1. Internal (not public) decision list and public decision list dated June 20, 2023 - Suzanne Otters-Bruijnen
The college adopts the decision lists.
2. Decision on objection to environmental permit felling - Jan Boersma
On February 8, 2023, the college decides to grant an environmental permit to cut down trees at the address Lamalaan in Son en Breugel. On March 20, 2023, the college receives a notice of objection from the objector against the above decision. The appeals committee advises to declare the objection well-founded and to revoke the contested decision on the understanding that the environmental permit for felling will still be refused. The request for reimbursement of legal costs may be granted.
College Decision:
- Declare the objection well-founded;
- Revoke the contested decision by still refusing the environmental permit for felling the eight spruces;
- To uphold the environmental permit for felling the oak tree;
- Grant the request for reimbursement of procedural costs;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
3. Updating financial regulation and control regulation - Jan Boersma
The financial regulation and the audit regulation based on articles 212 and 213 of the Municipal Law need to be updated. This is particularly necessary due to the shift of lawfulness accountability from the auditor to the municipal executive. After discussion in the audit committee, both ordinances will be updated. For further explanation, please refer to the council proposal.
The college agrees:
- with the updated financial regulation and decides to forward it to the City Council;
- with the updated audit regulation and decides to forward it to the City Council.
4. Mandate, power of attorney and authorization decision IZA cooperation region Eindhoven 2023-2026 - Steven Grevink
Effective January 1, 2023, the Integral Health Care Agreement (IZA) took effect. This agreement aims to make and keep Health qualitative, accessible and affordable in the future. The IZA states that one central municipality per cooperation region will receive a mandate from the regional municipalities to implement the agreements with the other parties. By signing the mandate, power of attorney and authorization decree, the municipality of Son en Breugel places these tasks with the municipality of Eindhoven for the period 2023-2026.
College Decision:
- Grant mandate, power of attorney and authorization to the College of Mayor and Aldermen and the Mayor of the Municipality of Eindhoven, as included in the mandate, power of attorney and authorization decree IZA Municipality of Eindhoven 2023 to 2026;
- Request the Mayor to grant mandate and power of attorney to the College and Mayor of Eindhoven Municipality by signing the Mandate, Power of Attorney and Authorization Decree IZA Municipality of Eindhoven 2023-2026.
5. Decision on complaint - Steven Grevink
On August 17, 2022 and March 23, 2023, two complaints were received against conduct of employees of the Municipality of Son en Breugel regarding the handling of a file. The complaint was handled according to the 2009 Complaints Procedure. It follows from the report of findings that mistakes were made and that there was miscommunication. The complaint can therefore be declared partially founded. For the remainder, the complaint is unfounded.
The college decides to declare the complaint directed against conduct of employees of the municipality of Son en Breugel partially founded.
6. Decision Woo request - Jelle de Jong
On June 5, 2023, the college receives a request under the Open Government Act (Woo) from the applicant. Information is requested regarding integrity violations, within the period January 1, 2020 to December 31, 2022, at or under the municipality of Son en Breugel. Copies of each case are requested. No documents have emerged that fall within the scope of the Woo request.
College Decision:
- Issue a decision on the applicant's Woo request dated June 5, 2023;
- not to disclose information in response to the Woo request.
7. Answering written questions CDA group Good Landlord Act - Jelle de Jong
Written questions were submitted on behalf of the CDA Group on May 24 regarding the Good Landlord Act.
Specifically, these questions are as follows:
- Is our municipality aware of abuses in the local rental market, and if so how common and/or how widespread are these abuses?
- there are 3 tools for municipalities. Can you indicate whether we can deploy all three as early as next July 1 and if not when we will be ready to do so?
- Municipal hotline (mandatory)
- Enforcement of general rules (mandatory)
- Rental permit regular and migrant workers (optional)
Your college is proposed to adopt the (draft) response.
The College decides to adopt the (draft) answers to the incoming written questions of the CDA Group on the Good Landlord Act.
8. May circular letter 2023 - Jan Boersma
The May Circular was published on May 31, 2023, and the financial implications are detailed in this memo. Due to errors in the national calculations and additional research work, it took longer than anticipated to present a complete picture in the short term. As a result, this memo on the May circular letter is later than usual. With this memo we inform the council about the financial consequences and how they will be processed in the multi-year budget 2024-2027. The consequences for 2023 will be included in the second administrative report 2023.
The college takes note of the memo May Circular 2023 and agrees to offer this memo to the council as an appendix to the 2024-2027 framework memo.
9. New indexing methodology 10vdJ - Steven Grevink
As part of the Youth Reform Agenda, national contract standards have been developed to reduce the administrative burden. One of these aspects concerns indexing. The proposal is to use the indexation in the national contract standards for the Youth Care contracts within A 10 for Youth. With this we follow the developments of the Youth Reform Agenda and offer a clear and uniform indexation to the youth aid providers. For 2024, the indexation rate is set at 6.43%.
College Decision:
- Adjust the indexing provision within A 10 for Youth in accordance with national contract standards effective 1-1-2024 and adjust the indexing provision in the agreement accordingly;
- not make interim adjustments in the future due to amended collective bargaining agreement provisions, as these are reflected in subsequent annual OVA indexation which is an important basis for indexation;
- For Youth Aid contracts, set the indexing rate at 6.43% for 2024.
10. Pilot indication-free day care Archipel - Steven Grevink
The Archipel foundation has developed a plan for offering indication-free day care for the elderly in the Dommelhuis in the form of a general facility. For the coming period of 1 year a subsidy will be made available for this pilot. Within this period, the pilot will be evaluated and decisions on the continuation will be made.
The college decides:
- To make a grant available for a period from July 1, 2023, to July 1, 2024, for the general facility day care pilot;
- evaluate the pilot in the 1st quarter in 2024.
