1. Public decision list Municipality of Son and Breugel July 11, 2023 - Suzanne Otters-Bruijnen

The college adopts the decision lists.

2. Written questions D66 checks on undermining - Suzanne Otters-Bruijnen

Written questions were submitted on behalf of the D66 Group on July 8 regarding controls on undermining.

The college decides to approve the (draft) answers to the received written questions of the D66 Group on controls in the context of undermining and make them available to the council.

3. Decisions on objections to municipal preferential rights act - Jelle de Jong

On April 20, 2023, the municipal council decides to establish a preferential right on part of the Breeakker neighborhood in Son en Breugel. The municipal council receives ten notices of objection from objectors against the above decision. The appeals committee recommends that the appeals be declared unfounded, that the contested decision be upheld and, if a request is made for reimbursement of legal costs, that this request be rejected. The college proposes that the council follow the advice of the Objections Committee.

The college decides to propose to the council to:

  1. Declare unfounded the objections to the decision dated April 20, 2023 to establish a preferential right to a part of the Breeakker district in Son en Breugel;
  2. uphold the contested decision;
  3. If reimbursement of litigation expenses is requested, deny the request;
  4. Refer to the opinion of the Objections Committee for the reasons for the decisions.

4. Start procedure zoning plan Buitengebied, Noorderlicht (Wolfswinkel crematorium) - Jelle de Jong

In mid-2022, the council approved adding a crematorium to the Wolfswinkel funeral home. To make this possible, a zoning revision is necessary. Meanwhile, for the purpose of expanding the funeral home with a crematorium, a draft zoning plan has been submitted. The procedure under the Spatial Planning Act can be initiated for this draft. The first step is to submit the draft zoning plan for public inspection.

College Decision:

  • To approve the draft zoning plan "Outside Area, Noorderlicht 1";
  • To release the draft zoning plan for the further adoption procedure, i.e., to submit the draft zoning plan for public inspection to provide an opportunity for the submission of views.

5. Council information letter strategic purchase Veer Street - Jan Boersma

On July 4, 2023, your college decided to acquire Veerstraat and cadastral parcel Son en Breugel, Section, F, number 262. The signing of the purchase agreements is scheduled on July 19, 2023 and the notarial transport is scheduled on July 27, 2023. Due to the vacation period of your college, in anticipation of the signing of the purchase agreements, the council information letter is hereby submitted for adoption. In this way, in accordance with the Land Policy Memorandum 2021 - 2024, the City Council can be informed about this strategic purchase as soon as possible.

The college decides to:

  • Adopt the text "Council Information Letter Strategic Acquisition Veer Street and Parcel F262'';
  • Alderman Boersma text mandate to make any changes.

6. RIB Container archaeological tools - Jan Boersma

Council information letter on disposition of motion 'Housing container archaeological tools'.

The college decides to adopt the RIB text on housing the container of archaeological tools and include it in the next council information letter.

7. Exploring circular opportunities Ekkersrijt - Jan Boersma

With the 'Great Harvest' project, we give an impulse to making Ekkersrijt business park more sustainable. One of the themes is the step towards a circular business park. The province is facilitating a residual flow analysis and circularity scan for this purpose. With this data a project can be started to set up area-oriented, material-oriented or an exchange between companies. With this we make a first step in boosting circularity on Ekkersrijt.

College Decision:

  • To commission InduSym Foundation to initiate an exploration for circularity at Ekkersrijt;
  • Inform the City Council through a Council Information Letter.

9. Board recommendation status of variant study on access to Jansen BV - Jan Boersma

On August 24, 2022, the Administrative Law Division of the Council of State (ABRS) ruled on the appeals filed (by the Municipality of Best and A. Jansen BV) against the zoning plan "Ekkersrijt; Jansen Kanaaldijk Zuid 24" adopted on March 12, 2020. The ABRS upheld the appeals and annulled the zoning plan. In doing so, it ordered us to make a new decision within 52 weeks, taking into account what was considered in the ruling. In order to do so, consultancy firm Kragten is conducting a variants study into the possible accesses to Jansen BV. Meanwhile, this study has progressed and important new facts have come to light. Given this and the complexity of the task, the deadline set by the ABRS is not feasible. The Municipality of Best and Jansen BV will be informed (again) about this.

The college decides to:

  1. Take note of the status of the variance study, legal opinion and current schedule;
  2. To inform the Municipality of Best by letter (and to provide text mandate to the portfolio holders if necessary);
  3. Inform the council by means of a RIB text (and mandate text to portfolio holders if necessary).

10. RIB Possibility of building carnival floats - Jan Boersma

The college decides to adopt the RIB text on the possibility of building carnival floats and include it in the next council information letter.
