1. Internal (non-public) list of decisions and public list of decisions dated August 29, 2023 - Suzanne Otters-Bruijnen
The college adopts the decision lists.
2. Decision on objection to administrative order -Suzanne Otters-Bruijnen
On April 26, 2023, the council decides to impose an administrative order in connection with the installation of a fence in violation of the zoning plan and without an environmental permit. On June 2, 2023, the council receives an objection from the objector against the above decision. The appeals committee recommends that the objection be declared unfounded, that the contested decision be upheld, and that the request for reimbursement of legal costs be rejected.
College Decision:
- Declare the objection unfounded;
- uphold the contested decision;
- Reject the request for reimbursement of legal costs;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
3. Political Evening September 7, 2023 - Suzanne Otters-Bruijnen
The council discusses the program schedule for the Political Evening on September 7, 2023.
4. Review of decision on objection - Jelle de Jong
On September 8, 2022, the board issued a decision on the objection and declared the objection unfounded. The objection was directed against the board's decision to reject the request to amend a permit requirement. An appeal was lodged against the decision on the objection with the District Court of East Brabant. Following the appeal, an investigation was conducted to determine whether the decision on the objection could be amended. This is the case. The objection can still be declared well-founded and the permit requirement will still be amended.
College Decision:
- to review the decision on the objection dated September 8, 2022, and to declare the objection well-founded;
- to amend the contested decision, on the understanding that the relevant permit requirement will be amended;
- Grant the request for reimbursement of procedural costs.
5. Response to liability claim - Jelle de Jong
The council has received a liability claim in connection with the rejection of an application for a building permit for the construction of an agricultural shed. A response to this claim will be sent in the form of a letter. The letter will be sent by the municipality's legal counsel.
College Decision:
- to approve the draft response to the liability claim in connection with the rejection of an application for a building permit for the construction of an arable farming shed;
- have the response sent by the in-house lawyer;
- instruct the company lawyer to negotiate an amicable settlement.
