1. Internal (not public) decision list and public decision list dated Feb. 28, 2023 - Hans Gaillard
The college adopts the decision lists.
2. College recommendation maintain Uranus Avenue 13 - Hans Gaillard
As a result of building in deviation from a granted environmental permit, a penalty payment was forfeited in this enforcement case. Since the deviation has not yet been adjusted, administrative coercion is now being applied, which means that the deviation will be removed by the municipality at the expense of the person causing it. In this case, it is now proposed to adjust the zoning in the zoning plan in order to legalize the case by means of a minor case. This proposal is not supported because it would be arbitrary and could undermine previous and future enforcement cases. The recommendation is to take enforcement action in this and future similar cases.
College Decision:
- not to agree to a zoning change;
- Agree to initiate enforcement proceedings in the form of administrative enforcement.
3. Response review accessibility Dommelhuis by CG platform - Jan Boersma
The CG Platform Son en Breugel represents residents with disabilities and deals with, among other things, the accessibility of public buildings in the municipality. In this, the CG-platform assumes an advisory role. On October 15, 2022, the CG platform sent a report on the accessibility of the Dommelhuis to the municipality. A response to this report has been prepared. The college decides to send this response to the CG platform.
The college decides to agree to send a response to the accessibility review at the Dommel House conducted by the CG Platform.
4. Decision limiting public access (Bbo) on building permits digitally transferred to the RHCe Son en Breugel 1930 to 1989 - Hans Gaillard
The building permits of Son en Breugel have been scanned and are digitally transferred to the Regional Historical Center Eindhoven (RHCe). They are placed in the e-depot and can be viewed digitally by citizens and employees. Because of the presence of personal data (AVG: invasion of privacy) we want to limit the public accessibility of part of the construction files: the application and the decision. The parts that citizens need most, namely drawings and construction calculations, are thus free to view.
The college decides to impose a restriction of public access on digital building permits 1930-1989.
5. Explanation of administrative responsibility - Hans Gaillard
Since January 1, 2023, the New Procedure for Determining Election Results Act has been in effect. The law stipulates that the Municipal Executive establishes a Municipal Voting Board (GSB) for each election. The GSB will hold a public session on March 16, 2023.
The college decides to determine the members of the municipal polling station for the Provincial and Water Board elections 2023.
6. Occupation Municipal Clerk’s Office youth city council - Hans Gaillard
Since the start of the Youth Council in 2016, two staff members have been involved in supporting the Youth Council each time. Support for the Youth City Council has always been filled on an ad hoc basis in recent years. This proposal asks the college to structurally fix the staffing of the Municipal Clerk’s Office of the Youth Council with two employees for two hours per week.
The College decides to structurally fill in the support of the Youth City Council with two staff members for two hours per week.
7. Political Evening March 9, 2023 - Hans Gaillard
The college discussed the program format for the March 9, 2023 Political Evening and the February 2, 2023 list of council commitments.
8. Framework letter ODZOB 2024 and financial perspective 2023 - Jelle de Jong
The Omgevingsdienst Zuidoost Brabant (ODZOB) sent the Framework Letter 2024 and the Financial Perspective 2023 to the municipal councils on December 21, 2022. ODZOB expects a negative result of €2 million over 2022, due to sick leave and lack of declarability. The deficits are covered from the reserve, which thus falls below the minimum level and must be replenished. For 2023, additional funds are needed to cover the lack of declarability and inflation.
The college decides to:
- To take note of the Framework Letter ODZOB 2024;
- To take note of the 2023 Financial Perspective;
- To agree to process the financial consequences in the appropriation of the results of the 2022 financial statements and the 1st or 2nd berap 2023. To incorporate the multi-year consequences in the 2024-2027 budget;
- To agree to the text of the RIB to inform the council about the financial developments of ODZOB in the current fiscal year.
