3. Service Agreement ODZOB 2025
On November 21, 2024, the Executive Board (DB) decided to enter into the new DVO for an indefinite period of time and to terminate the addendum belonging to the DVO 2019-2022 as of March 1, 2025. For this purpose, a new joint agreement framework between principals (being the participants) and the contractor (being ODZOB) for the performance of tasks and services has been developed.

The college decides:

  1. To enter into the service provision Omgevingsdienst Zuidoost-Brabant, with the general Requirements of ODZOB applicable thereto,
    as of March 1, 2025 for an indefinite period of time;
  2. To terminate the Addendum associated with the DVO 2019-2022, which has a term until July 1, 2025 as of the same date;
  3. To validly sign the DVO 2025 on behalf of the municipality.

4. Decision on objection granted environmental permit renovation house

On Feb. 13, 2024, the college decides to grant an environmental permit for the renovation of a house. On March 25, 2024, the college receives a notice of objection from several local residents against the above decision. The Objections Committee recommends that the objection for non-interested parties be declared inadmissible. The objection committee recommends that the objection for interested parties be declared unfounded and that the contested decision be amended as a result of an amendment to the application submitted by the applicant.

The college decides:

  1. Declare the objection inadmissible for non-interested parties;
  2. Declare the objection for interested parties unfounded;
  3. Amend the contested decision now that the balcony component initially authorized has been permanently voided as a result of an amendment to the application submitted by the applicant;
  4. Refer to the opinion of the Objections Committee for the reasons for the decision.

5. Housing Ordinance Municipality of Son and Breugel 2025 - 2029.

The municipalities in the Eindhoven Urban Area (SGE) have had a joint urgency regulation since 2016, which is part of our Housing Ordinance. At the end of 2023, the councils of the SGE municipalities adopted a new Housing Ordinance 2024-2027, as the current housing ordinances expired by operation of law. In terms of content, this new ordinance was unchanged. The Housing Ordinance Municipality of Son and Breugel 2025-2029 was drafted together with other SGE municipalities with substantive adjustments and uniform.

The college decides:

  1. To submit to the City Council for adoption the council proposal Housing Ordinance Municipality of Son and Breugel 2025-2029;
  2. To adopt the Terms of Reference for the Implementation of the Housing Ordinance of the Municipality of Son en Breugel and the associated list of mandates;
  3. To adopt the Rules of Procedure Urgency Committee Urban Area Eindhoven 2025-2029.

6. Breugel Bruist

Council information letter on progress project "Breugel Bruist!"

The college decides to adopt the council information letter "Progress Breugel Bruist!" and to send it to the city council with the next RIB on February 28, 2025.

7. Preventive and corrective maintenance of pumping stations and peripheral facilities.

The municipality has several legal duties of care regarding the treatment of wastewater, stormwater and groundwater. These responsibilities are set out in the Water and Sewerage Program 2023-2027 (hereinafter referred to as PWR). An essential part of the PWR is ensuring an effective and reliable sewerage system, including through preventive and corrective maintenance of the pumps, pumping stations and peripheral facilities.

The college decides:

  1. To adopt the procurement strategy maintenance pumps, pumping stations and peripheral facilities;
  2. To mandate the City Clerk and the Manager of Space to further carry out the procurement process, including adoption of the award decision and the framework agreement;
  3. Request the Mayor to assign the signature of the Framework Agreement to the City Clerk.

8. Decision on objection rejection of pupil transport application.

On September 16, 2024, the college decides to reject an application for pupil transportation. On October 17, 2024, the college receives a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.

The college decides:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

9. Political Evening Feb. 27, 2025

The college notes the program of the February 27 Political Evening and offers the List of Commitments and the List of Outstanding Motions to the council.

The college decides:

  1. To take note of the Political Evening program for February 27, 2025;
  2. To offer the list of commitments dated January 30, 2025 to the council;
  3. Present the February 2025 list of open motions to the council.

10. Dommelvallei Service - Joint Arrangement.

To strengthen the Dommelvallei Service (DDV), the General Board of the DDV has decided to convert the public body into a business operation organization. To this end, the DDV regulation must be amended. The college has agreed to the amended arrangement subject to council approval. It was also decided to seek council approval by submitting a council proposal to the council for decision.

The college decided:

  1. To agree to the establishment of a Joint Arrangement for the Dommelvallei Service Operating Organization, subject to the approval of the council;
  2. To submit the council proposal to convert the Dommelvallei Service into a business management organization (consent of college) to the council for decision.

11. Public housing program municipality of Son and Breugel; Building communities.

The 'Public Housing Program municipality of Son en Breugel; Building communities' is one of the elaboration programs from the 'Environmental Vision Son en Breugel; OOg to a bright future.' The college is asked to submit this new 'Public housing program municipality of Son en Breugel; 'Building on communities' to the council for adoption. This public housing program thus provides - both qualitatively and quantitatively - direction for the coming years. Further elaboration will take place in an implementation agenda/program and in flanking policy.

The college decides to propose to the council to adopt the 'Public Housing Program Municipality of Son en Breugel; Building on Communities' (version January 30, 2025).

12. Credit for new building Braecklant/health center.

The college proposes to the council to make a total credit available of € 5,030,000 for the realization of new construction of community center Braecklant in combination with a health center. For the health center, a rental agreement will be entered into with Huisartsenpraktijk Rijnlaan. The income from this will cover the additional investment costs for the health center part.

The College decides to propose to the City Council:

  1. To make available the investment credit for the development and realization of the Braecklant program included in the 2025-2028 Multi-Year Budget;
  2. To make a credit available for the development and realization of the program of Huisartsenpraktijk Rijnlaan of approximately 509 m2 gvo and to start working on the Preliminary Design, with the coverage of the additional capital costs being formed by rental income from Huisartsenpraktijk Rijnlaan;
  3. Provide a preparation appropriation within the total required appropriation;
  4. To lift the secrecy of the documents mentioned in 2 a through 2c on the date that both the lease agreement is signed and the building tender is completed; 
  5. incorporate the financial implications in this council proposal through the 2025 budget amendment and include them in the 2026-2029 multi-year budget;
  6. Pursuant to article 87 of the Municipal Law and article 5.1, first and second paragraphs, of the Open Government Act, to impose an obligation of secrecy on:
    a. Foundation costs Braecklant
    b. Rent calculation Braecklant
    c. Memo finances Braecklant
  7. provide the classified information to the City Council.

13. Written questions VVD and Village Vision: moving CMD

The VVD and Village Vision groups have asked council questions about the timeline of the CMD relocation. A letter answers these questions.

The college decides to adopt the response letter to the council.
