The college adopts the decision lists.

2. Multi-year plan Samen Sterk in Brabant / Hans Gaillard

The green partnership Samen Sterk in Brabant (SSiB) was established in 2008. It is now firmly established in the Province. With the 2021-2023 multi-year plan, they are heading into the future greener, cleaner and safer. The focal points are litter, poaching and wildlife corridors. SSiB is represented in the network supervision outside area for the municipalities of Nuenen and Son and Breugel, under the direction of supervision and enforcement Son and Breugel.

College Decision:

  1. To take note of the 2021 - 2023 program of Samen Sterk in Brabant;
  2. To agree to the text of the RIB to inform the council accordingly.

3. Development site 'Ruysdaelstraat 2'; response to letter Woonstichting 'thuis dated January 29, 2021 / John Frenken

The development of the 'Ruysdaelstraat 2' site began in 2020. Woonstichting 'thuis has been asked to come up with an urban development plan based on the established 'preconditions and principles' in cooperation with the municipality. A 1st plan outline was discussed in November 2020 and responded to on January 11, 2021. The 1st plan outline did not meet the 'preconditions and principles'. In the letter of January 29, 2021, Woonstichting 'thuis requests a response to a number of substantive issues. The questions of Woonstichting 'thuis are answered in this opinion. Stg. Doorpakken Wonen considers, after consultation with Woonstichting 'thuis, the 1st plan outline as a given. This in view of the invitation that the foundation has addressed to prospective residents, parents and members of the city council, to attend an information evening on March 25, 2021 about this. It is recommended to enter into discussions with Stg. Doorpakken Wonen a.s.a.p. in order to keep the expectations about the plan formation for the Ruysdaelstraat location on the right track.

College Decision:

  1. On the detailing of the desired housing program at the 'Ruysdaelstraat 2' development site, to seek the advice of the council's Land Affairs Committee by March 01, 2021;
  2. As a 1st step, preliminarily adopt the attached response to the questions of Woonstichting 'thuis from the letter of January 29, 2021;
  3. with the advice of the council's Land Use Committee to make a final decision in response to the questions of Housing Foundation 'home;
  4. To enter into (follow-up) discussions with Woonstichting 'thuis in the administrative meeting of February 24, 2021, however, no later than March 24, 2021, regarding the method of communication and course of action regarding the 'Ruysdaelstraat 2' development site;
  5. to enter into discussions with St. Doorpakken Wonen on the basis of this decision as soon as possible, but no later than March 24, 2021, to further explain the expectations for the Ruysdaelstraat 2 development site.

4. Elaboration 'Housing ordinance Son en Breugel 2020-2023': 'tenant at the helm' / John Frenken

On December 19, 2019, the City Council adopted the "Son en Breugel Housing Ordinance 2020-2023" specifically for the urgency section. This ordinance entered into force on January 1, 2020. The other municipalities of the Stedelijk Gebied Eindhoven (SGE) have adopted the same Housing Ordinance. As a result, a uniform urgency regulation is in force throughout the SGE. An important change in this Housing Ordinance 2020-2023 compared to the previous ordinance from 2016 is that urgent housing seekers are given the opportunity to respond to the housing offer themselves, thus putting the "tenant in charge". The Housing Ordinance left it up to the college to determine when this element, as included in Article 6 paragraph 9 of the ordinance, will take effect (see Article 16 of the ordinance). It has been agreed in the SGE context to now submit this to all nine colleges of the SGE municipalities involved in a uniform manner. The purpose of this proposal is to bring Article 6, paragraph 9 of the 'Housing Ordinance Son and Breugel 2020- 2023' into force.

College Decision:

  1. To take note of the elaboration of the aspect of "tenant themselves at the helm";
  2. That Article 6, paragraph 9 of the "Son en Breugel Housing Ordinance 2020-2023" shall enter into force on March 1, 2021.

5. Business park development day Feb. 24, 2021 / Jan Boersma

A Development Day is organized twice a year for each region in North Brabant. During a Development Day, agreements are made between the municipalities, the province and the water boards. These agreements may have legal consequences, for example for zoning plans (yet to be developed). The programming of business parks was again postponed during the Southeast Brabant Development Day on December 17, 2020, the subject was also already on the agenda for December 19, 2019 and for June 21, 2020. Since further postponement is not an option, it was decided to organize an additional, separate Development Day for the business parks. The documents for this are hereby submitted to the college.

The college notes the agenda and documents for the additional Business Park Development Day on February 24, 2021.

6. Budget 2021 PlatOO / Jos de Bruin

School Board PlatOO, in accordance with its bylaws, has submitted the 2021 budget to the municipality for consultation. It is proposed that the college take note of this.

College Decision:

  1. take note of PlatOO's 2021 budget and sees no need for further consultation;
  2. Agree to the text for the council information letter and include it in the next edition.

7. Request waiver of Albert Heijn opening hours April 2, 2021 / Jan Boersma

Albert Heijn in Son en Breugel has requested exemption from opening hours on Good Friday dated April 2, 2021. The Shopping Hours Ordinance states when the college is authorized to grant dispensation from opening hours. The Shopping Hours Ordinance does not apply to Good Friday. This means that the college cannot grant dispensation to extend opening hours on Good Friday.

The college decides not to grant an exemption to extend the opening hours of the Albert Heijn in Son en Breugel on April 2, 2021 (Good Friday).

8. Application Cordeel Bomb Scheme / John Frenken

In 2019, the company Cordeel encountered a phosphorus grenade during excavation work for the new construction of a distribution center at Ekkersrijt 3102. On the advice of the EOD, an explosives survey was conducted at the time. The municipality is asked to make use of the "Bomb Scheme" whereby 70% of the costs incurred can be reclaimed through the Ministry of the Interior.

College Decision:

  1. Not to cooperate with Cordeel's request to use the Bombing Rule;
  2. Inform Cordeel of this by letter.

8. Sale of land Prodrive Sciencepark 5055 5057 / Jan Boersma

Prodrive has applied for an environmental permit to construct a new commercial building at Sciencepark 5055 / 5057. For the realization of this new building, Prodrive has requested to purchase approximately 159 m2 from the municipality. The land will actually be purchased by J.V. Beheer B.V.

College Decision:

  1. To sell a partial plot of land in the amount of 159m2 of a plot known cadastrally as Son en Breugel, Sectie B number 2553 to J.V. Beheer B.V. for a land price of €216.50 p/m2 for the realization of a new business premises;
  2. To agree to the draft purchase and sale agreement as submitted.

9. Cooperation agreement Climate Portal Southeast Brabant 2021-2027 / Jan Boersma

On December 31, 2020, the cooperation agreement Waterportaal Zuidoost Brabant will expire. Regional cooperation has led to cost savings, development and exchange of knowledge, capacity and services in the field of urban water management. For example, a joint project with Waterschap de Dommel to monitor the overflow frequency of peripheral facilities. The focus of the network organization has broadened during the term of the agreement from solely efficient management of the waste water chain to the entire water chain and urban water system. The network organization intends to continue the cooperation by concluding a new broader cooperation agreement: Climate Portal Southeast Brabant 2021 - 2027.

College Decision:

  1. Enter into the agreement Cooperation Agreement Climate Portal Southeast Brabant 2021 - 2027 in accordance with the attached contract;
  2. Agree to the activities identified in the 2021 Annual Plan and associated staffing;
  3. Agree to the necessary project costs to implement the 2021 Annual Plan, being €14,067. Sufficient funds have been estimated in the budget for the contribution to the climate portal.

The mayor delegates the signing of this agreement to Alderman Boersma.

10. Policy rules TONK Son and Breugel / Paul van Liempd

The State has directed municipalities to provide temporary income support measures to residents due to the corona crisis. The Temporary Support Necessary Costs (Tonk) should provide for a contribution of housing costs in the first half of 2021. The municipality establishes policy rules for this purpose, which are part of the Special Assistance Policy.

College Decision:

  1. To adopt the policy rules Temporary Support Necessary Costs Tonk Son en Breugel 2021;
  2. To use the State funds for Tonk to implement the scheme;
  3. To agree to the council information text for the purpose of the next council information letter.

11. Judgment of the Council of State regarding Camtronics B.V. / John Frenken

The college takes note of the judgment of the Council of State in appeal by Camtronics against the environmental permit granted by the college for establishment of the thrift store. Verdict: appeal unfounded and the municipality upheld.
