1. Annual report 2019/2020 including annual plan 2021 of the Son and Breugel Audit Commission / Hans Gaillard
The Municipal Law requires the Court of Auditors to prepare an annual report of the activities performed for the previous year. The Court of Auditors Commission also prepares an annual plan outlining the topics for investigation in the current year and the activities the Court of Auditors Commission expects to perform. On January 15, the Court of Auditors Commission presented its 2019/2020 annual report including the 2021 annual plan to the council.
The college takes note of the 2019/2020 annual report including the 2021 annual plan of the Son and Breugel Audit Commission.
2. Regional Development Fund Work Locations: settlement agreement / Jan Boersma
The exit of the Brabantse Ontwikkelings Maatschappij (BOM) requires the conclusion of a settlement agreement. The actual exit takes place through a share transfer. The settlement agreement establishes agreements on the termination of the cooperation agreement with BOM. Since the individual municipalities are parties to the cooperation agreement, these individual municipalities must also agree. They sign the settlement agreement governing the termination of the cooperation agreement. In the previous college proposal on the ROW dated December 15, 2020, the Economy portfolio holder was mandated, among other things, to terminate the current cooperation agreement with BOM, not to sign the present settlement agreement. In order to settle this now, the settlement agreement is submitted separately to the colleges in the Eindhoven Urban Area.
The college decides to enter into a settlement agreement in which BOM Holding B.V., ROW B.V. and municipalities mutually agree on the exit of BOM Holding B.V..
The mayor authorizes the portfolio holder Economy to sign the settlement agreement on behalf of the municipality of Son and Breugel at the time that all municipalities have adopted the new cooperation agreement.
3. Supervising European tender for household waste collection / Paul van Liempd
A new contract for household waste collection must be in place by January 1, 2022. The municipality is currently going through a process to join the Blink joint arrangement. It is still unclear whether the council will approve this on March 18, 2021. Therefore, preparations for the European tender are already underway to allow sufficient time to complete the process.
The college decides to award United Quality the contract (worth €28,779, excluding VAT) for substantive guidance in the European tender for household waste collection from January 1, 2022.
4. Implementation monitor youth in vulnerable position (JIKP) / Jos de Bruin
Since 2019, municipalities are responsible for monitoring the participation in education or work of young people under 23 in a vulnerable position. The performance of this task may require the exchange of data between municipalities, educational institutions and work companies. Agreements were made about this in 2019. These agreements have been modified and supplemented in small parts.
The College decides:
1. agree to the issued mandate dated October 28, 2020 from the GGD Executive Committee;
2. to adopt the agreement "Joint responsibilities parties in processing personal data";
3. to adopt the amendment decision associated with the covenant JIKP;
4. to take note of the Service Agreement between the GGD and the Municipality of Eindhoven.
The Mayor decides:
1. to entrust to Alderman Jos de Bruin the signature of the agreement "Joint responsibilities parties in processing personal data";
2. to entrust to Alderman Jos de Bruin the signature of the amendment decision belonging to the covenant JIKP.
5. Adoption of non-public decision list and public decision list dated January 19, 2021 / Hans Gaillard
The college adopts the decision lists.
6. Adoption agreement Village Hall / Jan Boersma
The development of the new Village Hall has reached the stage where we want to agree the final contracting agreement regarding the realization with Stam de Koning. Stam de Koning's offer is within the agreed framework budget.
The College decides:
1. the College decides to adopt the contracting agreement with the firm Stam de Koning;
2. to adopt the terms of reference for this project.
7. Opinions combined Civil and Territory Affairs Committee Jan. 19, 2021 / Hans Gaillard
On Jan. 19, the combined Civil and Territory Affairs Committee met. The college is informed of the opinions given by this committee.
The college takes note of the opinions of the combined Civil and Territory Affairs Committee of January 19, 2021.
8. Joining Joint Arrangement Blink / Paul van Liempd
Over the past year and a half, a study has been conducted on how to reduce vulnerability in the area of waste policy. Joining the GR Blink is a qualitatively strong option that meets the preconditions set by the college.
The College decides to:
1. propose to the municipal council to make a formal request for accession to the joint arrangement Reiniging Blink;
2. allow the city council to choose from two scenarios in the field of service level / collection frequencies with the associated financial consequences, whereby the college expresses a preference for scenario 2 (lowest costs, average service level by adapting the frequency of VGF and PMD);
3. provide the financial annex and the bid book Blink confidentially / not publicly to the city council.
9. Response to draft RES 1.0 / Paul van Liempd
On September 1, 2020, the college adopted the draft RES and the response towards the MRE. Starting in April, the decision-making process for the RES 1.0 will begin. In the decision-making process there is no room to adopt the RES with amendment. Therefore, the college would like to meet with the Land Use Committee on February 22, 2021 to gather final input.
The college decides to:
1. inform the Territory Affairs Committee of the follow-up to the adopted response of the Territory Affairs Committee to the draft RES and the presentation on large-scale generation in the outlying area;
2. provide the Territory Affairs Committee with a 'final' response to take to the MRE RES for the RES.
