3. Political Evening May 8, 2025

The college takes note of the program of the May 8, 2025 Political Evening.

4. Decision on objection charge under penalty clause.

On October 7, 2024, the college decides to impose an order under penalty for various constructions and activities that violate the environmental plan of the municipality of Son en Breugel. On November 15, 2024, the college receives a notice of objection from the objector against the above decision. The Objections Committee recommends that the objection be declared unfounded, that the contested decision be upheld and that the request for reimbursement of legal costs be rejected.

The college decides:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Reject the request for reimbursement of legal costs;
  4. Refer to the opinion of the Objections Committee for the reasons for the decision.

5. Mandate register and mandate regulation 2025

The mandate register lists the powers that the college and mayor have mandated to the civil service organization. Without a mandate, officials are not authorized to execute powers and/or make decisions. Due to various developments, the Mandate Register has been updated.

The college decides:
1. to adopt the Mandate Register of the Municipality of Son and Breugel 2025;
2. to revoke the Mandate Register dated January 1, 2024;
3. to adopt the Mandate Regulation of the Municipality of Son and Breugel 2025.

6. Generic advice note college (DD) Application for authorization to suspend transfer of building permits.

Municipalities must transfer building permits granted under the 1995 Archives Act to the Regionaal Historisch Centrum Eindhoven (RHCe) after 20 years. As long as the building permits have not been transferred, there is an illegality especially since the permits are not publicly accessible. Both the RHCe and the Interadministrative Supervision (IBT) of the province supervise this.
All three Dommelvallei municipalities are behind in the transfer. We would therefore like to request an authorization for the suspension of transfer for a period of 5 years. After all, municipalities that wish to retain certain archive documents for longer than 20 years because they are still in frequent use may apply for an authorization to suspend transfer under article 13, paragraph 3 of the Archives Act. The college applies for this authorization to the provincial executive.

The college decides to apply to the provincial executive for an authorization for suspension of transfer of building permits.

7. Decision on objection denial of request for enforcement.

On October 18, 2024, the college decides to deny a request for enforcement. On November 29, 2024, the college receives an objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.

College Decision:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Reject the request for reimbursement of legal costs;
  4. Refer to the opinion of the Objections Committee for the reasons for the decision.

8. Written questions VVD - consultation structure forest policy and implementation.

The VVD and VOOR U groups have jointly asked council questions about the implementation of the amendment "Integral Management Plan Forest and Natural Areas" adopted by the council on March 18, 2021. This amendment called for setting up a consultation structure in which local agencies, interest groups and residents contribute structurally to policy and implementation. The answer to the council questions is included in the letter.

The college decides to adopt the answer to the council questions.

9. ASD recommendations regarding Adult Fund.

In its letter dated January 30, 2025, the Social Domain Advisory Council made three recommendations around our participation in the Adult Fund. A letter addresses these and indicates how we are addressing these recommendations.

The college decides to adopt the response letter to the Social Domain Advisory Council.

10. Creation of participation policy

Municipality of Son and Breugel wants to increase the involvement of residents in the decision-making of the municipality. Therefore, in July 2024, the first version of the Policy Framework 'Together Son and Breugel' and the Regulation on Involvement and Challenge Right of the Municipality of Son and Breugel 2024 were presented to the council. In August and September 2024 there were two image-forming sessions on the policy framework and the regulation. The council came to the conclusion that the present policy framework did not provide sufficient direction on that point. For that reason, the council finally decided on January 30, 2025, via a motion, to return the policy framework "Together Son and Breugel. A new refined version of the policy framework with possible dilemmas was discussed with the council in a working session. The final policy framework and accompanying ordinance are now submitted to the college and the city council for decision-making. 

The college decides to propose the following to the council;

  1. to adopt the Views Note;
  2. Adopt the "Together Son and Breugel" policy framework;
  3. To adopt the Regulation on Involvement and Challenge Municipality of Son and Breugel 2025.

11. First amendment of general local ordinance

It is proposed to the municipal council to amend the provisions of the General Local Bye-Law regarding the closing and pouring times of para commercial legal entities. The proposal is to broaden the provisions for a category of para commercial legal entities.

The College decides to propose to the City Council to adopt the First Amendment to the General Local Ordinance Municipality of Son and Breugel 2024.

12. Decision on objection rejection of correction request for BRP data.

On September 23, 2024, the college decides to reject a request for rectification of data in the Basic Register of Persons. On October 31, 2024, the college receives an objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded, that the contested decision be upheld and that the request for reimbursement of legal costs be rejected.

College Decision:

  1. Declare the objection unfounded;

  3. Reject the request for reimbursement of legal costs;
  4. Refer to the opinion of the Objections Committee for the reasons for the decision.

13. Budget 2026-2029 and 1st budget amendment 2025 DDV

On April 2, 2025, the Executive Board of Dienst Dommelvallei agreed to the draft budget 2026-2029 and the draft 1st budget amendment 2025. Both have financially adverse consequences for the municipal contribution of Son and Breugel to Dienst Dommelvallei. The increasing contribution due to the changed allocation key as a result of the Dommelvallei Service's Business Plan 2.0, in combination with the announced ravine year, give cause to submit an opinion to the Dommelvallei Service Board.
In addition, on April 16, 2025, the General Board adopted the 2024 Annual Report and Accounts, which are presented for notice.

The College decides to propose to the City Council;

  1. take note of:
  2. The 2026-2029 multi-year budget Dommelvallei Service;
  3. The 1st budget amendment 2025 Dommelvallei Service;
  4. Annual Report 2024 Dommelvallei Service.
  5. To submit the view on the draft 2026 budget and 1st budget amendment 2025.
  6. To decide to incorporate the financial consequences for the Municipality of Son and Breugel in the 1st Administrative Report 2025, Framework Memorandum 2026-2029 and ultimately in the multi-year budget 2026-2029 of the Municipality of Son and Breugel.

14. Questions council (environment) programs in relation to Omgevingswet

Questions have been asked by the GroenLinks-PvdA group about (environmental) programs in relation to the Omgevingswet.
The questions have been provided with a response. The college decides to send the responses to the members of the City Council.

The college decides to adopt the response letter to written questions on (environmental) programs in relation to the Omgevingswet Act.

The Joint Arrangements Act provides that before the Draft Budget is presented to the General Board, it is sent to the councils of the participating municipalities. The council can then give its views on the Draft 2026 Budget. Blink's Draft Budget was released by the Blink Executive Board on March 20, 2025 and presented to the municipal councils. The college presents the draft budget to the municipal council and proposes to submit views.

The College decides to propose to the City Council:

  1. To adopt the view on the draft 2026 budget of the Blink Joint Arrangement;
  2. Notify the board of Joint Arrangement Blink of the view by letter;
  3. incorporate the financial impact into the 2026 budget and multi-year budget.

16. Written questions VVD

The VVD group has asked council questions about observations of a wolf in the Rooise Heide and Sonniuswijk. The answer is included in a letter.

The college decides to adopt the answer to the council questions.

17. Consent GR A 10 for Youth

Since 2018, we have been working together within the A 10 for Youth region to organize the procurement of youth aid. As a result of the national Youth Reform Agenda and the upcoming legislative amendment to the Improving Availability of Youth Care Act, it is an obligation to convert the existing cooperation agreement into a joint arrangement. This GR focuses on the regional procurement of specialized youth care and ensures a solid regional basis and organization of this Health for the most vulnerable children, as required by the new legislation.
On April 3, 2025, the City Council decided to submit a view on the GR draft text. The decision-making now proposed to the college is necessary to strike the GR in the legally required manner.
In order to be operational from 2026, a Draft Budget 2026 has been prepared. In line with the role of municipal councils envisaged in the Wgr, the councils are now given the opportunity to make their views known to the college. This is now done informally, but in a full-fledged manner, as there is no formal procedure to do so.

The College decides to propose to the City Council:

  1. To take note of the views expressed on the draft GR;
  2. To take note of the conclusions drawn from the views;
  3. Authorize the College to enter into the Joint Arrangement Youth Region One 10 for Youth;
  4. To give an opinion to the college on the Draft 2026 Budget of the GR Youth Region A 10 for Youth, as expressed in the council proposal;
  5. To establish the Joint Arrangement Youth Region A 10 for Youth, subject to the approval of the City Council.
  6. to incorporate the financial implications, after adoption by the GR General Board, into the 2026 program budget and 2027-2029 multi-year estimate.

18. Annual documents 2024 and view budget 2026 et seq. GR WSD

Every year, in accordance with the WSD Joint Scheme (GR WSD), WSD makes the draft financial documents available. This gives the councils of the participating municipalities the opportunity to express their views on next year's budget. The board of WSD takes these views into account when finalizing the financial documents.

The College decides to propose to the City Council:

  1. To submit a view on the draft 2026 WSD budget, as per letter;
  2. agree to incorporate the financial consequences of the 2026 budget of GR WSD in the 2026 Framework Memorandum and subsequently in the 2026 budget and the 2027-2029 multi-year estimate of the Municipality of Son and Breugel;
  3. Inform WSD of the view via the attached letter.
