2 Political Evening December 21, 2023
The council discusses the program for the Political Evening of December 21, 2023, and the list of commitments made by the council on November 23, 2023.
3 Overview of decisions taken under mandate in week 51 2023
The college is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the college or the mayor in the past period.

4 Council information letter Sonnius Park
The council decides to submit the council information letter "status of the redevelopment of the park/forest north of Sonniuspark" to the council.
The council decides to adopt the council information letter and submit it to the municipal council.
5 Land prices letter 2024
On December 17, 2020, when adopting the Land Policy Memorandum 2021–2024, the municipal council instructed the Mayor and Aldermen to update land prices annually.
The college decides to:
- to determine the land price letter for 2024;
- For locations where fixed land prices do not apply, place greater emphasis on independent valuations.
6 Service Agreement on Tax Cooperation in East Brabant
The tasks relating to taxation and collection are outsourced to the East Brabant Tax Cooperation (BSOB). A service agreement is entered into for this purpose. In addition, the head of the BSOB department is appointed as the tax, collection, and WOZ (Valuation of Immovable Property Act) officer, and a number of BSOB policy rules are declared applicable.
College Decision:
- to agree to the outsourcing of tasks in the field of taxation and collection to the East Brabant Tax Cooperation, by entering into the attached service agreement;
- to grant the director of the Dommelvallei Service a mandate to enter into the service agreement and the associated processing agreement on behalf of the municipality of Son en Breugel;
- to request the mayor to assign the signing of the service agreement and the processing agreement to the director of the Dommelvallei Service;
- the council decision to adopt formal aspects of DVO Dienst Dommelvallei - Tax Cooperation East Brabant 2024.
7 Extending Administrative Agreements on Protected Housing until 2026
The decentralization of Sheltered Housing has been postponed until at least 2025. This means that the municipality of Eindhoven will remain responsible for the implementation of Sheltered Housing in the coming period. This is based on administrative agreements and mandates that must be extended. It has been decided to extend the Administrative Agreements until 2026, unless decentralization takes effect earlier.
The council decides:
1. to agree to the extension of the existing Administrative Agreements on Sheltered Housing until January 1, 2026, at the latest;
2. to agree to the mandates to be issued for Sheltered Housing to the municipality of Eindhoven, in accordance with the draft municipal gazette, until January 1, 2026, at the latest.
8 College proposal intention to collect
Before a collection decision can be made, case law requires that an intention to collect be established. The signing of an intention to collect is not included in the mandate register. As a result, the board must decide on the intention to collect. With this board decision, the board is requested to sign the intention to collect a forfeited penalty of €5,000.00.

9 Policy rule established for odor-sensitive buildings and noise
The Omgevingswet will come Omgevingswet force on January 1, 2024. With the introduction of the Omgevingswet , new, open standards Omgevingswet introduced and some definitions will change. The current environmental policy will also be abolished. We therefore propose to establish new policy rules. This will ensure a smooth transition and eliminate the need to make policy choices on a case-by-case basis. These policy rules will give substance to the open standards and the current definitions will remain in force for the time being. The policy rules have been rewritten to be as policy-neutral as possible.
College Decision:
- to adopt a policy-neutral approach to the definition of odor-sensitive buildings in relation to odor pollution from livestock farms in non-plan-based environmental planning activities by establishing the Policy Rule Definition for Odor-Sensitive Buildings Son en Breugel 2024;
- to apply the procedure for noise in areas of concern such as roads and industrial estates by adopting the Noise Policy Rule under the Omgevingswet en Breugel Omgevingswet
10 Development of participation policy
The municipality of Son en Breugel wants to increase residents' involvement in municipal decision-making. A number of options for creating a participation policy through a participation process have been explored. These are detailed in the Participation Process policy document. During an advisory evening, the municipal council expressed its preference, points of attention, and involvement during the process.
During a deliberative session, the council expressed its opinion on the proposal of the municipal executive and, based on the financial context, among other things, opted to implement the participation process based on the 'informed resident' variant. During this process, civil servants and various organized advisory groups from different domains will be consulted on the development of the participation policy. Residents of the municipality of Son en Breugel will have two opportunities to express their opinions: when the policy is available for inspection and when it is presented to the council. We are thus following the usual public participation procedure.
College Decision:
- to commission the implementation of the proposed participation process, based on the 'informed resident' concept as included in the Participation Process Policy Document;
- to adopt the council information letter to the municipal council, informing the municipal council about the established participation process. The text will be added to this week's general council information letter;
- to carry forward the surplus from 2023 to 2024 via the appropriation of profits in the 2023 financial statements.
11 Extension of agreement with Municipal Health Service (GGD) for performing reporting function under the Compulsory Mental Health Care Act (Wvggz)
Starting in 2020, the reporting function under the Wvggz will be carried out by the GGD for a number of municipalities. In addition, the GGD also operates the Reporting and Advice Center for Concerning Behavior. Based on the experiences with the GGD, it is proposed that this collaboration be continued for another period of five years.
College Decision:
- to continue the implementation of the Reporting and Advice Center for Concerning Behavior and the Wvggz by the GGD Brabant Zuidoost;
- to enter into an agreement with the GGD Brabant Zuidoost (Municipal Health Service) for a period of 5 years;
- to make an annual amount of €12,553 available to the Municipal Health Service (price level 2024) with annual indexation of the Municipal Health Service's indexation percentage. The coverage is found in Program 2.
