1. Non-public decision list and public decision list dated December 14, 2021 / Hans Gaillard

The college adopts the decision lists.

2. Decision on objection to denial of environmental permit / Hans Gaillard

On June 15, 2021, the college decides to deny the application for an environmental permit to temporarily legalize four erected shelters for a period of five years. On July 22, 2021, the college receives a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld, with additional reasoning.

College Decision:

  • Declare the objection unfounded;
  • uphold the contested decision, supplementing the reasons as reflected in the opinion of the Objections Committee;
  • Reject the request for reimbursement of legal costs;
  • Refer to the opinion of the Objections Committee for the reasons for the decision.

3. Decision Wob request Foundation Platform Keelbos / Hans Gaillard

On December 7, the college received a request under the Open Government Act (Wob) from Platform Keelbos Foundation. Information was requested regarding how nuisance from the gay meeting place (HOP) was monitored. The request has been checked against the Wob. The documents that have come forward are already public. No new documents have emerged that fall within the scope of the Wob request.

College Decision:

  • To issue a decision on the Wob request from Platform Keelbos Foundation dated December 7, 2021;
  • Not to disclose information in response to the Wob request.

(Re)development Boslaan 63 adopt final plan and participation report / John Frenken

On November 22, 2021, the initiator submitted the final plan including the summary of the environmental dialogues held for the (re)development of the location Boslaan 63. It concerns the development of the plot with 12 owner-occupied apartments and one detached house. The final plan elaborates on the 'municipal preferred model', the 'preconditions and principles' set by the municipality, the suggestions made by the members of the council (committee Grondgebiedzaken) and the input from the environmental dialogue has been taken into account. The olSB Steering Committee has determined that the final plan is satisfactory and proposes to your college to approve the final plan, after which the follow-up steps (agreement, draft zoning plan, draft environmental permit) can be taken by the initiator. It is also requested that the council be allowed to apply the coordination scheme for this development site.

College Decision:

  1. adopt the final plan "Boslaan 63" as an elaboration of the 'municipal preferred model' adopted on July 9, 2019, the environmental dialogues conducted and the consultations with the council (territory committee);
  2. draw up the antecedent exploitation agreement with the promoter;
  3. Request the promoter to prepare the draft zoning plan and draft environmental permit;
  4. In preparation for the necessary legal-planning procedure, to propose to the City Council the application of the coordination scheme ex art. 3.30 Wro for the redevelopment of the plan initiative on the parcel Boslaan 63;
  5. Inform the council of this decision via a RIB.

5. Letter county budget 2022 / Jan Boersma

The province informs the city council each year about its findings from financial supervision of the budget. From this supervision, there are no particulars for the 2022 budget. Normal supervision remains in effect for this budget.

The college takes note of the letter from the province dated December 8, 2021 with the subject of budget 2022.

6. Start procedure draft zoning plan Buitengebied, Airboirneweg 51 / Jan Boersma

A draft zoning plan was submitted in October 2021 for the amendment of the Buitengebied zoning plan. This involves changing an intensive livestock farm (poultry farm) to horse farm at the address Airborneweg 51. An anterior agreement has since been concluded with the applicant. For this draft, the Wet ruimtelijke ordening procedure can be started. The first step is publication and making the draft available for inspection.

College Decision:

  • To adopt the draft zoning plan "Buitengebied, Airborneweg 51";
  • To release the draft zoning plan for further adoption procedure in the context of the opportunity for the submission of views.

7. Continued implementation of local corona fund / Jan Boersma

Entrepreneurs, companies and workers continue to face tightened corona measures that limit the room for enterprise. The government therefore announced another economic support package on December 14, 2021. This support package contains a number of well-known generic schemes among others the NOW, TVL and a relaxed Bbz. In addition to these (state) schemes, it is proposed to perpetuate the local corona support fund. This will preserve a local financial safety net and allow for local customization.

The Board decides to continue to implement the motion of the City Council by calling on local entrepreneurs, businesses and residents to apply for individual support when financial (national) schemes do not provide it.

8. Questions Dorpsbelang / Paul van Liempd

The council group Dorpsbelang Son en Breugel has asked a number of questions related to the presentation on November 21 about the CMD business plan and the Dommelhuis. Submitted is the answer to the council questions.

College Decision:

  • To agree to answer the questions of Dorpsbelang Son en Breugel in accordance with the submitted answers;
  • To inform the council group Dorpsbelang Son en Breugel and the city council of the answers to the council questions.

9. Development vision New Heath & Old Lake / Paul van Liempd

Request the council to adopt the New Heath & Old Lake Development Vision and make implementation credit available as per council proposal.

The college decides to present the New Heath & Old Lake Development Vision to the council for adoption and to ask the council for implementation credit in accordance with the council proposal.

10. Program Political Evening and list of commitments December 23, 2021 / Hans Gaillard

The college discusses the documents scheduled for the December 23 political evening.

11. Decision Wob request Foundation Platform Keelbos / Hans Gaillard

On December 7, the college received a request under the Open Government Act (Wob) from Platform Keelbos Foundation. The request is for the transmission of the B&W advisory memorandum underlying the 2019 closure of the parking spaces on Hoberglaan. No documents have emerged that fall within the scope of the Wob request.

The College decides:
1. to take a decision on the Wob request of Foundation Platform Keelbos dated December 7, 2021;
2. not to disclose any information in response to the Wob request.

12. Traffic decision Hoberglaan / Kanaaldijk Noord / Hans Gaillard

On August 3, 2020, the college published a draft traffic decision regarding the closure of inlets on Hoberglaan / Kanaaldijk-North. Views have been submitted against this. Taking note of the views, the college takes a final traffic decision. In doing so, the views have been partially addressed. In addition, the college received a notice of default for not taking the final traffic decision on time.

College Decision:

  • To agree with the note of response to views;
  • Agree to the final traffic decision;
  • To agree with the opinion on the notice of default of Platform Keelbos Foundation;
  • agree with the opinion that no penalty payment is due for failure to make a decision in a timely manner.

13. (Re)development site Ruysdaelstraat 2; basic plan and start environmental dialogue / John Frenken

On September 27, 2021, Woonstichting 'thuis was given the (adjusted) preconditions and starting points for the desired housing development at the Ruysdaelstraat 2 location. Woonstichting 'thuis presented a plan outline on November 04, 2021, which for the moment meets the 'preconditions and starting points'. It concerns a plan design with 20 housing units for the 24-hour Health and 23 regular social housing units. Besides the access structure (from the Rembrandtlaan) and the parking (east side), attention is paid to the public space. It is proposed to request Woonstichting 'thuis to start the environmental dialogue with this plan outline.

The college decides to:

  • To take note of the plan outline prepared by Woonstichting 'thuis that meets the "preconditions and principles" for this stage of the process;
  • Request Housing Foundation 'Home to initiate the environmental dialogue based on the Ruysdael Street plan outline dated November 4, 2021;
  • Inform the council of this decision and start of the environmental dialogue via a RIB.

14. Green Spaces 2022 / Jan Boersma

The maintenance of green areas, such as roadsides, lawns, ditches is carried out by various contractors under specifications. The specifications run until 2021. In 2021 we started updating the management data which will become the basis for good specifications. This improvement will be completed in the first quarter of 2022. Unfortunately, this is too late to tender new specifications with correct data for the service year 2022. For this reason, we want to tender the existing contracts for one year by single private treaty so that we can tender the new specifications with correct information and quantities in 2022 for the 2023-2028 plan period. An important quality assurance in the process is management and supervision of the specifications. We have outsourced this to an external party. For 2022 we will enter into a new contract with this party because of its historical knowledge of specifications and environment.

College Decision:

  • To award the specifications "mowing lawns/sports fields" for one year to the company Ploegmakers;
  • To award the specifications "stabbing lawn edges" for one year to the Ploegmakers company;
  • To award the specifications "berms and waterways" for one year to the company J. Bouw;
  • to award management and supervision of the 2022 specifications to the company Terraspect.

15. Arrangement lease bicycle Son en Breugel / Paul van Liempd

The scheme allows an employee to lease a bicycle in a tax-friendly manner. Employees are encouraged to exercise more and reduce car use. It increases sustainable employability. The recommendation is to adopt the scheme uniformly for the 4 Dommelvallei organizations. It is advised to also maintain the current bicycle incentive scheme in addition to the new lease scheme. The works council of the municipality of Son en Breugel has agreed to the lease arrangement.

College Decision:

  • To take note of the Works Council's response;
  • to adopt the lease bicycle arrangement;
  • Maintain the current bicycle incentive scheme;
  • enter into a lease agreement with the company Lease a bike.
