1. Adoption of the list of non-public decisions and the list of public decisions of the Municipality of Son en Breugel dated December 22, 2020 / Hans Gaillard

The college adopts the decision lists.
 

2. Purchase of body cameras for Boa / Hans Gaillard

The Boa's successfully completed a three-week pilot program with body cameras. These are intended to promote a safe working environment. The body cameras are used in cases where contact with a person threatens to escalate. Research shows that their use has a de-escalating effect. Images are used as evidence or for educational purposes. A policy rule will be established for the use of body cameras and images.

The council decides:

  • take note of the evaluation of the pilot;
  • Boa's the final purchase of three body cameras for the Boa's ;
  • to establish the policy rule on the use of body cameras by special investigating officers in the municipality of Son en Breugel.

3. Decision on objection to rejection of planning damage claim / John Frenken

On July 2, 2020, the council decides to reject the claim for planning damage resulting from the entry into force of the "Buitengebied 1999" zoning plan. On August 13, 2020, the council received an objection from the objector against the above decision. The objections committee recommended that the objection be declared unfounded, that the contested decision be upheld, and that the request for reimbursement of legal costs be rejected.

College Decision:

  • Declare the objection unfounded;
  • uphold the contested decision;
  • Reject the request for reimbursement of legal costs;
  • Refer to the opinion of the Objections Committee for the reasons for the decision.

4. Report on research into poverty and income schemes in Son en Breugel / Paul van Liempd

On behalf of the municipality, the GGB BZO conducted research into poverty and income schemes in Son en Breugel in 2020. The research has been completed. The council will receive the research report.

The council takes note of the report on poverty and income schemes in Son en Breugel and submits the report to the BZ committee.


5. Regional plan for decentralization of sheltered housing 2021 Eindhoven region / Paul van Liempd

Municipalities are faced with the task of organizing sheltered housing in a future-proof manner and developing its content in the coming years. The Association of Netherlands Municipalities (VNG) and the national government have made administrative agreements to this effect. Central to this is that financial responsibility will also be transferred in phases from the central municipalities to all municipalities. The national government will implement the decentralization of resources for sheltered housing in phases over a period of 10 years. Gradually, the resources for this will be transferred from the central municipalities (in this case Eindhoven) to the regional municipalities. The national government and the VNG have agreed that municipalities will draw up a regional plan for the decentralization of sheltered housing.

The council decides:

  • to approve the regional plan for the decentralization of sheltered housing;
  • submit the regional plan to the Civil Affairs Committee for information;
  • inform the Social Domain Advisory Council of your decision to adopt the regional plan.

6. Amendment to the Son en Breugel Debt Assistance Regulation 2021 / Paul van Liempd

The Municipal Debt Assistance Act (WGS) stipulates that residents with problematic debts can turn to municipalities for advice, debt mediation, or a restructuring loan, among other things. This act will be amended with effect from January 1, 2021, for the purpose of exchanging personal data, among other things. The basic principle is that debt assistance should be widely accessible. It is important that residents know within what period of time after the initial consultation about their request for assistance a decision will be made as to whether they are eligible for a debt settlement. Municipalities are required to lay this down in a regulation.

The College:

  • takes note of the amendment to the Municipal Debt Assistance Act.
  • decides to approve the attached council proposal to adopt the Son en Breugel Debt Assistance Regulation 2021.

7. Agreement between the Municipal Health Service (GGD) and Paul van Liempd regarding the implementation of the reporting function under the Wvggz (Mental Health Care Act)

As of January 1, 2020, the Special Admissions to Psychiatric Hospitals Act (BOPZ) has been replaced by the Compulsory Mental Health Care Act (Wvggz) for people with a mental disorder and the Health Compulsion Act (Wzd) for people with a psychogeriatric disorder or intellectual disability. As of 2020, the reporting function under the Wvggz will be carried out by the Municipal Health Service (GGD) for eight municipalities. Based on the experiences with the GGD and the evaluation conducted by the GGD, it is proposed to continue this collaboration for another period of three years.

The board:

  • takes note of the evaluation report on the Wvggz reporting function by the Bijzonde-re Health team Health the GGD Brabant-Zuidoost
  • decides to continue the implementation of the Wvggz reporting function by the GGD Brabant Southeast;
  • decides to enter into an agreement with the GGD Brabant Zuidoost for a period of 3 years, with an option for a 1-year extension;
  • decides to make an annual amount of €12,137 available (2020 price level) with annual indexation of the GGD indexation percentage;
  • decides to enter into an agreement with the Municipal Health Service (GGD) for the processing of personal data.
