The college adopts the decision lists.

2. Decision on objection to building permit / John Frenken

On May 3, 2021, the college decides to grant an environmental permit to erect an outbuilding. On June 14, 2021, the college receives a notice of objection from the objector to the above decision. The notice of objection lacks the grounds of objection. The objector was given the opportunity to submit the grounds of objection. To date, the College has not received the grounds of objection. The Objections Committee recommends that the objection be declared inadmissible.

College Decision:

  1. Declare the objection inadmissible;
  2. Refer to the opinion of the Objections Committee for the reasons for the decision.

3. Council proposal to adopt zoning plan "Buitengebied; Van den Elsenstraat ong." / John Frenken

On May 4, 2021, the college decided to give its final cooperation to the amendment of the zoning at Van den Elsenstraat ongenummerd (next to 54) for the realization of a dwelling via Ruimte voor Ruimte, by releasing the draft zoning plan for public inspection and signing the anterior agreement. For the realization of the dwelling, the required draft zoning plan was prepared and released for public inspection for the period of views (May 13, 2021 through June 23, 2021). The draft zoning plan was also submitted to, among others, the province of North Brabant (no response) and Waterschap de Dommel (agreement) to give them the opportunity to respond to this draft zoning plan by means of an opinion. The period of views did not produce any further reactions. In conclusion of this process, the zoning plan "Buitengebied; Van den Elsenstraat ong." can be presented to the municipal council for adoption.

College Decision:

  1. To seek the council's opinion on the adoption of the zoning plan "Buitengebied; Van den Elsenstraat ong." in a judgmental meeting. in accordance with the draft council proposal and draft council decision;
  2. To propose that the council decide not to adopt an exploitation plan for zoning plan "Buitengebied; Van den Elsenstraat ong." pursuant to Section 6.12 of the Spatial Planning Act;
  3. To propose to the council that the zoning plan "Buitengebied; Van den Elsenstraat ong." with plan identification "NL.IMRO.0848.BP824BUITENGEBIED-VA01" be adopted without amendment and made available digitally.

4. Modification of letterhead template / Paul van Liempd

The college decides to approve the modification of the letterhead.

5. Request Fort Lawyers / Paul van Liempd

Repeated requests have been made to revoke two public law restrictions relating to the use of a plot of land as a parking site and to have the restrictions removed from the Basic Land Registry (BRK). New circumstances have been presented that justify the request. The restrictions will be revoked and removed from the BRK.

College Decision:

  1. To revoke the orders under penalty of payment to Eazzy Park B.V. and Ovi Service B.V. regarding their use as parking locations for third party cars in accordance with the attached decisions;
  2. To have the restrictions listed under 1. removed from the Basic Registration Cadastre (BRK).

6. Decision Wob request / Hans Gaillard

On July 28, the college received a request under the Public Access Act (Wob) from Platform Keelbos Foundation. Information is requested regarding reports of nuisance at the parking lot on Hoberglaan. In addition, the official opinion issued recommending the reopening of the parking lot is requested. The request has been reviewed under the Wob. Some of the information is already public. The other part of the information can be made public, with the exception of personal data and personal policy opinions.

College Decision:

  1. To issue a decision on the Wob request from Platform Keelbos Foundation dated July 28, 2021;
  2. That the Wob does not cover information that is already in the public domain;
  3. Make public the documents with order numbers 7, 8, 8b and 8c, with the exception of personal data under Article 10(2)(e) of the Wob and personal policy views under Article 11(2) of the Wob.

7. Decision Wob request / Hans Gaillard

On August 9, 2021, the college received a request under the Open Government Act (Wob) from Ons Son en Breugel. The request is for the video recording between the end of session 1 and the council meeting political evening on July 22, 2021. It is assessed that the requested information cannot be disclosed on the basis of article 10 paragraph 2 under e of the Wob (respect for privacy) and article 10 paragraph 2 under g of the Wob (disproportionate favoritism or disadvantage).

College Decision:

  1. Issue a decision on the Wob request from Ons Son en Breugel dated August 9, 2021;
  2. not to make public the video recording between the end of session 1 and the council meeting of the political evening on July 22, 2021.

8. Program Political Evening September 23, 2021 and list of commitments / Hans Gaillard

The college will discuss the documents scheduled for the Sept. 23 political evening.

9. Answering written questions / Hans Gaillard

At the moment, supervision and enforcement are being carried out on the basis of a plan of action aimed primarily at the pollution of the forest area located on the Hoberglaan in Son en Breugel. Secondary supervision and enforcement is aimed at other offenses in the field of vice and in response to signals of prostitution. The council fractions of D66 and PvdA/Groen Links, have submitted written questions about this. Advice to the board is to agree with the answers.

The college decides to agree to answer the written questions on Hoberglaan from the council groups D66 and PvdA and GL.

10. Houtens 11 development site / John Frenken

The college wishes to implement "Frameworks as Heading". The Houtens 11 development site is in the picture for this purpose. Woonveste Projectontwikkeling has made an offer to purchase and develop the land. The college has decided to do so and now an antecedent and sales agreement has been drawn up for the development and sale of the land, which your college must decide to enter into. All agreements associated with the plan development of this location have now been recorded in the draft "Anteriorior and sales agreement development location Houtens 11 in Son en Breugel".

  1. The college decides to adopt the antecedent and sales agreement Ontwikkellocatie Houtens 11 in Son en Breugel dated July 15, 2021 and publish the business content.
  2. The Mayor instructs Alderman J. Frenken to sign the agreement mentioned in 1 above.

11. Application for contribution local corona support fund / Jan Boersma

On March 18, 2021, the City Council unanimously decided to establish a temporary local corona support fund (€200,000) for local customization of acute and distressing situations. Despite a broad package of national generic measures, there are residents and businesses that cannot claim this but have a need for financial support. The applicant is requesting a financial contribution from this fund from the college.

The college decides to provide the applicant with a financial contribution of €10,000 due to the acute and dire financial situation created by covid19 restrictive measures including temporary closure during lockdowns.
