1. Public list of decisions Municipality of Son en Breugel July 11, 2023 - Suzanne Otters-Bruijnen
The college adopts the decision lists.
2. Written questions D66 checks on subversion - Suzanne Otters-Bruijnen
On behalf of the D66 parliamentary party, written questions were submitted on July 8 regarding checks for subversion.
The council decides to approve the (draft) response to the written questions received from the D66 political party regarding checks in the context of subversion and to make this available to the council.
3. Decisions on objections to municipal preemptive rights law - Jelle de Jong
On April 20, 2023, the municipal council decides to establish a right of first refusal on part of the Breeakker neighborhood in Son en Breugel. The municipal council receives ten objections from objectors to the above decision. The appeals committee recommends that the objections be declared unfounded, that the contested decision be upheld, and that any request for reimbursement of legal costs be rejected. The municipal executive proposes that the council follow the advice of the appeals committee.
The board decides to propose to the council that:
- to declare unfounded the objections to the decision dated April 20, 2023, to establish a right of first refusal on part of the Breeakker neighborhood in Son en Breugel;
- uphold the contested decision;
- if reimbursement of legal costs is requested, to reject this request;
- refer to the opinion of the appeals committee for the reasons behind the decisions.
4. Start procedure zoning plan Rural Area, Noorderlicht (Wolfswinkel crematorium) - Jelle de Jong
In mid-2022, the council approved the addition of a crematorium to the Wolfswinkel funeral home. To make this possible, a zoning plan revision is necessary. A draft zoning plan has now been submitted for the expansion of the funeral home with a crematorium. The procedure for this draft can be started on the basis of the Spatial Planning Act. The first step is to make the draft zoning plan available for public inspection.
College Decision:
- to approve the draft zoning plan "Buitengebied, Noorderlicht 1";
- to release the draft zoning plan for the further adoption procedure, namely to make the draft zoning plan available for inspection in order to allow for the submission of opinions.
5. Council information letter on strategic purchase Veerstraat - Jan Boersma
On July 4, 2023, your council decided to acquire Veerstraat and cadastral parcel Son en Breugel, Section F, number 262. The signing of the purchase agreements is scheduled for July 19, 2023, and the notarial transfer is scheduled for July 27, 2023. In connection with your council's vacation period, the council information letter is hereby submitted for approval in anticipation of the signing of the purchase agreements. In this way, in accordance with the Land Policy Memorandum 2021–2024, the municipal council can be informed as soon as possible about this strategic purchase.
The college decides to:
- to adopt the text "Council information letter Strategic purchase Veerstraat and plot F262";
- Alderman to be given text mandate to implement any changes.
6. RIB Container archaeological tools - Jan Boersma
Council information letter on the handling of the motion 'Accommodation of archaeological tools container'.
The council decides to adopt the RIB text on the storage of the container with archaeological tools and to include it in the next council information letter.
7. Exploration of circular opportunities in Ekkersrijt - Jan Boersma
With the 'Grote Oogst' (Big Harvest) project, we are giving a boost to making the Ekkersrijt business park more sustainable. One of the themes is the transition to a circular business park. The province is facilitating a waste stream analysis and circularity scan for this purpose. This data can be used to launch a project that is area-focused, material-focused, or involves exchanges between companies. This is our first step in promoting circularity at the Ekkersrijt business park.
College Decision:
- to commission Stichting InduSym to start an exploration of circularity at Ekkersrijt;
- Inform the City Council via a Council Information Letter.
8. Overview of decisions taken during mandate week 29 2023 - Suzanne Otters-Bruijnen
The council is periodically informed about decisions taken under mandate. The overview contains decisions taken on behalf of the council or the mayor in the past period.
The board takes note of the overview of decisions taken during week 29 of 2023.
9. College advice on the status of the variant study on access to Jansen BV - Jan Boersma
On August 24, 2022, the Administrative Law Division of the Council of State (ABRS) ruled on the appeals (lodged by the municipality of Best and A. Jansen BV) against the zoning plan "Ekkersrijt; Jansen Kanaaldijk Zuid 24" adopted on March 12, 2020. The ABRS upheld the appeals and annulled the zoning plan. In doing so, it instructed us to take a new decision within 52 weeks, taking into account the considerations set out in the ruling. In order to comply with this, the Kragten consultancy firm is conducting a study of the various options for accessing Jansen BV. This study is now well advanced and important new facts have come to light. In view of this and due to the complexity of the task, the deadline set by the ABRS is not feasible. The municipality of Best and Jansen BV will be informed of this (again).
The college decides to:
- take note of the status of the variant study, the legal advice, and the current planning;
- inform the municipality of Best by letter (and, if necessary, grant text mandate to the portfolio holders);
- Inform the council by means of a RIB text (and, if necessary, grant text mandate to the portfolio holders).
10. RIB Opportunity to build carnival floats - Jan Boersma
Council information letter on the status of the implementation of the motion 'Possibility of building carnival floats'.
The council decides to adopt the RIB text on the possibility of building carnival floats and to include it in the next council information letter.
