1. List of non-public and public decisions by the Municipality of Son en Breugel dated February 16, 2021 / Hans Gaillard

The college adopts the decision lists.

2. Multi-year plan Strong Together in Brabant / Hans Gaillard

The green partnership Samen Sterk in Brabant (SSiB) was established in 2008. It is now firmly anchored in the province. With the 2021-2023 multi-year plan, they are moving toward a greener, cleaner, and safer future. The priorities are waste, poaching, and illegal off-road driving. SSiB is represented in the rural area surveillance network for the municipalities of Nuenen and Son en Breugel, under the direction of Son en Breugel surveillance and enforcement.

College Decision:

  1. to take note of the 2021–2023 program of Samen Sterk in Brabant (Strong Together in Brabant);
  2. to approve the text of the RIB in order to inform the council about this.

3. Development site 'Ruysdaelstraat 2'; response to letter from housing association 'thuis' dated January 29, 2021 / John Frenken

In 2020, development of the Ruysdaelstraat 2 site commenced. The 'thuis' housing association was asked to draw up an urban development plan in collaboration with the municipality, based on the established 'preconditions and principles'. A first draft plan was discussed in November 2020 and a response was provided on January 11, 2021. The first draft plan did not meet the 'preconditions and principles'. In its letter of January 29, 2021, the 'thuis housing association asked for a response to a number of substantive issues. The questions from the 'thuis housing association are answered in this advice. After consultation with Woonstichting 'thuis, Stg. Doorpakken Wonen considers the first draft plan to be a given. This is in view of the invitation sent by the foundation to prospective residents, parents, and members of the municipal council to attend an information evening on March 25, 2021, to discuss this matter. It is recommended that Stg. Doorpakken Wonen be consulted as soon as possible in order to keep expectations regarding the planning for the Ruysdaelstraat location on track.

College Decision:

  1. to request advice from the Land Affairs Committee on the details of the desired housing program at the development site 'Ruysdaelstraat 2' by March 1, 2021, at the latest;
  2. As a first step, please find enclosed our response to the questions posed by the Woonstichting 'thuis housing association in its letter dated January 29, 2021.
  3. to take a final decision, with the advice of the Land Affairs Council Committee, in response to the questions raised by the 'thuis' Housing Association;
  4. with Woonstichting ‘thuis’ in the administrative consultation of February 24, 2021, but no later than March 24, 2021, to enter into (follow-up) discussions about the method of communication and course of action regarding the development location ‘Ruysdaelstraat 2’;
  5. with St. Doorpakken Wonen, based on this decision, to enter into discussions as soon as possible, but no later than March 24, 2021, to further clarify the expectations for the Ruysdaelstraat 2 development site.

4. Implementation of the 'Son en Breugel Housing Regulation 2020-2023': 'tenant at the helm' / John Frenken

On December 19, 2019, the municipal council adopted the "Son en Breugel Housing Regulation 2020-2023," specifically for the urgency component. This regulation came into effect on January 1, 2020. The other municipalities in the Eindhoven Urban Area (SGE) have adopted the same Housing Regulation. This means that a uniform urgency scheme is in force throughout the SGE. An important change in these Housing Regulations 2020-2023 compared to the previous regulations from 2016 is that urgent house hunters are given the opportunity to respond to housing offers themselves, putting the 'tenant in the driver's seat'. The Housing Regulation leaves it up to the municipal executive to determine when this element, as included in Article 6, paragraph 9 of the regulation, will take effect (see Article 16 of the regulation). In the SGE context, it has been agreed to submit this to all nine councils of the SGE municipalities concerned in a uniform manner. This proposal aims to bring Article 6, paragraph 9 of the 'Son en Breugel Housing Regulation 2020-2023' into effect.

College Decision:

  1. take note of the impact of the aspect 'tenant in control';
  2. that Article 6, paragraph 9 of the ‘Son en Breugel Housing Regulation 2020-2023’ will enter into force on March 1, 2021.

5. Business park development day February 24, 2021 / Jan Boersma

A Development Day is organized twice a year for each region in North Brabant. During a Development Day, agreements are made between the municipalities, the province, and the water boards. These agreements may have legal consequences, for example for zoning plans (yet to be developed). The programming of the business parks was postponed again during the Southeast Brabant Development Day on December 17, 2020; the topic had already been on the agenda for December 19, 2019, and June 21, 2020. Because further postponement is not an option, it has been decided to organize an additional, separate Development Day for the business parks. The relevant documents will be submitted to the council.

The council takes note of the agenda and documents for the extra Business Park Development Day on February 24, 2021.

6. 2021 Budget PlatOO / Jos de Bruin

In accordance with its articles of association, the PlatOO school board has submitted the 2021 budget to the municipality for consultation. It is proposed that the council take note of this.

College Decision:

  1. takes note of PlatOO's 2021 budget and sees no reason for further consultation;
  2. to approve the text for the council information letter and include it in the next edition.

7. Request for exemption from opening hours for Albert Heijn April 2, 2021 / Jan Boersma

Albert Heijn in Son en Breugel has requested an exemption from the opening hours on Good Friday, April 2, 2021. The Shop Hours Ordinance specifies when the municipal executive is authorized to grant exemptions from the opening hours. The Shop Hours Regulation does not apply to Good Friday. This means that the municipal executive cannot grant an exemption for extended opening hours on Good Friday.

The council decides not to grant an exemption for extending the opening hours of the Albert Heijn supermarket in Son en Breugel on April 2, 2021 (Good Friday).

8. Application for the Bombing Compensation Scheme / John Frenken

In 2019, during excavation work for the construction of a new distribution center at Ekkersrijt 3102, the company Cordeel stumbled upon a phosphorus grenade. On the advice of the EOD (Explosive Ordnance Disposal), an explosives investigation was carried out at the time. The municipality is being asked to make use of the 'Bomb Regulation', whereby 70% of the costs incurred can be reclaimed from the Ministry of the Interior.

College Decision:

  1. not to cooperate with Cordeel's request to make use of the Bombing Compensation Scheme;
  2. Inform Cordeel of this by letter.

8. Sale of land Prodrive Science Park 5055 5057 / Jan Boersma

Prodrive has applied for an environmental permit for the construction of new business premises at Science Park 5055/5057. Prodrive has requested to purchase approximately 159 m² from the municipality for the construction of these new premises. The land will actually be purchased by J.V. Beheer B.V.

College Decision:

  1. to sell a 159 m² portion of a plot of land known in the land registry as Son en Breugel, Section B number 2553, to J.V. Beheer B.V. for a land price of €216.50 per m² for the construction of new commercial premises;
  2. to approve the draft purchase and sale agreement as presented.

9. Cooperation agreement Climate Portal Southeast Brabant 2021-2027 / Jan Boersma

On December 31, 2020, the Water Portal Southeast Brabant cooperation agreement expired. The regional cooperation has led to cost savings, development, and exchange of knowledge, capacity, and services in the field of urban water management. One example is a joint project with the Dommel Water Authority to monitor the overflow frequency of peripheral facilities. During the term of the agreement, the focus of the network organization broadened from the efficient management of the wastewater chain to the entire water chain and the urban water system. The network organization intends to continue the collaboration by concluding a new, broader cooperation agreement: Climate Portal Southeast Brabant 2021–2027.

College Decision:

  1. to enter into the Cooperation Agreement Climate Portal Southeast Brabant 2021–2027 in accordance with the attached contract;
  2. to approve the activities specified in the 2021 Annual Plan and the associated personnel deployment;
  3. to approve the project costs required to implement the 2021 Annual Plan, amounting to €14,067. Sufficient funds have been estimated in the budget for the contribution to the climate portal.

The mayor entrusts the signing of this agreement to Alderman .

10. Policy rules TONK Son en Breugel / Paul van Liempd

The government has instructed municipalities to offer temporary income support measures to residents in connection with the coronavirus crisis. The Temporary Support for Necessary Costs (Tonk) scheme is intended to provide a contribution towards housing costs in the first half of 2021. The municipality has established policy rules for this purpose, which form part of the Special Assistance Policy.

College Decision:

  1. to adopt the policy rules Temporary support for necessary costs Tonk Son en Breugel 2021;
  2. to use government funds for Tonk to implement the scheme;
  3. to approve the council information text for the next council information letter.

11. Ruling by the Council of State regarding Camtronics B.V. / John Frenken

The council takes note of the ruling by the Council of State in Camtronics' appeal against the environmental permit granted by the council for the establishment of the thrift store. Ruling: appeal is unfounded and the municipality is upheld.
