2 Political Evening December 21, 2023

The college discussed the program for the December 21, 2023 Political Evening and the list of commitments council November 23, 2023.

3 Overview of decisions taken in mandate week 51 2023

The college is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the college or the mayor in the past period.

The college takes note of the "Overview of decisions taken in mandate week 51 2023".

4 Council information letter Sonnius Park

The college decides to submit the council information letter "status of park/forest redevelopment north of Sonnius Park" to the council.

The College decides to adopt the council information letter and submit it to the City Council.

5 Land Price Letter 2024

On December 17, 2020, the City Council, in adopting the Land Policy Memorandum 2021 - 2024, instructed the College of Mayor and Aldermen to update land prices annually.

The college decides to:

  • Adopt the 2024 land price letter;
  • for sites not subject to fixed land prices, more explicitly rely on independent valuations.

6 Service Agreement for East Brabant Tax Cooperation.

Tax and collection tasks are outsourced to the East Brabant Tax Cooperation (BSOB). A service agreement will be entered into for this purpose. In addition, the head of department of the BSOB will be appointed as levy, collection and WOZ official and a number of policy rules of the BSOB will be declared applicable.

College Decision:

  1. agree to outsource the tasks in the field of taxation and collection to the East Brabant Tax Cooperation, by entering into the attached service agreement;
  2. To grant a mandate to the Director of the Dommelvallei Service to enter into the Service Agreement and the associated Processor Agreement, on behalf of the Municipality of Son and Breugel;
  3. To request the Mayor to delegate the signing of the Service Agreement and the Processing Agreement to the Director of the Dommelvallei Service;
  4. Adopt the College Decision formal aspects DVO Dienst Dommelvallei - Belastingsamenwerking Oost-Brabant 2024.

7 Extending Administrative Agreements Protected Housing to 2026

The decentralization of Protected Housing has been postponed until at least 2025. This means that the Municipality of Eindhoven will remain responsible for the implementation of Protected Housing for the coming period. Attached to this are administrative agreements and mandates that must be extended. It has been decided to extend the Administrative Agreements until 2026, unless the decentralization takes effect earlier.

The College decides:
1. agree to the extension of the existing Administrative Agreements for Protected Housing until no later than January 1, 2026;
2. to agree with the mandates for Protected Housing to be issued to the Municipality of Eindhoven, in accordance with the draft Municipal Gazette, until no later than January 1, 2026.

8 College proposal intent to collect

Before a collection decision can be made, case law requires that an intention to collect be signed. The signing of an intention to collect is not included in the mandate register. As a result, the college must decide on the intention to collect. With this college decision, the college is requested to sign the intention to recover a forfeited penalty of €5,000.00.

9 Policy rule establishing odor sensitive building and noise

On Jan. 1, 2024, the Omgevingswet will take effect. With the arrival of the Omgevingswet , new, open standards will be introduced and some definitions will be different. Current environmental policies will also expire. Therefore, we propose to adopt new policies. By doing so, we will transition smoothly and policy choices will not have to be made on a case-by-case basis. These policy rules flesh out the open standards and maintain the current definitions for the time being. The policy rules have been rewritten in a policy-neutral manner as much as possible.

College Decision:

  • Adopt a policy-neutral approach to the definition of odor-sensitive building for odor exposure from livestock farms in out-of-plan environmental planning activities by adopting the Policy Rule Definition Odor Sensitive Building Son en Breugel 2024;
  • adopt the procedure for noise in focus areas of roads and industrial estates by adopting the Noise Policy Rule under the Son en Breugel Omgevingswet

10 Creation of participation policy

The municipality of Son and Breugel wants to increase the involvement of residents in the decision-making of the municipality. A number of variants have been explored on how to make participation policy with a participation process. This has been worked out in the Participation Process Selection Memorandum. With an advisory evening, the city council expressed their preference variant, points of interest and their involvement during the process.
During an opinion-forming session, the council gave its verdict on the college's proposal and, based on the financial context, among other things, opted to carry out the participation process based on the "informed resident" variant. During this process, officials and various organized advisory groups from different fields are consulted in the creation of the participation policy. Residents in the municipality of Son and Breugel can give their opinion at two moments, when the policy is available for inspection and when it is presented to the council. We thus follow the usual public participation procedure.

College Decision:

  1. mandate the implementation of the proposed participation process, based on the "informed resident," as included in the Choice Process Participation Memorandum;
  2. To adopt the council information letter to the City Council, informing the City Council of the established participation process. The text will be added to this week's general council information letter;
  3. Carry the 2023 surplus into 2024 via profit appropriation in the 2023 financial statements.

11 Renewal agreement GGD implementation reporting function Wvggz

As of 2020, the reporting function under the Wvggz will be performed by the GGD for a number of municipalities. In addition, the GGD also performs the Reporting and Advice Point Worrisome Behavior. Based on the experience with the GGD, it is proposed to continue this cooperation for another period of 5 years.

College Decision:

  1. To continue the implementation of the Reporting and Advice Point Worrisome Behavior and Wvggz by the GGD Brabant Zuidoost;
  2. To this end, enter into an agreement with GGD Brabant Zuidoost for the duration of 5 years;
  3. To provide the GGD with an annual amount of €12,553 (price level 2024) with an annual indexation of the GGD's indexation rate. Coverage will be found in Program 2.
