The college adopts the decision lists.

2. Overview of decisions taken during mandate week 36 2022 - Hans Gaillard

The college is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the College or the Mayor in the past period.

The council takes note of the overview of decisions taken in mandate week 36 2022.

3. Proposal to adopt zoning plan for rural area, Airborneweg 51 - Jelle de Jong

The amendment procedure, with the aim of having your council adopt the zoning plan "Buitengebied, Airborneweg 51," has been completed. The zoning plan can now be adopted by the council. This plan aims to change the zoning from intensive livestock farming (poultry) to horse farming.

The College:

  • Decision to adopt the zoning plan "Buitengebied, Airborneweg 51";
  • To publish the adopted zoning plan in connection with the possibility of lodging an appeal with the Council of State;
  • Due to delays in the proceedings, 50% of the fees already paid shall be refunded to the applicant.

4. Repair rates for paving - Jan Boersma

When utility companies carry out work on cables and pipes, they cause damage to paving materials, verges, and green spaces. They pay compensation to the municipality of Son en Breugel for this damage. The rates must be set annually by the municipal executive. The municipal executive has decided to set the repair rates for the year 2022.

5. General authorization - Hans Gaillard

The general authorization designates officials who are authorized to act on behalf of the municipal executive, the mayor, or the municipal council in objection and appeal proceedings. The general authorization dates from February 15, 2022, and must be updated due to changes in the administration and organization.

College Decision:

  • To adopt the general authorization dated September 6, 2022;
  • To revoke the general authorization dated February 15, 2022.

6. Political Evening Program September 8, 2022 - Hans Gaillard

The council discusses the program schedule for the Political Evening on September 8, 2022.

7. Decision on objection to rejection of request for withdrawal of permit requirement - Jelle de Jong

On March 29, 2022, the council decides to reject the request to revoke a permit requirement. On April 12, 2022, the council receives an objection from the objector against the above decision. The objections committee recommends that the objection be declared well-founded and that the contested decision be reviewed, on the understanding that an assessment will be made as to whether the permit requirement can be amended.

College Decision:

  1. Motivated to deviate from the advice of the appeals committee;
  2. To declare the objection unfounded;
  3. To uphold the contested decision, supplementing the grounds;
  4. To reject the request for reimbursement of legal costs.

8. Development of Planetenlaan – End; public inspection of draft zoning plan and draft decision on higher noise limits - Jelle de Jong

On February 8, 2016, the council decided to cooperate in the development of a residential area on the site located on Planetenlaan and Eind. The final plan and the prior exploitation agreement were adopted by your council on May 25, 2021. The agreement was signed by all parties on July 5, 2021. A new zoning plan is legally required for the realization of the final plan. The draft zoning plan has now been completed. As part of the adoption procedure, the draft zoning plan must be released for the period during which opinions can be submitted.

The college decides to:

  1. Take note of the draft zoning plan “Breugel; Planetenlaan – Eind”;
  2. To declare the Crisis and Recovery Act applicable to the zoning plan "Breugel; Planetenlaan – Eind";
  3. Based on the "Notification memorandum for informal EIA assessment Breugel; Planetenlaan - Eind" submitted by the initiator, it has been determined that there is no reason to proceed with an EIA procedure;
  4. The draft zoning plan "Breugel; Planetenlaan - Eind" to be released for the consultation period;
  5. The draft decision to release the "higher noise limits for the Planetenlaan – Eind location" for the consultation period.

9. Start procedure for draft zoning plan for rural area, Brouwerskampweg 21; expansion of fish farm - Jelle de Jong

In June 2022, a draft zoning plan was submitted for the expansion of the fish farm at Brouwerskampweg 21. The zoning plan for rural areas needs to be revised for the expansion. The zoning designation "Agricultural with value 1" will be revised to "business." An anterior agreement has now been concluded with the applicant. The procedure for this draft can be started on the basis of the Spatial Planning Act. The first step is to make the draft zoning plan available for inspection. The council decides:
1. To approve the draft zoning plan "Rural Area, Brouwerskampweg 21";
2. To release the draft zoning plan for the further adoption procedure, namely to make the draft zoning plan available for inspection to allow for the submission of opinions.

10. Reject request for weekly market stall - Jan Boersma

Until early 2020, there were three fruit and vegetable shops at the weekly market in Son en Breugel. During the coronavirus crisis, several shops, including one fruit and vegetable shop, left. The space was not filled during that period due to the coronavirus measures. Once the measures were lifted, the market was restocked, including with a fruit and vegetable stall. The two existing fruit and vegetable stalls protested against this. Despite the current market policy, it has been decided to maintain the status quo for the time being until consumer research indicates otherwise.

College Decision:

  1. Not to grant a license for the weekly market to a third fruit and vegetable shop, contrary to current market policy, unless consumer research indicates otherwise;
  2. Request a quote to start the consumer research.

11. Overview of energy-saving activities in fall 2022 - Steven Grevink

Energy prices have risen sharply over the past year. More and more residents are struggling to pay their monthly bills. In the coming months, the municipality will organize additional initiatives to help residents reduce their energy costs. The municipal executive will proactively involve the council in our activities.

The council has decided to inform the council about how we will help residents reduce their energy costs this fall.

12. Increase in one-off energy allowance for 2022 - Steven Grevink

The council has decided to increase the one-off energy allowance. This increase is in line with national guidelines. In order to implement this increase, the council has adopted policy rules for increasing the energy allowance.

College Decision:

  1. To adopt the policy rules for the increase in the one-off energy allowance for Son en Breugel in 2022;
  2. To make additional budget available for this purpose from the government funds already committed and to provide pre-financing from the General Reserve;
  3. To approve the attached text for the council information letter and forward it to the council.
