1. Non-public decision list and public decision list dated December 21, 2021 / Hans Gaillard
The college adopts the decision lists.
2. Updating general local ordinance / Hans Gaillard
The current General Local Ordinance 2019 municipality of Son en Breugel was adopted by the municipal council on June 13, 2019. On December 17, 2020, the municipal council adopted the first amendment to the ordinance, adding a provision for a ban on Carbide shooting. The second amendment was adopted by the City Council on July 22, 2021. The second amendment added a provision to enforce against the use of nitrous oxide. Now it is time for an overall update of the General Local Ordinance.
The College decides to submit the council proposal "Update of General Local Ordinance" to the City Council.
3. Eindhoven metropolitan region: draft work program 2022 / Hans Gaillard
The MRE Executive Board recently presented the draft MRE 2022 work program to the City Council. With the invitation to submit a view on this work program before February 3, 2022.
College Decision:
- To accept the draft MRE 2022 work program for notification;
- To propose to the City Council to submit a view on the draft MRE 2022 work program;
- To agree to the draft letter "Viewpoint Son and Breugel".
4. Omgevingswet; Omgevingswet program team; reports and college opinions / Paul van Liempd
The Program Team Omgevingswet offers the adopted minutes of the December 16, 2021 meeting for information, so that the college can follow the developments of the Implementation Program Omgevingswet in Son and Breugel.
The College decides to take note of the adopted report of the Omgevingswet Program Team of the meeting of December 16, 2021.
5. Eindhoven metropolitan region: ambition document / Hans Gaillard
Recently, the MRE Executive Board presented the draft ambition document "Balance in growth from economic quality for our healthy living environment" to the City Council. along with the invitation to submit a response to this document by Feb. 3, 2022.
College Decision:
- Accept the draft ambition document "Balancing growth from economic quality for our healthy living environment" for notification;
- To propose to the City Council a response to the draft ambition document "Balancing Growth from Economic Quality for Our Healthy Environment."
- Agree to the draft letter "response Son and Breugel".
6. Award recommendation for tender for framework agreements Element and Asphalt Maintenance / Jan Boersma
The tender procedures for the framework agreements for element and asphalt maintenance were recently completed. For the framework agreement element maintenance, RO-infra B.V. tendered the lowest price. For the framework agreement asphalt maintenance KWS infra B.V. tendered the lowest price. The college decides to award the framework agreements for element and asphalt maintenance to RO-infra B.V. and KWS infra B.V., respectively.
College Decision:
- Adopt the award recommendation for the 2022-2024 element maintenance framework agreement;
- To adopt the award recommendation for the 2022-2024 Asphalt Maintenance Framework Agreement;
- To award the framework agreement element maintenance 2022-2024 to RO-infra B.V. in the amount of €1,388,872.85 excluding VAT;
- To award the 2022-2024 asphalt maintenance framework contract to KWS infra B.V. in the amount of € 298,900, excluding VAT.
7. Amendment regulation individual income supplement and special assistance / Paul van Liempd
This proposal implements the widely supported desire to increase the income limit of the minimum regulations to 120 percent of the social assistance standard. This will make these schemes accessible to more low-income residents. This proposal raises the income limit of special assistance and individual income supplement in the special assistance and approves the council proposal on raising the income limit of the individual income supplement.
College Decision:
- To approve the council proposal to adopt the 2022 Individual Income Supplement Regulation;
- Adopt the Special Assistance Policy Rules 2022.
8. Establish right of superficies for two casing pipes for the Sonse Heideloop pipeline / Paul van Liempd
The Water Board received a permit in 2021 to lay an aquifer pipeline to the agricultural area around the Sonnius neighborhood. Where the pipeline crosses the Dutmella path and Gentiaan bike paths, the pipeline is in a casing pipe. After removal of the pipeline (in 2 years), the casing pipes will remain. To ensure that the pipes remain the property of the Water Board and that the Water Board also bears the costs of maintenance and removal, the municipality of Son en Breugel has requested that a right of superficies be established for these two pipes.
College Decision:
- To establish for the benefit of Waterschap de Dommel a right of superficies on cadastral parcels Son en Breugel, Section A, number 5034 and Son en Breugel, Section A number 4806;
- To give a power of attorney to an associate of Wedemeijer Marks notarissen N.V. in Oirschot to establish the right of superficies.
9. DVO Municipality of Eindhoven / Paul van Liempd
The College decides to approve the updated DVO for 2022 and 2023 and the costs for these services. The Mayor grants power of attorney to the Alderman Youth to sign the DVO. The college grants mandate to the college of the municipality of Eindhoven to enter into or terminate agreements on behalf of the municipality of Son and Breugel with service providers for specialized forms of youth aid and Safe Home. Eindhoven may amend these agreements if the participating municipalities are informed in advance and with reasons. The amendment may not have a higher financial impact than 6.5% of the total order value per calendar year for all participating municipalities. The College authorizes the Mayor of the Municipality of Eindhoven to sign agreements. The college authorizes the college of Eindhoven to grant a submandate.
College Decision:
- To agree to continue the updated DVO for the period January 1, 2022 through December 31, 2023, in accordance with the draft "Service and Cooperation Agreement 21 Youth Aid and Safe Home Southeast Brabant 2022 through 2023" with appendices;
- To ask the Mayor to give power of attorney to the Portfolio Holder for Youth to sign the DVO21 referred to in decision point 1;
- Grant a mandate to the Municipal Executive of the Municipality of Eindhoven, each insofar as it concerns its powers, in accordance with the draft municipal gazette, to:
a. decide on behalf of the municipality of Son and Breugel to enter into or terminate agreements with service providers for youth assistance and Safe Home as described in the DVO21;
b. to decide to amend the agreements referred to under a on condition that:
i. the participating municipalities have been informed in a timely and reasoned manner prior to the amendments; and
ii. the amendment per agreement has a financial impact of less than 6.5% of the total contract value per calendar year for all participating municipalities. - Authorize the Mayor of the Municipality of Eindhoven to sign the agreements mentioned in decision point 2. Those agreements are also binding on the Municipality of Son and Breugel;
- Authorize the College of the Municipality of Eindhoven, each insofar as its powers are concerned, to grant submandates to subordinates for the powers referred to in decision points 2 and 3;
- Agree to the cost of this service of €8,744.00 per year;
- Send the Council Information Letter.
10. Workplan21fortheYouth 2022 Upper Regional Network of Expertise / Paul van Liempd
The college approves the Work Plan 21 for Youth 2022 and makes an amount of € 8,999 available for this purpose. The work plan defines the regional procurement of youth aid for 2022. The mayor grants power of attorney to Alderman Richters of Eindhoven to sign the "cooperation agreement Bovenregionaal Expertisenetwerk Jeugd Brabant/Zeeland and representation of municipalities/ Regional Expert Teams" on behalf of the municipality of Son en Breugel. This allows resources from the Bovenregionaal Expertise Network to be used for the further development of the Regional Expert Team. The Expert Team is a means to lead youth with complex problems to appropriate Health.
College Decision:
- To agree to the agreements, budget and cost sharing from the "Work Plan 21 for Youth 2022" . The contribution for our municipality is €8,999 for 2022;
- To request the mayor to grant power of attorney to Alderman Richters of the Municipality of Eindhoven to sign on behalf of the Municipality of Son and Breugel the 'cooperation agreement Bovenregionaal Expertisenetwerk Jeugd Brabant/Zeeland and representation of municipalities/ Regional Expert Teams'.
