The college adopts the decision lists.

2. Overview of decisions taken in mandate week 36 2022 - Hans Gaillard

The college is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the College or the Mayor in the past period.

The college takes note of the overview of decisions taken in mandate week 36 2022.

3. Proposal to adopt zoning plan Buitengebied, Airborneweg 51 - Jelle de Jong

The amendment procedure, with the aim of the adoption by your college of the zoning plan "Buitengebied, Airborneweg 51", has been completed. The zoning plan can be adopted by the college. This plan aims to change the zoning Intensive Livestock Farming (poultry) to Equine Farming.

The College:

  • Decision to adopt the zoning plan "Buitengebied, Airborneweg 51";
  • Publish the adopted zoning plan for the possibility of appeal to the Council of State;
  • Due to delays in the procedure, refund 50% of the fees already paid to the applicant.

4. Repair rates street work - Jan Boersma

When utility companies perform work on cables and pipes, they cause damage to paving materials, roadsides and green areas. For this they pay the municipality of Son en Breugel a fee. The rates must be set annually by the college. The college decides to set the repair tariffs for the year 2022.

5. General authorization - Hans Gaillard

The General Authorization designates officials authorized to act on behalf of the College, Mayor or City Council in objection and appeal proceedings. The general authorization is dated Feb. 15, 2022, and needs to be updated due to changes in governance and organization.

College Decision:

  • To adopt the general authorization dated September 6, 2022;
  • To revoke the general authorization dated February 15, 2022.

6. Program Political Evening September 8, 2022 - Hans Gaillard

The college discusses the program format for the September 8, 2022 Political Evening.

7. Decision on objection rejecting request to withdraw permit requirement - Jelle de Jong

On March 29, 2022, the college decides to reject the request to withdraw a permit requirement. On April 12, 2022, the college receives an objection from the objector to the above decision. The Objections Committee recommends that the objection be upheld and that the contested decision be revised with the understanding that an assessment be made as to whether the permit requirement can be modified.

College Decision:

  1. Reasoned departure from the opinion of the Objections Committee;
  2. To declare the objection unfounded;
  3. Uphold the contested decision, while supplementing the statement of reasons;
  4. Reject the request for reimbursement of legal costs.

8. Development Planetenlaan - Eind; making draft zoning plan and draft decision on higher noise limits available for inspection - Jelle de Jong

On Feb. 8, 2016, the college decided to cooperate in the development of a residential area on the site located at Planet Avenue and End. The final plan and the antecedent operating agreement were adopted by your college on May 25, 2021. The agreement was signed by all parties on July 5, 2021. A new zoning plan is legally required for the realization of the final plan. The draft zoning plan has now been finalized. As part of the adoption procedure, the draft zoning plan must be released for the period during which views may be submitted.

The college decides to:

  1. To take note of the draft zoning plan "Breugel; Planetenlaan - Eind";
  2. Declare the Crisis and Recovery Act applicable to the zoning plan "Breugel; Planetenlaan - Eind";
  3. Based on the "Notification Memorandum Form-Free EIA Assessment Breugel; Planetenlaan - Eind" submitted by the initiator, to determine that there is no reason to conduct an EIA;
  4. To release the draft zoning plan "Breugel; Planetenlaan - Eind" for the viewing period;
  5. To release the draft decision 'higher noise limits location Planetenlaan - Eind' for the viewing period.

9. Start procedure draft zoning plan Buitengebied, Brouwerskampweg 21; expand fish farm - Jelle de Jong

A draft zoning plan was submitted in June 2022 for the expansion of fish farm, Brouwerskampweg 21. The expansion requires a revision of the Buitengebied zoning plan. The "Agrarisch met waarde-1" zoning will be revised to the "bedrijf" zoning. Meanwhile, an anterior agreement has been concluded with the applicant. The procedure under the Spatial Planning Act can be started for this draft. The first step is to submit the draft zoning plan for public inspection. The college decides:
1. To agree to the draft zoning plan "Buitengebied, Brouwerskampweg 21";
2. To release the draft zoning plan for the further adoption procedure, namely, to make the draft zoning plan available for inspection in order to provide the opportunity for the submission of views.

10. Reject request for stand weekmark - Jan Boersma

Until early 2020, there were three AGF stores at the weekly market in Son en Breugel. During the corona crisis, some businesses, including one AGF business, left. The space was not filled under the corona measures during that period. After the measures ended, the filling of the market including an AGF business was restarted. The two AGF stalls already in place objected. Despite the current market policy, it was decided to maintain the status quo for the time being until consumer surveys might indicate otherwise.

College Decision:

  1. To deviate from the current market policy not to issue a permit for the weekly market to a third-party AGF store until consumer research possibly indicates otherwise;
  2. Requesting bids to initiate consumer research.

11. Overview of energy conservation activities fall 2022 - Steven Grevink

Energy prices have risen sharply over the past year. More and more residents are struggling to pay the monthly charges. The council is going to organize additional actions in the coming months to help residents reduce energy costs. The college is proactively including the council in what we are doing.

The college decides to inform the council on how we will help residents lower energy costs this fall.

12. Increase one-time energy surcharge 2022 - Steven Grevink

The college decides to increase the one-time energy surcharge. This increase is in accordance with national guidelines. To implement this increase, the college adopts the policy rules for increasing the energy surcharge.

College Decision:

  1. To adopt the policy rules Increase one-time energy surcharge Son en Breugel 2022;
  2. To provide additional budget for this purpose from the already committed State funds and pre-financing from the General Reserve;
  3. To agree to the attached text for the council information letter and forward it to the council.
