1. List of non-public decisions and list of public decisions dated April 20, 2021 / Hans Gaillard
The council adopts the lists of decisions.
2. Information policy for the Dommel Valley 2021-2025 / Hans Gaillard
The Dommel Valley Information Policy 2021-2025 sets out the frameworks and priorities for shaping the information society by and within the municipalities of the Dommel Valley for the period 2021-2025.
College Decision:
- to adopt the Dommel Valley Information Policy 2021-2025;
- to adopt the (draft) council proposal;
- Municipal Clerk’s Office both documents to the Municipal Clerk’s Office for consideration at a political evening.
3. Adjustments to the Regional Development Fund for Work Locations / Jan Boersma
In February 2021, the municipal council approved the amendments to the Regional Development Fund for Work Locations (ROW). In doing so, the council also delegated the provision of subsidies in this context to the ROW foundation. A recent ruling by the Council of State shows that delegating a public law authority to a private entity is not permitted. In consultation with the lawyers at the municipalities in the Eindhoven Urban Area (SGE), it has been agreed that mandating this authority is possible. This does, however, mean an amendment to the decision of February 2021.
The council decides to propose to the municipal council:
- to revoke the decision dated February 4, 2021, whereby the council:
a. delegated the authority to grant subsidies within the framework of the Regional Development Fund for Work Locations to the SGE Work Locations Development Fund Foundation (with the SGE 2021 Regional Development Fund for Work Locations Investment Subsidy Regulation, to be adopted, as the standard framework for the delegated task);
b. has adopted the Subsidy Regulation for Investments in the Regional Development Fund for Work Locations SGE 2021. - to repeal the Subsidy Regulation for Investments in the Regional Development Fund for Work Locations SGE 2021 and to adopt a new regulation (with a few technical amendments), in accordance with the draft regulation;
- the authority to implement the subsidy regulation, which explicitly includes making a decision on an application for a subsidy under the Subsidy Regulation for Investments in the Regional Development Fund for Work Locations SGE (2021), including all associated preparatory and implementation activities, to the SGE Business Locations Development Fund foundation in accordance with the draft decision.
4. Questions March 18, 2021, regarding the Village Hall project / Jan Boersma
The Dorpsbelang, VVD, and Voor-U political parties have submitted questions to the municipal executive regarding Hekkelman's permit and working methods (email dated March 18, 2021). The letter containing the questions and a draft response has been submitted. If the municipal executive approves this letter, it will be sent to the council members.
College Decision:
- To take note of the letter answering the questions;
- To agree to answer the questions;
- Agree to send the letter to council members.
5. Procurement strategy for crisis assistance for young people in 2022 and beyond / Paul van Liempd
The municipality is responsible for, among other things, crisis assistance for young people. This form of youth assistance is jointly procured by the 21 municipalities in Southeast Brabant. The current contracts for crisis assistance will expire at the end of 2021. It is proposed that the procurement strategy for crisis assistance for 2022 and beyond be established.
The council decides to adopt the procurement strategy "Procurement of crisis assistance for young people 2022 and beyond."
6. Provision of resources for youth activities / Jos de Bruin
The government has made financial resources available to municipalities to organize activities for young people within the applicable measures. The youth work department will organize the game "The Hunted." Every young person from Son en Breugel can register; there is room for 200 participants. The municipal executive will make part of the extra government funds available for this purpose.
The council decides to allocate €3,630 from the additional government funds for the Youth Package to 'The Hunted' and includes this in the first management report.
7. Agenda for the public council meeting on April 29, 2021 / Hans Gaillard
The council discusses the items on the agenda for the council meeting on April 29.
8. Appointment decision secretary regional disputes committee / Hans Gaillard
Since the entry into force of the Civil Servants (Normalization of Legal Status) Act on January 1, 2020, employers are required to establish a disputes committee. By decision of November 17, 2020, the municipal executive decided that the municipality of Son en Breugel will join the Regional Disputes Committee for Southeast Brabant. The municipal executive still has to appoint a secretary for this disputes committee.
The council decides to adopt the 'appointment decision for the secretary of the regional disputes committee': Ms. Monica Bellemakers as secretary and Ms. Suzanne Glaudemans as deputy secretary.
9. SGE: Administrative Platform dated April 30, 2021 / Hans Gaillard
The Administrative Platform of the Eindhoven Urban Area (SGE) is scheduled for April 30, 2021. This advisory report presents the agenda and supporting documents for the attention of the municipal executive.
The council decides to take note of the agenda and supporting documents for the Eindhoven Urban Area Administrative Platform dated April 30, 2021.
10. Responses to various written questions posed by the VOOR U! political party on March 18, 2021 / John Frenken
On March 18, 2021, the VOOR U! political party asked three questions about the quiet center, the felling of trees, and the protection of trees. The council decided to inform the council of the answers to the questions in accordance with the Rules of Procedure.
College Decision:
- to agree with the answers to the questions asked;
- inform the council of these responses.
11. Development site Europalaan 2; statement by the municipality regarding subsidy request Zuidzorg / John Frenken
Zuidzorg requests the municipality, in connection with a subsidy application by Zuidzorg, to sign a statement confirming that the property at Europalaan 2 is eligible for a feasibility study to convert the building into housing/a residential care facility.
College Decision:
- to take note of Zuidzorg's wish to submit a subsidy application under the 'Housing and Health Incentive Scheme Health SWZ)' for a feasibility study to convert the building at Europalaan 2 into a residential care home;
- as a guideline, the remaining available space in the building should be filled with start-ups.
The mayor instructs Alderman to sign the requested statement from Zuidzorg.
12. Public Green Space Policy Document 2021 / Jan Boersma
The current green policy plan from 2013 is due for partial revision. The draft memorandum provides details on this. It is now being presented to the council for discussion as an informative document.
College Decision:
- to approve the draft policy document to be presented to the council for discussion as an informative document;
- approve the draft estimate
13. Motion Local coronavirus fund / Paul van Liempd
On March 18, 2021, the municipal council of Son en Breugel unanimously approved the motion to establish a local coronavirus support fund. The Tonk scheme is intended by the national government to provide municipalities with local tailor-made solutions that meet the specific needs of our municipal council. In order to further implement the municipal council's decision, we are expanding the municipal Tonk scheme. We are doing this by increasing access for residents who have been affected. In addition, the municipal executive will assess individual cases of households and entrepreneurs for possible support from the municipal fund.
College Decision:
- with the expansion of the Tonk scheme and assessment of individual cases, implement the municipal council's motion to establish a local coronavirus support fund.
- to adopt the policy rules "Temporary support for necessary costs (Tonk) version 2 (2021) municipality of Son en Breugel";
- to use municipal funds from the motion to implement the scheme;
- to approve the council information text for the next council information letter;
- give effect to the motion by also calling on households and businesses to apply for individual support when (national) regulations do not provide for this.
14. Decision on objection to rejection of Tozo 2 application / Paul van Liempd
On November 13, 2020, the board decides to reject the application for a Social assistance benefit living expenses under the Temporary Bridging Measure for Independent Entrepreneurs (Tozo 2). On December 23, 2020, the board receives an objection from the objector against the above decision. The appeals committee recommended that the appeal be upheld and that the contested decision be partially revised, on the understanding that a Social assistance benefit living expenses under Tozo 2 could be granted for the month of September 2020.
College Decision:
- to declare the objection well-founded;
- partially revise the contested decision, on the understanding that a Social assistance benefit living expenses may be granted under the Tozo 2 for the month of September 2020;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
15. Opinion on draft RES 1.0 / Paul van Liempd
On March 18, 2021, the draft RES 1.0 was released for consultation. All municipal executives and councils will first have the opportunity to submit a formal opinion on the RES before July 1, 2021. With the consultation round, the MRE RES is asking for a decision on the draft RES 1.0 and the search areas in the planMER. The municipal executive agrees with the opinion of the municipality of Son en Breugel on the draft RES 1.0 and will submit it to the municipal council for a decision.
College Decision:
- take note of the draft RES 1.0 2.;
- to agree with the opinion on the Draft RES 1.0 to submit this to the municipal council for decision-making.
16. Dioscuri Grant 2021 / Jos de Bruin
The Dioscuri gymnastics club submitted a subsidy application for 2021, but it was too late and was therefore rejected. The club lodged an objection to this decision. Although we believe that the subsidy application was rightly rejected, we value a sustainable relationship with Dioscuri more highly. We therefore propose to grant a subsidy for 2021 after all.
College Decision:
- to grant the Dioscuri gymnastics club a subsidy of €2,864 for 2021;
- in 2021, cover the costs of the subsidy (€2,864) from the transition budget from the old to the new subsidy policy, and include the costs for 2022 and beyond in the budget.
