The council approves the lists of decisions.

2. Overview of decisions taken in mandate week 46 2021 / Hans Gaillard

The College is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the College or the Mayor.

3. Bibob policy rule / Hans Gaillard

The Bibob Act is a preventive administrative law instrument that protects competent government authorities against a fraudulent business climate. It can be used in connection with applications for permits, government contracts, subsidies, and real estate transactions. The existing policy rule has been amended to ensure that we have a uniform policy rule within the six municipalities of Dommelstroom, enabling us to form a more cohesive unit. The recommendation is to withdraw the 2018 policy rule and approve the new policy rule.

College Decision:

  1. the policy rule under the Public Administration Probity Screening Act (Wet Bibob) for the municipality of Son en Breugel 2021, each insofar as it concerns their own authority;
  2. the policy rule Bibob Act municipality of Son en Breugel 2018, each insofar as it concerns their own authority.
  3. inform the council by agreeing to the text of the letter.

4. Map mobility scenario for northern municipalities' / Jan Boersma

In 2021, the national government, province, and region developed a vision for the nature and scope of urbanization and accessibility challenges in the Brainport region as part of the MIRT study on the Eindhoven Ring Road. To achieve this urbanization goal while keeping the region accessible and livable, a transformation of the regional mobility system is necessary. Together, we are committed to a mobility transition, which aims to achieve a different distribution and use of infrastructure. The ideal image for the northern edge is a Map the details of this mobility transition for four municipalities together. With this proposal, the municipal executive is asked to approve this map, and the municipal council is also informed.

College Decision:

  1. to agree to the 'vision for the northern edge of the Eindhoven region' and the 'vision for the cycle route network';
  2. inform the municipal council about both visions via the council information letter.

5. Son en Breugel - Council decision / Jan Boersma

The council of Son en Breugel has commissioned Crowe Foederer BV to perform the audit for the 2021 financial year. However, in preparation for and in support of the audit, the council still needs to arrange a number of matters, which will be set out in the audit protocol.

College Decision:

  1. take note of the 2021 audit protocol, including the 2021 standards framework;
  2. To take note of the council proposal.

6. Memo on zonal closure declaration for freight traffic in the center of Son / Jan Boersma

In July 2021, the council agreed to schedule an information session on 'freight traffic in the city center'. This was in response to a motion that was tabled at the time on 'banning freight traffic on Antoon van de Venstraat'. In this recommendation, your council is asked to adopt the document 'Information meeting on freight traffic in the city center'.

College Decision:

  1. to adopt the document 'Information meeting on freight traffic in the city center' and the memo 'Zonal closure for freight traffic in the city center of Son';
  2. agrees to send this to the council for the planned information session.

7. Regional Agreement Framework for Housing in the Eindhoven Urban Area (SGE) / Jos de Bruin

The revised SGE Housing Agreement Framework 2022 'Building the Future' will be presented to the council. This will replace the current SGE Housing Agreement Framework from 2017. This was approved at the SGE Housing Policy Meeting on September 30, and it was agreed to submit this in a clear manner for decision-making to all nine councils and municipal councils involved in the Eindhoven Urban Area.

College Decision:

  1. to agree to the SGE 2022 Housing Agreement Framework "Building the Future";
  2. to submit the SGE 2022 Housing Agreement Framework 'Building the Future' to the council for approval, replacing the 2017 Housing Agreement Framework.

8. Signing of agreement on health promotion and prevention in the Brainport region / Jos de Bruin

In order to make our residents even healthier, the council is requested to sign the Brainport region health promotion and prevention agreement. This agreement focuses on prevention and positive health. Objective: By 2030, all residents of the Brainport region will live at least three years longer in good health and health inequalities will have been reduced by 20%. To achieve this, we will report annually on our efforts in the field of health promotion and prevention at regional meetings organized for this purpose.

  1. The council decides to sign the Brainport region health promotion and prevention agreement.
  2. The mayor entrusts the signing of this agreement to Alderman de Bruin.

9. Appeal against environmental permit for tree felling / Jan Boersma

On March 9, 2021, the council made a decision on the objection to the environmental permit for the felling of 108 trees in connection with the 'Sloot Gentiaan' project. An appeal has been lodged against this decision on the objection. The appeal is directed against tree number 84. As the project is nearing completion, it has been decided for pragmatic reasons not to fell the tree in question. The environmental permit can be withdrawn with regard to this tree.

The council decides to partially revoke the environmental permit for felling trees in connection with the redevelopment of the ditch (waterway) in the Gentiaan district with regard to tree number 84.

10. Principle request Ekkersrijt 2066 (Rhenus); use of distribution warehouse for high-risk storage / Jan Boersma

On August 9, 2021, the municipality received a request in principle from an initiator for the construction of a distribution warehouse at the location Ekkersrijt 2066 on the Ekkersrijt industrial estate, to be used as a 'high-risk facility'. The request in principle concerns the permission for a 'high-risk facility' for the storage of end-user-related hazardous substances. This requires an amendment to the current zoning plan, with the inclusion of an additional new safety contour. In view of the ambition to phase out or reduce high-risk activities in residential areas and industrial estates, it is recommended not to approve this activity and not to proceed with the amendment of the zoning plan involving an additional new safety contour.

College Decision:

  1. not to cooperate with the request in principle for a zoning plan revision at the Ekkersrijt 2066 location to allow a high-risk facility at this location;
  2. inform the initiator of this in writing via the draft letter.

11. Omgevingswet; drafting new award for environmental plan / Paul van Liempd

Based on a new procurement process (termination of the current environmental plan contractor, procurement team, quotation, and accountability of the procurement team), the contract for continuing to draw up the environmental plan for Son en Breugel has been awarded to Antea Group. The other organization will receive a (reasoned) letter of rejection.

College Decision:

  1. take note of the document "Accountability of the Procurement Team for Omgevingswet; environmental plan";
  2. to award Antea Group the contract to continue drafting the Son en Breugel environmental plan;
  3. inform the other party of the rejection by letter (mandated to the project manager);
  4. inform the council in accordance with the RIB text.

12. Concept note Development vision Nieuwe Heide & Oud Meer / Paul van Liempd

The council agrees to send the briefing note Development Vision Nieuwe Heide & Oud Meer to the council.
