1. Internal (not public) decision list and public decision list dated March 21, 2023 - Hans Gaillard

The college adopts the decision lists.

2. ENSIA 2022 DigiD and Suwinet - Hans Gaillard

The college of the municipality of Son en Breugel accounts for the year 2022 on the state of information security within the municipal organization. This is based on the Eenduidige Normatiek Single lnformation Audit (= ENSIA) system.

The college notes:

  • That at municipality of Son and Breugel, accountability for DigiD has been established;
  • That at municipality of Son and Breugel accountability for Suwinet has been established.

3. Legal quality assurance municipality of Son and Breugel - Hans Gaillard

The report "Legal Quality Assurance Municipality of Son and Breugel" includes how the legal function in the municipality of Son and Breugel is organized and how the legal quality of our products and services can be secured even better.

The college decides to adopt the report "Legal Quality Assurance Municipality of Son and Breugel".

5. Authorization to represent request for injunction and objection - Hans Gaillard

A notice of objection and a request for injunctive relief have been received against an environmental permit for felling. The handling of these cases is being taken up by the municipality's green consultant. However, he is not authorized to represent the college. This is taken care of by this authorization decision.

The college decides to authorize the public green space consultant to represent the college regarding the processing of the request for injunctive relief and the objection to an environmental permit for felling, in accordance with the authorization decision.

6. Appointment of deputy secretary - Jelle de Jong

The replacement of the town clerk should be secured within the organization. In connection with the upcoming departure of the first deputy secretary, it is important to designate a new replacement for the town clerk. This is a temporary appointment related to the current staffing within the Steering and Coaching team. The moment the managers are appointed then the designation of replacements will be reviewed.

The college decides to designate as a replacement for the town clerk, in view of article 106 of the municipal law, effective March 28, 2023: first and temporary replacement, Mr. H.A.J. Loos, coordinator a.i. team Red and Strategy and Advice.

7. Terminate pilot solar along A50 - Steven Grevink

Since 2019, we have been working with Rijkswaterstaat, Rijksvastgoedbedrijf and the Rijksdienst voor Ondernemend Nederland to realize a pilot of Zon along the A50 (solar panels). It has been noted by the national parties that the Ekkersweijer node does not offer enough space to achieve concrete development within the set frameworks. As a result, there is insufficient volume to arrive at an own tender. The remaining land in the picture will be included in the OER application for the A2, which the RES has already submitted to the Ministry of Economic Affairs & Climate.

The college decides to:

  • To take note of the letter from the Ministry of EZK regarding the termination of the solar pilot project along A50 in Son en Breugel;
  • Inform the City Council with the next council information letter.

8. Omgevingswet decision council def delegation binding advisory right mandatory advisory right extended procedure - Jelle de Jong

Over the past few months, the council has been taken through informative and image-forming meetings on the choices and decision-making to be made by the city council for 4 components under the Omgevingswet. These are the components 'delegation', 'participation in relation to the Omgevingswet', 'extended procedure' and 'the binding advisory right by the council'. The outcome of the three meetings has guided the draft council proposal and decision to be taken by the city council. The draft council proposal and decision was, as agreed (prior to the judgment-forming meeting of the council), shared with the council members to ask substantive questions and/or make comments (period February 28 to March 10, 2023). The submitted questions c.q. comments were (partly) included in the final draft council proposal and decision now presented for the judgment meeting.

The college decides to:

  1. to agree with the answers to the submitted questions/comments as included in the memo "Omgevingswet; answers submitted questions or comments regarding the draft proposal and decisionOmgevingswet; decision-making 'delegation', 'binding advisory right', 'mandatory participation' and 'extended procedure' " dated March 22, 2023;
  2. To adopt the council proposal and draft council decision;
  3. To send the council the council proposal and draft council decision.

9. Opinion-forming meeting council Raw materials policy - Jan Boersma

Son and Breugel joined Blink in 2022. When joining Blink, it was decided to maintain the current level of service and make a new assessment of the service level in 2023. This agreement was ratified in the college program 2022-2026. This is the reason for preparing a new resource policy plan. On April 20, 2023, the college will discuss with the council the ideas and preferences that the council groups have about the development of waste collection and waste prevention.

The College decides to adopt the image-forming memorandum and submit it to the City Council.

10. Building energy generation policy and heat pumps - Steven Grevink

Due to the development of technology and the high cost of electricity, we are seeing an acceleration of various sustainability initiatives, such as wind-on-roof, heat pumps and solar panels (non-roof). As a result, permit and enforcement requests are increasing on various topics. As a municipality, we are positive about sustainable developments. However, there is now a lack of frameworks to encourage residents toward the most desirable solutions. We will therefore draw up policy to provide clear frameworks for what is and is not desirable.

The college decides to direct Facet to develop policies for wind-to-roof, heat pumps and solar panels (non-roof).

11. Social Emergency Fund Son and Breugel - Steven Grevink

Inflation is at an all-time high, causing the cost of living and especially energy to rise significantly. This threatens more and more people with financial problems. Not only minima, but also people with low and middle incomes. To prevent a large number of them from falling into debt or poverty due to the high inflation and energy crisis, a local Social Emergency Fund has been developed. It takes effect one day after the publication of the policy rules with retroactive effect from January 1, 2023.

The college decides to:

  1. To adopt the policy rules Social Distress Fund Son and Breugel;
  2. To allocate €15,000 in 2023 for the Emergency Social Fund charged to fcl poverty policy;
  3. To grant mandate to the Lumens Area Coordinator to implement the Social Hardship Fund policy rules, as per mandate decision;
  4. Inform the City Council through the next council information letter.

12. LEADER Het Groene Woud - Steven Grevink

With the declaration of intent the college confirms that the municipality of Son & Breugel:
- wants to be part of the LEADER program Het Groene Woud (duration 2023 to 2027);
- is prepared to provide the necessary co-financing for this.

The college decides to sign the declaration of intent to want to be part of
LEADER program Het Groene Woud.

13. Memorandum Social Domain Policy Framework 2023-2026 - Steven Grevink

The memorandum Social Domain Policy Framework contains the vision and ambitions within the Social Domain for the next 4 years. The version now before you is the result of the discussion with the council in the image-forming session of September 22, 2022. This version also incorporates the advice of the Social Domain Advisory Council.

College Decision:

  • To approve the memorandum Social Domain Policy Framework 2023-2026;
  • To agree to the draft letter to the Social Domain Advisory Council with the administrative response to their advice.

14. Plan of approach to CMD March 2023 - Steven Grevink

In 2022, the audit committee investigated the operation of the Center for Social Participation (CMD). The committee recorded its findings, conclusions and recommendations in the report The CMD Unravels? On March 9, the council agreed to the recommendations and instructed the college to prepare a Plan of Action that would implement the recommendations of the audit committee.

The college decides to adopt the Center for Social Participation Action Plan and send it to the council for information.
