1. Internal (not public) decision list and public decision list dated Nov. 15, 2022 - Hans Gaillard

The college adopts the decision lists.

2. Decision on objection recovery decision penalty payment - Hans Gaillard

On June 21, 2022, the college decides to proceed with the recovery of the penalty payments due in response to the imposed penalty payment order for building a structure contrary to a granted environmental permit. On August 1, 2022, the College receives a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.

College Decision:

  • Declare the objection unfounded;
  • uphold the contested decision;
  • Refer to the opinion of the Objections Committee for the reasons for the decision.

3. Program Political Evening Nov. 24, 2022and list of commitments council Nov. 9, 2022 - Hans Gaillard

The college discussed the program format for the November 24, 2022 Political Evening and the list of commitments council November 9, 2022.

4. Addressing issue of access to Jansen BV following ABRS ruling dated 24-8-2022 - Jan Boersma

On August 24, 2022, the Administrative Law Division of the Council of State ruled on the appeals filed (by the Municipality of Best and A. Jansen BV) against the zoning plan "Ekkersrijt; Jansen Kanaaldijk Zuid 24" adopted on March 12, 2020. The Council of State upheld the appeals and annulled the zoning plan "Ekkersrijt; Jansen Kanaaldijk Zuid 24" in its entirety. In doing so, the Council of State ordered us to make a new decision within 52 weeks, taking into account what was considered in the ruling. It is proposed to hire external expertise for this assignment.

The college decides:

  • To request Bureau Kragten to bid for the provision of an expert project manager and other necessary expertise to fulfill the order of the Administrative Law Division of the Council of State regarding the opening up of Jansen BV;
  • if Bureau Kragten does not have capacity available, solicit bids for this work from three other consulting firms with similar profiles.

5. Administrative agreements Protected Housing 2023 - Steven Grevink

Municipalities are responsible for Social Care and Protected Housing (Wmo 2015). Region Eindhoven (15 municipalities) is working on the national decentralization of Protected Housing. The national changes in the working method around Protected Housing will not take effect on 1-1-2023, but only a later date. In that context, it is necessary to extend the current administrative agreements. The College extends the current administrative agreements and the mandate to the Mayor of Eindhoven for the deployment of Protected Housing until 1-1-2024. In this way, Protected Housing will continue to be readily available for those who need it in 2023.

College Decision:

  • To agree to the extension of the updated Administrative Agreements Protected Housing until January 1, 2024;
  • To agree to the extension and adjustment of associated mandate for Protected Housing and Reception to the Municipality of Eindhoven, in accordance with the draft Municipal Gazette.

6. Ambition level Open Government Act - Hans Gaillard

For the implementation of the Open Government Act (Woo), it is important to determine at the front end the level of ambition with regard to active disclosure. This is because the strategy for implementing this part of the Woo depends on this level of ambition. 

College Decision:

  • To establish ambition level basis for the implementation of the Open Government Act, as described in the ambition document;
  • To actively inform the council through a council information letter.

7. Administrative planning - Hans Gaillard

The administrative schedule lists the topics that will appear on the City Council's agenda at some point. The discussion of the administrative schedule is a regular part of the agenda of the Presidium. In the version presented now, the topics from the college program have been added, therefore it is desirable that the college agrees to forward it to the council this time.

The College decides to agree to forward the draft administrative schedule to the City Council.

8. Grondexploitatie Centrum Son - Jan Boersma

The City Council is proposed to adopt the land exploitation for the Center of Son. The ground exploitation for the center of Son was discussed in an image-forming meeting on October 6, 2022. Subsequently, the amended council proposal was discussed judgementally on November 10. As a result of the opinion-forming meeting, the council proposal was amended. Hence, your college is again asked to agree to the amended council proposal.

The college decides to agree with the council proposal and the land exploitation for the center of Son.
