1. Annual Report 2019/2020 including the 2021 annual plan of the Son en Breugel Audit Committee / Hans Gaillard

The Municipalities Act stipulates that the Audit Committee must draw up an annual report on the activities carried out in the previous year. The Audit Committee also draws up an annual plan indicating which topics are eligible for investigation in the current year and which activities the Audit Committee expects to carry out. On January 15, the Audit Committee presented its 2019/2020 annual report, including the 2021 annual plan, to the council.

The council takes note of the 2019/2020 annual report, including the 2021 annual plan of the Son en Breugel Audit Committee.

2. Regional Development Fund for Work Locations: settlement agreement / Jan Boersma

A settlement agreement must be concluded before the Brabant Development Agency (BOM) can withdraw. The actual withdrawal will take place through a share transfer. The settlement agreement will set out the terms for ending the cooperation agreement with BOM. Because the individual municipalities are parties to the cooperation agreement, they must also give their consent. They will sign the settlement agreement that regulates the termination of the cooperation agreement. In the earlier council proposal on the ROW dated December 15, 2020, the portfolio holder for Economy was given a mandate to terminate the current cooperation agreement with BOM, not to sign the present settlement agreement. In order to settle this matter, the settlement agreement will be submitted separately to the councils in the Eindhoven Urban Area.

The council decides to enter into a settlement agreement in which BOM Holding BV, ROW BV, and municipalities make mutual agreements regarding the withdrawal of BOM Holding B.V.
The mayor grants the portfolio holder for Economic Affairs power of attorney to sign the settlement agreement on behalf of the municipality of Son en Breugel once all municipalities have adopted the new cooperation agreement.

3. Guidance on European tendering for household waste collection / Paul van Liempd

A new contract for household waste collection must be in place by January 1, 2022. The municipality is currently going through a process to join the Blink joint arrangement. It is still unclear whether the council will approve this on March 18, 2021. That is why preparations for the European tender are already underway, so that there is enough time to complete the process.

The council decides to award United Quality the contract (worth €28,779 excluding VAT) for substantive support in the European tender for the collection of household waste as of January 1, 2022.

4. Implementation monitor for young people in vulnerable positions (JIKP) / Jos de Bruin

Since 2019, municipalities have been responsible for monitoring the participation in education or work of young people under the age of 23 who are in a vulnerable position. In order to carry out this task, it may be necessary to exchange data between municipalities, educational institutions, and employers. Agreements were made about this in 2019. These agreements have been amended and supplemented in minor respects.

The council decides:
1. to approve the mandate issued on October 28, 2020, by the Administrative Committee of the Municipal Health Service (GGD);
2. to adopt the agreement "Joint responsibilities of parties in the processing of personal data";
3. to adopt the amendment decision accompanying the JIKP covenant;
4. to take note of the Service Agreement between the GGD and the municipality of Eindhoven.

The mayor decides:
1. to assign the signing of the agreement "Joint responsibilities of parties in the processing of personal data" to Alderman de Bruin;
2. to assign the signing of the amendment decision accompanying the JIKP covenant to Alderman de Bruin.

5. Adoption of the list of non-public decisions and the list of public decisions dated January 19, 2021 / Hans Gaillard

The college adopts the decision lists.

6. Village Hall Contract / Jan Boersma

The development of the new Village Hall has reached the stage where we want to agree on the final construction contract with Stam de Koning. Stam de Koning's offer is within the agreed budget framework.

The council decides:
1. the council decides to approve the construction contract with the firm Stam de Koning;
2. to approve the mandate arrangement for this project.

7. Recommendations of the Joint Committee on Civil Affairs and Land Affairs January 19, 2021 / Hans Gaillard

On January 19, the joint committee on Civil Affairs and Land Affairs met. The council is informed about the recommendations made by this committee.

The council takes note of the recommendations of the joint Civil Affairs and Land Affairs Committee of January 19, 2021.


Over the past year and a half, research has been conducted into how vulnerability in the area of waste policy can be reduced. Joining the GR Blink is a high-quality option that meets the preconditions set by the municipal executive.

The council decides to:
1. propose to the municipal council that it submit a formal request to join the Reiniging Blink joint arrangement;
2. allow the municipal council to choose between two scenarios in terms of service level/collection frequencies with the associated financial consequences, with the council expressing a preference for scenario 2 (lowest costs, average service level by adjusting the frequency of organic waste and PMD collection);
3. to provide the financial appendix and the Blink bid book to the municipal council on a confidential/non-public basis.



9. Response to draft RES 1.0 / Paul van Liempd

On September 1, 2020, the council adopted the draft RES and the response to the MRE. The decision-making procedure for RES 1.0 will start in April. The decision-making process does not allow for the RES to be adopted with amendments. The council therefore wants to consult with the Land Affairs Committee on February 22, 2021, to gather the latest input.

The council decides to:
1. inform the Land Affairs Committee about the follow-up to the Land Affairs Committee's response to the draft RES and the presentation on large-scale energy generation in rural areas;
2. give the Land Affairs Committee a 'final' response to be included in the MRE RES for the RES.
