3. Decision not to consider complaints

A complaint has been filed against several employees, aldermen and the mayor of the municipality of Son en Breugel. Among other things, the complaint is directed against the contact with the municipality. The purpose of complaint handling under the General Administrative Law Act is to restore trust in the government. Since it is clear that trust cannot be restored, it is decided not to handle the complaint. The points that remain open will be taken up further.

College Decision:

  • Not to consider the complaint directed against several employees, aldermen and the mayor of the municipality of Son en Breugel about the contact with the municipality;
  • Continue to deal with outstanding items.

4. Decision on objection to administrative order

On October 4, 2023, the college decides to impose an administrative enforcement order for building in deviation from the granted environmental permit and leaving this structure in place without the necessary permit. On November 7, 2023, the college receives an objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.

The college decides:

  1. To declare the objection unfounded;
  2. Uphold the contested decision with modification of the reasons;
  3. To refer to the opinion of the Objections Committee for the reasons for the decision.

5. Political Evening March 7, 2024

The college discusses the program of the March 7 Political Evening 2024.
 

6. (Re)development Wolfswinkel; 3 space-for-space homes; including preconditions and principles

A request in principle has been submitted for the development of three space for space homes in Wolfswinkel. The proposed development will be adjacent to the existing ribbon of Wolfswinkel. The three landowners (family members) would like to divide this plot into three lots so that each can build a sustainable home with an eye for lots of greenery. The intention is to live there themselves. Cooperation is granted in principle to the request in principle to realize a maximum of 3 space-for-space homes. The initiator is asked to further elaborate this request in principle, taking into account the established preconditions and starting points.

The college decides:

  1. To cooperate in principle with the request in principle for the development of up to 3 space-for-space homes in Wolfswinkel;
  2. To agree to the preconditions and principles for the possible realization of up to 3 space-for-space homes in Wolfswinkel;
  3. To inform the initiator in writing about the preconditions and starting points for the possible realization of a maximum of 3 space-for-space houses in Wolfswinkel. Also to request the initiator to come up with a detailed plan that meets these conditions.

7. Establishment of periodic hot spot monitor

Our municipality has now gained experience in naming an archival hotspot, namely over corona. Now we are taking follow-up steps for structural assurance of the process by developing a hotspot monitor to also exempt other relevant subjects from destruction.
Since 2017, municipalities have been required to work with the hotspot monitor. One of the Critical Performance Indicators from the Archive and Information Management Improvement Plan 2023-2024 is therefore about setting up a hotspot monitor.

The college decides to introduce a hotspot monitor.

8. Breeakker; Wvg area; answer council questions

In response to the information to the council (council information letter no. 137 dated February 09, 2024) regarding the progress of the work for the preparation of the development vision "Breeakker; Wvg area" and the start of the environmental dialogue, some questions have been raised by the council. The college adopts the answers to the questions raised and decides to inform the council accordingly.

The college agreed with the answer and decided to send the council the memo "Answering council questions; Breeakker Wvg area.

9. Subsidy Scheme Welfare Son and Breugel 2024.

In December 2023, the new General Subsidy Ordinance Son en Breugel 2024 was adopted by the council. This came into force on January 1, 2024. The underlying Subsidy Regulation Welfare (formerly the Subsidy Policy Rules) regulates the further elaboration of implementation rules and powers delegated to the college in the regulation. This Welfare Subsidy Scheme needs to be updated to be in line with the structure, format and terminology of the Regulation. The update of the Grant Regulation is done in two steps. First, a more technical and editorial update to ensure that the grant regulation is in line with the regulation, that references are correct and that duplicate provisions are avoided. The second step is an update of substantive provisions. That change will be presented to you later this year when the Arts and Culture Policy is updated and the Events Policy is also reauthorized. It is recommended to adopt the updated Subsidy Regulation Welfare Son and Breugel 2024.

10. Swimming pool Breeakker Street 4

On November 30, 2023, we received an application for an environmental permit to construct a swimming pool. The building plan violates the zoning plans in force on the site, "Son Midden" and "Bebouwde kommen; revision 2017". The required minimum distance from the property boundaries is not met. It is recommended to grant cooperation to the building plan pursuant to Section 2.12 subsection 1 part a under 2º of the General Provisions Environmental Law Act (out-of-plan deviation procedure).

The college decides to grant cooperation to the realization of a private swimming pool by means of an out-of-plan deviation procedure pursuant to Section 2.12 subsection 1 part a under 2º of the Wabo.

11. Traffic proposal BS BuitensteBinnen

In connection with the new construction of BuitensteBinnen Elementary School, a number of adjustments to the public space must be made. This is important to create a safe traffic situation and parking facilities. In order to realize this, a design has been made with attention to the school environment, routes for slow traffic and finally parking.

The college decides to agree to "traffic proposal BuitensteBinnen" with the exception of the bike lane included. 
 

12. Regional preparation of tender for Wmo Help with the household 

Son en Breugel has entered into a framework agreement for the provision of Wmo Help with the household. This framework agreement is the result of a joint tender with Nuenen in 2020. As of January 1, 2025, the agreement can be extended one more time. However, there is a desire to start a tender with several municipalities. Besides Son en Breugel, these are Nuenen, Geldrop-Mierlo and Waalre (also called: Dommelvallei+). The agreements of Geldrop-Mierlo and Waalre expire one year earlier, namely on January 1, 2025. Although our agreement can be extended for another year, we are advised to participate in this tender now. Partly because of the economies of scale, working more efficiently in a larger context and a uniform regional rate. We can still make a trade-off between joining the new agreement immediately on Jan. 1, 2025, or possibly joining the new agreement a year later. The timing of switching to the new agreement is still under consideration. In a separate recommendation, the procurement strategy and procurement documents will be submitted to you for adoption.

The college decides to approve the official preparation of the tender for Wmo Help with the household in cooperation with Nuenen, Geldrop-Mierlo and Waalre.

13. Statement of no objections Ekkersrijt, parcel B02774G

A. Jansen BV has had a piece of land (10,248 m²), improperly in use since 2010. It concerns a parcel of (forest) land belonging to them (purchased in 2008). Specifically, the plot is being used as a water basin and storage/parking area for materials and equipment. This use is contrary to the zoning plan. The zoning plan indicates as use "forest." In addition, they do not have an environmental permit from the county for their activities. Jansen applied to the province for an environmental permit for this conflict, environmental and conflicting use section, in January 2023. However, the application has not yet been completed by Jansen on the landscape investment component. In anticipation of completing the permit, the province has asked the city council to issue a statement of no objections. The municipal council must make a decision on this.
