1. Non-public decision list and public decision list July 13, 2021 / Hans Gaillard

The college adopts the decision list.

2. Heritage policy and zoning Cultural history / John Frenken

In order to comply with the obligations of the Spatial Planning Act (Wro), Spatial Planning Decree (Bro) and the Heritage Act, the policy memorandum " Heritage Policy" has been drawn up in consultation with Monumentenhuis Brabant, the society of local history and the monument committee. The "Heritage Policy" has been translated into the draft "Cultural Heritage" zoning plan so that it forms an assessment framework for new developments. On October 13, 2020, the college decided to release the drafts for the viewing period. Five views were submitted in response to the draft "Cultural Heritage" zoning plan. Of these five, one view is inadmissible because it contains no content. Part of one of the views will be adopted and the remaining views will not be adopted. In addition, an official adjustment to the plan will be made on its own initiative and based on the official response from the Department of Public Works (RWS). At the conclusion of this process, the Heritage Policy and the 'Cultural Heritage' zoning plan can be presented to the City Council for adoption.

College Decision:

  • To propose that the council adopt the policy memorandum "Heritage Policy";
  • To propose that the council adopt and adopt the response to the views as described and weighed in the "Notice of Views" draft zoning plan "Cultural History," which notice is deemed to be part of this decision;
  • propose to the council to adopt the zoning plan "Cultural Heritage" with plan identification "NL.IMRO.0848.BP152ERFGOED-VA01 "as amended and to make it available digitally.

3. 2nd connection Ekkersrijt: Report and Preliminary exploration / Jan Boersma

After an intensive process together with the Municipality of Eindhoven, consultancy firm Movares has completed the preliminary exploration phase - to arrive at a second connection Ekkersrijt. To this end Movares has delivered a final report, which is presented for adoption. The report is also the prelude to starting the exploration phase.

College Decision:

  • To agree to the report of the Preliminary Exploration;
  • Inform the City Council about this separately with a Council Information Letter (RIB).

4. Regulation of complaints and sanctions pupil transport / Paul van Liempd

The municipality may establish further rules on complaint handling and the imposition of sanctions for misconduct in adapted pupil transport. The current regulations have been updated due to practical experience and the transition to a new carrier.

College Decision:

  • To approve the "Regulation on complaints and sanctions in the adapted pupil transport Son en Breugel";
  • To repeal the "Regulations on Penalties in Adapted Pupil Transport 2012".

5. Library board agreement 2021-2024 / Jos de Bruin

Library work in the municipalities of Geldrop-Mierlo, Nuenen c.a. and Son and Breugel is carried out by Dommeldal Library on the basis of a board agreement. This describes the quantitative and qualitative agreements between the four parties and was concluded for the period 2016-2019. The agreement was extended until July 1, 2021 so that a vision for library work could first be developed. The college is asked to agree to the new board agreement based on the new vision for library work.

The college decides to approve the management agreement of the municipalities of Son en Breugel, Nuenen c.a., Geldrop-Mierlo and Stichting Basisbibliotheek Dommeldal regarding the implementation of library work in the period 2021-2024.

6. Political Evening and the list of commitments council meeting July 22, 2021 / Hans Gaillard

The college discusses the documents scheduled for the political evening of July 22, 2021.
7.JB Relaunch 2nd connection Ekkersrijt: Interim step and Exploratory Study and 2 RIBs
In order to be able to complete the vision creation in time, in the form of the Exploratory Study for the project 2nd connection Ekkersrijt, acceleration of the process and limitation of the lead time is necessary.

College Decision:

  • Adopt the procurement strategy exploration 2nd connection Ekkersrijt and commission consulting firm Movares for the Exploration, including the Intermediate Step of the project 2nd connection Ekkersrijt;
  • Inform the City Council with a Council Information Letter on status of Bundle Route projects;
  • Inform the City Council with a Council Information Letter on the completion of the Preliminary Exploration and the acceleration of the process.

8. Sale and purchase of land at Ekkersrijt entrance / Jan Boersma

The college decides to sell ca 1277 m2 of land to Bakker Ontwikkeling B.V. for the benefit of the development at Ekkersrijt 4000 and to buy ca 69 m2 of land from Mr. Bakker for the benefit of the construction of a footpath.

The college agrees to:

  • The sale of approximately 1277 m2 of land to Messrs. Bakker/Mast for an amount of € 220, - m2k.k., for the benefit of the development at Ekkersrijt 4600 as further described in the advice note regarding this initiative (the anterieure agreement);
  • to reimburse the costs up to a maximum of € 55,000- for the relocation of the sewers and to pay a contribution of € 5,500 for the costs of Kragten as supervisor
  • The purchase of approximately 69 m2 of land at a cost of €220, with additional costs to be borne by Bakker/Mast, for the purpose of constructing a footpath along road 4000;
  • The purchase and sale agreement setting forth.

9. Appoint deputy secretary / Paul van Liempd

The replacement of the town clerk should be secured within the organization. In coordination with the Steering and Coaching team, the proposal is to make an adjustment in the designation of replacements as of July 20, 2021, partly due to the absence of a Stuco member. In the case of one substitute, the situation is temporary.

The College decides to designate as substitutes for the Town Clerk, in view of Article 106 of the Municipal Law, effective July 20, 2021 for the duration of S. de Jong's absence:

  • first alternate, Ms. G.D.M.H. Bom - van Leeuwen, member team Steering and Coaching;
  • second and temporary replacement, Mr. F.A. van Gorp, senior policy officer.

10. Addendum procurement strategy Wmo accompaniment / Paul van Liempd

In view of signals from providers that the rates for Wmo day care would be insufficient, the procurement team has prepared an addendum with the adjusted rates. It is proposed to agree to the adjusted rates as included in the attached addendum.

The college agrees to the addendum to the Purchasing Strategy for Guidance Wmo adopted by the college in November 2020.
