3. Annual report and financial statements 2024 School Board Platoo

School Board Platoo, in accordance with its bylaws, submits the 2024 Annual Report to the City Council for consultation. Both the annual report and financial statements do not give rise to any questions.

The College decides:
1. to take note of the 2024 annual report of school board Platoo;
2. to inform the City Council of this through the next Council Information Letter.

4. Decision on objection rejection of application for financial allowance

On December 11, 2024, the college decides to deny an application for financial relief. On January 13, 2025, the college receives a notice of objection from the objector to the above decision. The appeals committee recommends that the appeal be declared unfounded and that the contested decision be upheld.

The college decides:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

5. DVO procurement and contract management Youth CarePlus.

The municipalities of Landsdeel Zuidoost want to go through a new procurement procedure for the contract period starting January 1, 2026 for JeugdzorgPlus. At the end of 2024 consensus was reached within Landsdeel Zuidoost that the municipality of Eindhoven will carry out this new procurement on behalf of all the municipalities of Landsdeel Zuidoost. The municipality of Eindhoven thus takes over the role of central municipality from the municipality of Roermond. It is therefore proposed to conclude the new Service and Cooperation Agreement JeugdzorgPlus (decision point 3 and annex 3a).

The college decides:

  1. To take note of the departure of region Hart van Brabant from Landsdeel Zuidoost to Landsdeel Zuidwest as of January 1, 2026;
  2. Agree to the addition of South Limburg Region to Landsdeel Zuidoost Nederland as of January 1, 2026 under the Requirements set forth with this recommendation;
  3. To agree to the Service and Cooperation Agreement Purchasing and Contract Management (DVO) JeugdzorgPlus Landsdeel Zuidoost Nederland for the period from June 1, 2025 to December 31, 2029 with the option to extend twice by 1 year to a maximum of December 31, 2031 and to sign it as part of region Zuidoost Brabant;
  4. commission, mandate, authorize and empower the Municipal Executive of the Municipality of Eindhoven in accordance with the draft Municipal Gazette, each insofar as their powers are concerned, to:
    a. decide, on behalf of the Municipality of Son en Breugel, to enter into or terminate agreements with service providers regarding JeugdzorgPlus as described in the DVO referred to in decision point 3;
    b. decide to amend the Agreements referred to under a. on condition that:
    I. the total financial impact of this amendment per Agreement does not exceed 10% of the total original contract value;
    II. the total financial impact of this amendment per Agreement does not exceed the European Threshold; and
    III. the amendment of the Agreement does not otherwise lead to a substantial change within the meaning of the Procurement Act 2012.
  5. To request the Mayor to give power of attorney to the Mayor of the Municipality of Eindhoven to sign the agreements mentioned in decision point 4 in accordance with draft municipal bulletin. These agreements are also binding for the municipality of Son en Breugel;
  6. Authorize the College of Mayor and Aldermen of the Municipality of Eindhoven to grant submandates to subordinates for the powers referred to in decision points 4 and 5 in accordance with draft municipal bulletin;
  7. To remove JeugdzorgPlus from the scope of the Service Provision and Cooperation Agreement 21 Municipalities Southeast Brabant regarding Youth Protection & Youth Rehabilitation (JBJR), Safe Home (VT), Crisis Intervention Team (CIT), Crisis Aid Coordination and JeugdzorgPlus (JZ+), (also called DVO 21) by entering into the addendum and signing;
  8. To adopt the new mandate decree with the citation "DVO21 ZOB as of June 1, 2025" with simultaneous repeal of the mandate decree "Mandate Decree DVO21 ZOB"; and
  9. incorporate the financial impact of the new DVO into the 2026-2029 budget.

6. Fairgrounds 2025

Bureau De Kermisgids has submitted an application on behalf of the municipality of Son en Breugel to organize the fair in the center of Son. The fair will be held from Friday, June 13 through Tuesday, June 17, 2025. The line-up of these attractions is submitted for approval.

College Decision:

  1. Agree to set up the fairgrounds from June 13 to 17, 2025;
  2. To take note of traffic measures to be taken for safe conduct.

7. Program Cost Recovery and Financial Contribution + RIB text.

To achieve various ambitions and objectives as a municipality, a clear working method is needed regarding municipal cost recovery. This program, according to the Omgevingswet also gives the municipality an additional instrument as the financial contribution. Cost recovery means that the municipality can pass on costs incurred for a specific building plan to the landowner (initiator) according to the rules of the Omgevingswet. This includes, for example, costs for adapting infrastructure or realizing certain facilities. In addition to the costs for specific building plans, the municipality also invests in the public area, such as nature restoration and new roads. New construction plans benefit from these investments in the public area by using the facilities. Therefore, the promoters also contribute financially to these municipal investments through a financial contribution.

The college decides:

  1. Adopt the Cost Recovery and Financial Contribution Program and make it available to the official organization for use.
  2. Adopt the text on Program Cost Recovery and include it in the next council information letter.

8. Decision on complaint

A complaint was filed against conduct of an employee of the municipality. The complaint was handled in accordance with Chapter 9 of the General Administrative Law Act and the 2009 Complaints Procedure. The complaint handler recommends that the complaint be declared partially founded.

The college decides to declare the complaint directed against conduct of an employee of the municipality of Son en Breugel partially founded and to address the points for attention.

9. Board proposal annual child care accounting 2024 S&B

The municipality is responsible for the supervision and enforcement of childcare quality. Annually, the municipality accounts for these duties to the Ministry of SZW (Inspectorate of Education) by answering a questionnaire.

The college decides:

  1. To adopt the questionnaire Annual Accountability for Childcare 2024 Municipality of Son and Breugel.
  2. Adopt the text on Annual Accountability 2024 Son and Breugel and include it in the next council information letter.
