1. Non-public list of decisions and public list of decisions dated December 14, 2021 / Hans Gaillard

The college adopts the decision lists.

2. Decision on objection to refusal of environmental permit / Hans Gaillard

On June 15, 2021, the council decides to reject the application for an environmental permit for the temporary legalization of four shelters erected for a period of five years. On July 22, 2021, the council receives an objection from the objector against the above decision. The objections committee recommends that the objection be declared unfounded and that the contested decision be upheld, with additional reasoning.

College Decision:

  • Declare the objection unfounded;
  • uphold the contested decision, supplemented by the reasoning set out in the opinion of the appeals committee;
  • Reject the request for reimbursement of legal costs;
  • Refer to the opinion of the Objections Committee for the reasons for the decision.

3. Decision on Freedom of Information Act request by Stichting Platform Keelbos / Hans Gaillard

On December 7, the council received a request from Stichting Platform Keelbos under the Government Information (Public Access) Act (Wob). The request was for information regarding how nuisance caused by the gay meeting place (HOP) was monitored. The request was assessed against the Wob. The documents that were found are already public. No new documents have been found that fall within the scope of the Wob request.

College Decision:

  • to make a decision on the Freedom of Information Act request submitted by Stichting Platform Keelbos on December 7, 2021;
  • not to disclose any information in response to the Wob request.

4. (Re)development of Boslaan 63: final plan and participation report / John Frenken

On November 22, 2021, the initiator submitted the final plan, including a summary of the community dialogues held for the (re)development of the Boslaan 63 site. The plan involves the development of the plot with 12 owner-occupied apartments and one detached house. The final plan elaborates on the 'municipal preference model', the 'preconditions and principles' set by the municipality, the suggestions made by the members of the council (Land Affairs Committee), and takes into account the input from the community dialogue. The olSB Steering Group has determined that the final plan is satisfactory and will propose to your council that it be approved, after which the next steps (agreement, draft zoning plan, draft environmental permit) can be taken by the initiator. The council is also being asked to request permission to apply the coordination scheme for this development location.

College Decision:

  1. to adopt the final plan "Boslaan 63" as an elaboration of the "municipal preferred model" adopted on July 9, 2019, the environmental dialogues conducted, and the consultations with the council (land affairs committee);
  2. to draw up the prior operating agreement with the initiator;
  3. ask the initiator to prepare the draft zoning plan and the draft environmental permit;
  4. in preparation for the necessary legal and planning procedures, to propose to the municipal council that the coordination arrangement pursuant to Article 3.30 of the Spatial Planning Act (Wro) be applied to the redevelopment of the planning initiative on the plot at Boslaan 63;
  5. inform the council about this decision-making process via a RIB.

5. Letter from the province regarding the 2022 budget / Jan Boersma

The province informs the municipal council each year about its findings from financial supervision of the budget. Based on this supervision, there are no particular issues for the 2022 budget. Normal supervision will continue to apply to this budget.

The council acknowledges the letter from the province dated December 8, 2021, regarding the 2022 budget.

6. Start procedure for draft zoning plan for rural area, Airboirneweg 51 / Jan Boersma

In October 2021, a draft zoning plan was submitted for the amendment of the Buitengebied zoning plan. This involves changing an intensive livestock farm (poultry farm) to a horse farm at the address Airborneweg 51. An anterior agreement has now been concluded with the applicant. The Spatial Planning Act procedure can be initiated for this draft. The first step is to publish the draft and make it available for inspection.

College Decision:

  • to adopt the draft zoning plan "Rural area, Airborneweg 51";
  • To release the draft zoning plan for further adoption procedure in the context of the opportunity for the submission of views.

7. Continuation of the local coronavirus fund / Jan Boersma

Entrepreneurs, businesses, and workers are still facing stricter coronavirus measures that limit their ability to do business. The government therefore announced another economic support package on December 14, 2021. This support package contains a number of familiar generic schemes, including the NOW, TVL, and a relaxed Bbz. In addition to these (national) schemes, it is proposed to continue the local coronavirus support fund. This will maintain a local financial safety net and enable local customization.

The council has decided to continue to implement the municipal council's motion by calling on local entrepreneurs, businesses, and residents to apply for individual support when financial (national) schemes do not provide for this.

8. Questions from Dorpsbelang / Paul van Liempd

Following the presentation on November 21 regarding the cmd business plan, the Dorpsbelang Son en Breugel council faction asked a number of questions related to the accommodation of the cmd and the Dommelhuis. The answers to the council questions have been submitted.

College Decision:

  • to agree to answer the questions from Dorpsbelang Son en Breugel in accordance with the answers provided;
  • to inform the Dorpsbelang Son en Breugel council faction and the municipal council of the answers to the council questions.

9. Development vision for Nieuwe Heide & Oud Meer / Paul van Liempd

The council requests that the Development Vision for Nieuwe Heide & Oud Meer be adopted and that implementation funds be made available in accordance with the council proposal.

The council decides to submit the Development Vision for Nieuwe Heide & Oud Meer to the council for approval and to request implementation funding in accordance with the council proposal.

10. Political Evening Program and list of commitments December 23, 2021 / Hans Gaillard

The council discusses the items on the agenda for the political evening of December 23.

11. Decision on Freedom of Information Act request by Stichting Platform Keelbos / Hans Gaillard

On December 7, the council received a request from Stichting Platform Keelbos under the Government Information (Public Access) Act (Wob). The request was for the municipal executive's advisory memorandum that formed the basis for closing the parking spaces on Hoberglaan in 2019. No documents were found that fell within the scope of the Wob request.

The council decides:
1. to take a decision on the Wob request from Stichting Platform Keelbos dated December 7, 2021;
2. not to disclose any information in response to the Wob request.

12. Traffic decision Hoberglaan / Kanaaldijk Noord / Hans Gaillard

On August 3, 2020, the municipal executive published a draft traffic decision regarding the closure of inlets on Hoberglaan / Kanaaldijk-Noord. Opinions were submitted in response to this. Taking these opinions into account, the municipal executive will make a final traffic decision. In doing so, it has partially taken the opinions into account. In addition, the municipal executive received a notice of default for failing to take the final traffic decision in a timely manner.

College Decision:

  • to agree with the memorandum responding to the opinions;
  • to agree to the final traffic decision;
  • to agree with the advice on the notice of default issued by Stichting Platform Keelbos;
  • to agree with the recommendation that no penalty is payable for failing to take a decision in time.

13. (Re)development site Ruysdaelstraat 2; basic plan and start of community dialogue / John Frenken

On September 27, 2021, the housing association 'thuis was provided with the (adjusted) preconditions and starting points for the desired housing development at the Ruysdaelstraat 2 location. On November 4, 2021, Woonstichting 'thuis presented a draft plan that currently meets the 'preconditions and starting points'. The draft plan involves 20 residential units for the 24-hour Health 23 regular social housing units. In addition to the access structure (from Rembrandtlaan) and parking (east side), attention is also being paid to the public space. It is proposed that Woonstichting 'thuis be asked to initiate the environmental dialogue with this draft plan.

The college decides to:

  • take note of the plan drawn up by the Housing Association, which at this stage of the process meets the 'preconditions and principles';
  • Housing association 'thuis' requests, based on the plan for Ruysdaelstraat dated November 4, 2021, to start the environmental dialogue;
  • inform the council about this decision-making process and start the environmental dialogue via a RIB.

14. Green specifications 2022 / Jan Boersma

The maintenance of green areas, such as verges, lawns, and ditches, is carried out by various contractors under specifications. The specifications are valid until 2021. In 2021, we started updating the management data, which will form the basis for sound specifications. This improvement will be completed in the first quarter of 2022. Unfortunately, this is too late to now tender new specifications with the correct data for the 2022 service year. For this reason, we want to tender the existing contracts for one year on a single private basis so that we can tender the new specifications with the correct information and quantities in 2022 for the 2023-2028 planning period. An important quality assurance measure in the process is the management and supervision of the specifications. We have outsourced this to an external party. For 2022, we are entering into a new contract with this party because of its historical knowledge of specifications and the environment.

College Decision:

  • award the contract for "mowing lawns/sports fields" to the company Ploegmakers for one year;
  • award the contract for "lawn edging" to the company Ploegmakers for one year;
  • to award the contract for "verges and waterways" for one year to the company J. Bouw;
  • to award the management and supervision of the specifications for 2022 to the company Terraspect.

15. Son en Breugel bicycle lease scheme / Paul van Liempd

The scheme allows employees to lease a bicycle in a tax-friendly manner. Employees are encouraged to exercise more and reduce their car use. This increases sustainable employability. The recommendation is to establish the scheme uniformly for the four Dommelvallei organizations. It is also recommended that the current bicycle incentive scheme be maintained alongside the new lease scheme. The works council of the municipality of Son en Breugel has approved the lease scheme.

College Decision:

  • take note of the response from the works council;
  • to establish the bicycle lease scheme;
  • maintain the current bicycle incentive scheme;
  • enter into a lease agreement with the company Lease a bike.
