The college adopts the decision lists.

2. Decision on objection to administrative order -Suzanne Otters-Bruijnen

On April 26, 2023, the college decides to impose an administrative enforcement order in connection with the erection of a fence in violation of the zoning plan and without an environmental permit. On June 2, 2023, the college receives an objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded, that the contested decision be upheld and that the request for reimbursement of legal costs be rejected.

College Decision:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Reject the request for reimbursement of legal costs;
  4. Refer to the opinion of the Objections Committee for the reasons for the decision.

4. Review of decision on objection - Jelle de Jong

On September 8, 2022, the college issued a decision on the objection and declared the objection unfounded. The objection was directed against the college's decision to reject the request to amend a permit condition. The decision on the objection was appealed to the East Brabant District Court. As a result of the appeal, it was examined whether the decision on the objection could be modified. This is the case. The objection can as yet be declared well-founded and the permit condition will as yet be amended.

College Decision:

  1. Review the decision on objection dated September 8, 2022, and declare the objection well-founded;
  2. Amend the contested decision, subject to the modification of the relevant permit requirement;
  3. Grant the request for reimbursement of procedural costs.

5. Response to accountability - Jelle de Jong

The college has received a notice of liability, in connection with the denial of an application for a building permit for the erection of an agricultural shed. A letter is being sent in response. The letter is sent from the municipality's in-house attorney.

College Decision:

  1. To agree to the draft response to the Liability, in connection with the denial of an application for a building permit to erect an agricultural shed;
  2. have the response sent from the in-house counsel;
  3. instruct the in-house attorney to negotiate an amicable settlement.
