- To request the promoter, taking into account the preconditions and assumptions, to elaborate the plan in more detail and to carry out the necessary studies, so that it becomes clear whether the plan is definitively feasible.
11 Renewal of service agreement for Omgevingsdienst Zuidoost-Brabant.
The current service agreement with the Omgevingsdienst Zuidoost-Brabant expires July 1, 2024. The current agreement is a good working agreement framework. The service agreement will be extended until July 1, 2025.
The college decides to extend the service agreement Omgevingsdienst Zuidoost-Brabant until July 1, 2025.
12 College proposal to convert cash loan
In early May, the current cash loan of €18 million will be converted into a long-term loan. Despite this conversion, the cash limit will also be exceeded in the second quarter of 2024. In accordance with the Fido Act (Financing Decentralized Authorities Act), we will notify the province. By attracting the long-term loan, there will no longer be an exceeding of the cash limit in the third quarter 2024.
College Decision:
- In early May convert the cash loan of €18 million into a long-term money loan of up to €20 million with a maturity of 10 years;
- To mandate the Finance Portfolio Holder to determine the amount of the long-term money loan and to raise this long-term loan.
13 Draft college proposal for public inspection (route) participation policy and regulation
The municipality of Son and Breugel wants to increase the involvement of residents in the decision-making of the municipality. A number of variants have been explored on how to make participation policy with a participation process. The preferred implementation of the participation process was based on the variant 'informed resident'. During this process, officials and representatives of interest and advisory groups from Son en Breugel from various fields were consulted. This policy and the accompanying ordinance are now before the municipal executive for decision-making. After adoption, the policy will be made available for inspection. This is the moment when residents can give their opinion. This input will be incorporated into a final version, which will be submitted to the city council for decision-making.
College Decision:
- To release the draft policy framework "Together Son and Breugel" for public inspection;
- To release the draft ordinance involvement and challenge right municipality of Son and Breugel 2024 for public inspection.
14 View first amendment to budget 2024 and draft budget 2025 GGD
GGD BZO has sent the 1st budget allocation 2024 and the draft budget 2025 to the participating municipalities. Under the Joint Scheme GGD Brabant-Zuidoost, the municipal councils are given the opportunity to give their views on these. It is proposed to the council not to submit an opinion.
College Decision:
- To take note of the 1st budget allocation 2024 and the draft budget 2025 of the GGD Brabant-Zuidoost;
- To propose to the City Council:
- Not to submit a view against the first amendment to the 2024 budget of the GGD Brabant-Zuidoost;
- Not to submit an opinion against the draft budget 2025 of the GGD Brabant-Zuidoost;
- To include the financial impact of the first budget amendment 2024 in the first Berap 2024;
- To incorporate the financial implications of the draft budget into the 2025-2028 Framework Memorandum.
