2. List of decisions taken in mandate week 46 2021 / Hans Gaillard
The College is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the College or the Mayor.

3. Bibob policy rule / Hans Gaillard
The Bibob Act is a preventive administrative law instrument and protects authorized government agencies from a malafide business environment. It can be used in applications for permits, government contracts, subsidies and real estate transactions. The existing policy rule has been modified so that we have a uniform policy rule within the six municipalities of Dommelstroom, making us more of a block. The recommendation is to withdraw the 2018 policy rule and agree to the new policy rule.
College Decision:
- Adopt the policy rule Wet Bibob Gemeente Son en Breugel 2021, each insofar as it concerns their own authority;
- Repeal the policy rule Wet Bibob Municipality of Son en Breugel 2018, each insofar as it concerns their own authority.
- Inform the council by agreeing to the text of the letter.
4. Map 'wish image mobility north periphery municipalities' / Jan Boersma
National, provincial and regional governments developed a vision of the nature and scope of the urbanization and accessibility task in the Brainport region in 2021 as part of the MIRT study Randweg Eindhoven. To achieve this urbanization task and at the same time keep the region accessible and livable, a transformation of the regional mobility system is necessary. Together we are committed to mobility transition, which aims to achieve a different distribution and use of infrastructure. The northern edge is a Map that shows the effects of this mobility transition for four municipalities. With this proposal the college is asked to agree with this map and the city council is informed.
College Decision:
- Agree with the "desirable image of northern Eindhoven region" and the "desirable image of bicycle route network";
- Inform the City Council of both wish lists through the council information letter.
5. Son and Breugel - Council decision / Jan Boersma
The council of Son and Breugel has commissioned Crowe Foederer BV to conduct the audit for the fiscal year 2021. However, in preparation and support of the execution of the audit, the council still needs to regulate a number of matters in more detail, which takes place in the audit protocol.
College Decision:
- To take note of the 2021 audit protocol including 2021 standards framework;
- To take note of the council proposal.
6. Memo zonal closed declaration for freight traffic downtown Son / Jan Boersma
In July 2021, the college promised to schedule an information session on 'freight traffic in the center'. This was in response to a motion introduced at the time about 'prohibiting freight traffic Antoon van de Venstraat'. This recommendation asks your college to adopt the document 'Information session on freight traffic in the center'.
College Decision:
- To adopt the document "Information meeting freight traffic in center" and the memo "zonal closed declaration for freight traffic center Son";
- Agrees to send this to the council for the purpose of the scheduled information session.
7. Regional Agreements Framework Housing Urban Area Eindhoven (SGE) / Jos de Bruin
Presented to the college is the revised Agreements Framework Housing SGE 2022'Building the future'. This, to replace the current Agreements Framework Housing SGE from 2017. At the poho housing SGE of 30 September last, this was agreed and it was agreed to present this in an unambiguous manner for decision-making to all nine colleges and councils involved in the Urban Area Eindhoven.
College Decision:
- To approve the Agreement Framework for Housing SGE 2022 'Building the Future';
- To present the SGE 2022 Housing Agreements Framework "Building the Future" to the council for adoption, replacing the 2017 Housing Agreements Framework.
8. Signing agreement on health promotion and prevention Brainport region / Jos de Bruin
In order to make our residents even healthier, the college is requested to sign the agreement on health promotion and prevention Brainport region. This agreement focuses on prevention and positive health. Goal: In 2030 all inhabitants of the Brainport region live at least 3 extra years in good perceived health and the health differences are reduced by 20%. To achieve this, we report annually on our efforts in the field of health promotion and prevention at regional meetings organized for this purpose.
- The college decides to sign the agreement on health promotion and prevention Brainport region.
- The mayor dedicates the signing of this agreement to Alderman Jos de Bruin.
9. Appeal against tree canopy environmental permit / Jan Boersma
On March 9, 2021, the College issued a decision on the objection to the environmental permit to cut down 108 trees in connection with the Ditch Gentian project. This decision on the objection has been appealed. The appeal is against the tree numbered 84. As the project is nearing completion, it is decided for pragmatic reasons not to cut down the tree in question. The environmental permit can be withdrawn as far as this tree is concerned.
The College decides to partially revoke the environmental permit for tree felling in connection with the redevelopment of the ditch (watercourse) in the Gentian neighborhood as regards the tree numbered 84.
10. Principle request Ekkersrijt 2066 (Rhenus); use distribution warehouse for high-risk storage / Jan Boersma
On August 9, 2021, the municipality received a request in principle from an initiator for the realization of a distribution warehouse at the location Ekkersrijt 2066 in industrial park Ekkersrijt with the use 'high-risk establishment'. The principle request relates to allowing a 'high-risk establishment' to store end-user related hazardous substances. The current zoning plan must be amended to include an additional new safety contour. In view of the ambition to reduce or diminish high-risk activities in residential areas and business parks, it is recommended not to approve this activity and not to amend the zoning plan to include an additional new safety contour.
College Decision:
- Not to cooperate with the request in principle for a zoning plan revision to the location Ekkersrijt 2066 to allow a high-risk establishment at this location;
- Inform the promoter in writing via the draft letter.
11. Omgevingswet; new award drafting environmental plan / Paul van Liempd
Based on a new procurement process (farewell current environment plan contractor, procurement team, tender and justification of the procurement team), the contract for continuing the preparation of the environment plan for Son and Breugel will be awarded to Antea Group. The other organization will receive a (motivated) rejection letter.
College Decision:
- To take note of the document "Accountability Procurement Team Omgevingswet; omgevingsplan";
- To award Antea Group the contract for the continuation of the preparation of the Son en Breugel environmental plan;
- Inform the other party of the rejection by letter (mandated to the project manager);
- Inform the council in accordance with the RIB text.
12. Conceptualization memo Development Vision New Heath & Old Lake / Paul van Liempd
The college agrees to send the imaging memo Development Vision New Heath & Old Lake to the council.
