1. Internal (non-public) list of decisions and public list of decisions dated June 20, 2023 - Suzanne Otters-Bruijnen

The college adopts the decision lists.

2. Decision on objection to environmental permit for tree felling - Jan Boersma

On February 8, 2023, the council decides to grant an environmental permit for the felling of trees at Lamalaan in Son en Breugel. On March 20, 2023, the council receives an objection from the objector against the above decision. The appeals committee recommends that the objection be upheld and the contested decision be revoked, on the understanding that the environmental permit for felling will still be refused. The request for reimbursement of legal costs may be granted.

College Decision:

  1. Declare the objection well-founded;
  2. revoke the contested decision by refusing the environmental permit for the felling of the eight spruce trees;
  3. to maintain the environmental permit for felling the oak tree;
  4. grant the request for reimbursement of legal costs;
  5. Refer to the opinion of the Objections Committee for the reasons for the decision.

3. Update of financial regulations and control regulations - Jan Boersma

The financial regulation and the control regulation based on Articles 212 and 213 of the Municipalities Act need to be updated. This is particularly necessary due to the shift in accountability for compliance from the auditor to the mayor and aldermen. Following discussion in the audit committee, both regulations will be amended. For further explanation, please refer to the council proposal.

The council agrees:

  • with the updated financial regulation and decides to forward it to the municipal council;
  • with the updated control regulation and decides to forward it to the municipal council.

4. Mandate, power of attorney, and authorization resolution IZA Eindhoven cooperation region 2023-2026 - Steven Grevink

The Integral Care Agreement (IZA) came into effect on January 1, 2023. The aim of this agreement is to ensure that Health remains high-quality, accessible, and affordable Health the future. The IZA stipulates that one central municipality per cooperation region will be mandated by the regional municipalities to implement the agreements with the other parties. By signing the mandate, power of attorney, and authorization decision, the municipality of Son en Breugel has assigned these tasks to the municipality of Eindhoven for the period 2023-2026.

College Decision:

  • to grant a mandate, power of attorney, and authorization to the Municipal Executive and the mayor of the municipality of Eindhoven, as included in the mandate, power of attorney, and authorization decision IZA municipality of Eindhoven 2023 to 2026;
  • to request the mayor to grant a mandate and power of attorney to the municipal executive and the mayor of the municipality of Eindhoven by signing the mandate, power of attorney, and authorization resolution IZA municipality of Eindhoven 2023-2026.

5. Decision on complaint - Steven Grevink

On August 17, 2022, and March 23, 2023, two complaints were received against the conduct of employees of the municipality of Son en Breugel with regard to the handling of a file. The complaint was handled in accordance with the 2009 Complaints Procedure. The report of findings shows that mistakes were made and that there was miscommunication. The complaint can therefore be declared partially justified. The remainder of the complaint is unfounded.

The board decides to declare the complaint against the conduct of employees of the municipality of Son en Breugel partially justified.

6. Decision on Woo request - Jelle de Jong

On June 5, 2023, the council receives a request from the applicant under the Open Government Act (Woo). The request is for information relating to integrity violations within the period from January 1, 2020, to December 31, 2022, at or under the municipality of Son en Breugel. A number of details are requested for each case. No documents have been found that fall within the scope of the Woo request.

College Decision:

  • to make a decision on the Woo request submitted by the applicant on June 5, 2023;
  • not to disclose any information in response to the Woo request.

7. Response to written questions from the CDA parliamentary party Good Landlord Act - Jelle de Jong

On behalf of the CDA parliamentary party, written questions were submitted on May 24 regarding the Good Landlord Act.
Specifically, the questions are as follows:

  1. Is our municipality aware of abuses in the local rental market and, if so, how often do they occur and/or how serious are they?
  2. There are three instruments for municipalities. Can you indicate whether we will be able to use all three of them on July 1, and if not, when we will be ready to do so?
  • Municipal reporting center (mandatory)
  • Enforcement of general rules (mandatory)
  • Regular rental permit and migrant workers (optional)

It is proposed that your council adopt the (draft) response.

The council decides to adopt the (draft) response to the written questions received from the CDA political party regarding the Good Landlord Act.

8. May Circular 2023 - Jan Boersma

The May circular was published on May 31, 2023, and the financial consequences are detailed in this memo. Due to errors in the national calculations and additional research, it took longer than expected to paint a complete picture in the short term. As a result, this memo on the May circular is later than usual. With this memo, we are informing the council about the financial consequences and how they will be incorporated into the 2024-2027 multi-year budget. The consequences for 2023 will be included in the second management report for 2023.

The council takes note of the May circular 2023 memo and agrees to submit this memo to the council as an appendix to the 2024-2027 framework memorandum.

9. New indexing method 10vdJ - Steven Grevink

As part of the Youth Reform Agenda, national contract standards have been developed to reduce administrative burdens. One of these aspects concerns indexation. The proposal is to apply the indexation in the national contract standards to the Youth Assistance contracts within A 10 for Youth. In doing so, we are following the developments of the Youth Reform Agenda and offering clear and uniform indexation to youth assistance providers. For 2024, the indexation percentage has been set at 6.43%.

College Decision:

  1. to amend the indexation provision within A 10 for Youth in accordance with the national contract standards with effect from January 1, 2024, and to amend the indexation provision in the agreement accordingly;
  2. not to implement any interim adjustments in the future due to changes in collective labor agreement provisions, as these are reflected in subsequent annual OVA indexation, which forms an important basis for indexation;
  3. to set the indexation percentage for Youth Assistance contracts at 6.43% for 2024.

10. Pilot project for non-indicative daytime activities Archipel - Steven Grevink

The Archipel Foundation has developed a plan to offer day care for elderly people at the Dommelhuis in the form of a general facility, without the need for a referral. A subsidy will be made available for this pilot project for the coming year. During this period, the pilot will be evaluated and a decision will be made about its continuation.

The council decides:

  • to make a subsidy available for the pilot project for general day care facilities for the period from July 1, 2023, to July 1, 2024;
  • to evaluate the pilot in the first quarter of 2024.
