3 Decision on objection regarding cost recovery decision.
On May 13, 2024, the college decides to send a cost recovery decision. On June 14, 2024, the college receives an objection to the above decision. The Objections Committee recommends that the objection be upheld and the contested decision be rescinded, with the proviso that the contested decision be withdrawn.
College Decision:
- Declare the objection well-founded;
- Revoke the contested decision, with the proviso that the contested decision be withdrawn;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
4 Chain clause
In the past, municipalities of Son and Breugel and Eindhoven cooperated in the Agglomeration Industrieschap Ekkersrijt. The Industrieschap was among other things responsible for land allocation of industrial lots. This was sometimes done under specific Requirements including chain clauses in notarial deeds. The board is asked to remove a chain clause with restrictive usage options for a specific lot and inform the notary.
The college decides to delete the perpetual clause, included in the notarial deed dated January 8, 1979, with respect to the plot Ekkersrijt 1001, at the time established by the Agglomeration Industrieschap Ekkersrijt and taken over by the municipality of Son and Breugel.
5 Cooperation and Implementation Agenda RES.
In the Regional Energy Strategy (RES) 1.0, 21 MRE municipalities together with the province, water boards and grid operator Enexis agreed on ambitions. The Cooperation and Implementation Program RES (S&UP) is an elaboration of the RES 1.0. Because there is a new organizational structure, the S&UP has been updated. The S&UP is a multi-year program containing the projects we are implementing, including how we will work together. In the regional Poho consultation on energy transition on September 11, the S&UP has already been discussed. It was agreed that the S&UP will be presented for adoption in each college by October 23. After October 23, the MRE will send an information letter to the clerks to inform the councils as well.
College Decision:
- Adopt the RES MRE 2025-2027 Cooperation and Implementation Program;
- Confirm the previously made capacity deployment agreements;
- To accept the RES MRE Dashboard and RES MRE 2024 Progress Report for notification;
- To adopt the Council Information Letter.
6 Preconditions and principles Ockhuizenweg 14
On the site are a farmhouse with attached outbuilding and two former stables that have been converted as spaces for static storage. The initiator wants to create an office farm with home-like atmosphere for local residents on this location, where meetings and work can be held. Existing former stables are in use for static storage for small businesses. There will be small-scale parking out of sight, at the back of the property. There will be a green incorporation into the landscape. Living, working and recreation are central to this development.
The college decides:
- To adopt the "preconditions and principles of development site Ockhuizenweg 14" for the redevelopment of the Ockhuizenweg 14 development site;
- To inform the initiator in writing of the "preconditions and principles of development location Ockhuizenweg 14" and to request that they come up with a detailed plan that fulfills them.
7 Preconditions and principles Ockhuizenweg 10
At Ockhuizenweg 10, the company Merks toilet truck rental has been located since 2018. The initiator wants to use his site for toilet truck construction, rental and storage. For this purpose, the existing greenhouses will be demolished, the existing shed will be maintained and an additional storage shed will be realized at the back of the site. This will include a landscape green incorporation.
The college decides:
- To adopt the "preconditions and principles of development site Ockhuizenweg 10" for the redevelopment of the Ockhuizenweg 10 development site;
- To inform the initiator in writing of the "preconditions and principles of development location Ockhuizenweg 10" and to request that they come up with a detailed plan that fulfills them.
8 'Development vision the Breeakker - northern part -' and partially revoke 'preferential right Breeakker'
In a decision dated 20 April 2023 to establish a preferential right pursuant to Article 4 of the Municipal Preferential Rights Act (Wet voorkeursrecht gemeenten (Wvg)) on part of the immovable property in the de Breeakker area in Son en Breugel, the municipal council indicated that it wished to take a decision at the end of 2024 on a development plan (development vision) for this location and the possible consequences thereof for the preferential right area 'Breeakker'.
Since then, a plan of action has been implemented to fulfill the City Council's wish and the "Development vision the Breeakker - northern part -" has been drawn up. The vision is presented to the council for adoption. Now that, according to the development vision, part of the real estate on which a preferential right has been established does not stand in the way of the intended development of the area, the interest of the municipality in continuing to encumber the real estate in question with a preferential right expires. This constitutes grounds for proposing that the council revoke the preferential right for a number of properties.
The college decides:
- Adopt the council proposal '"Development vision the Breeakker - northern part -" as a framework document for further elaborations and discussions and submit this council proposal to the city council for decision;
- To use the "Development Vision the Breeakker - northern part -" as a framework for further elaboration for the purpose of an amendment to the environment plan so that the established right of first refusal valid until April 20, 2026, can be maintained, if necessary;
- to use the "Development Vision the Breeakker - northern part -" as the municipal desired framework in the discussions with the owners of and limited beneficiaries of the real estate, on which the preferential right is or remains established, respectively;
- To use the "Development Vision the Breeakker - northern part -" as a municipal desired framework in discussions with prospective buyers of properties/plots/real estate of the owners of and limited beneficiaries of the real estate on which the right of first refusal has been and remains established, respectively;
- Based on the "Development vision the Breeakker - northern part -" to adopt the council proposal "Partial withdrawal of the preferential right area Breeakker" and to submit this council proposal to withdraw the preferential right on part of the immovable property based on the "Development vision the Breeakker - northern part -" to the City Council for decision.
9 Permit to establish special crematorium under Section 53 Burial Act
On July 19, 2024, the college received an application for a permit under Section 53 of the Burial Act for the establishment of a special crematorium. The application concerns the location Noorderlicht 1 in Son en Breugel. The proposed decision to grant the permit was available for inspection from August 26, 2024 to September 24, 2024. There is no reason to change the intended decision. The permit can be granted.
The college decides to grant a permit for the establishment of a special crematorium under Article 53 of the Burial Act on the plot Noorderlicht 1 in Son en Breugel.
10 Answers to questions on accessibility of Dommelhuis
Written questions were asked about access to the Dommel House.
The college decides to adopt the answer to written questions,asked by the group PvdA/GroenLinks, about the accessibility of the Dommelhuis.
11 Vision of Work Locations Southeast Brabant
A new programming of work locations is being prepared in the Southeast Brabant region. To this end, a long-term vision for work locations in Southeast Brabant has been drawn up by the 21 municipalities in cooperation with the province and water boards. This forms the basis for the development of the programming. The Vision work locations Eindhoven Metropolitan Region is ready to be adopted by all municipal councils in the region.
The College decides to propose to the City Council:
- To adopt the 'Vision work locations Eindhoven Metropolitan Region, version 4.1';
- To take note of the Implementation Strategy and the draft Implementation Agenda of the Regional Programming Work Locations Southeast Brabant.
- To terminate the financial arrangement associated with the programming of workplaces SGE.
12 Electric charging in Son en Breugel - Charging plan
In Administrative Agreement 2022 - 2026, we stated that as a municipality that values sustainability and a clean living environment, we want to encourage electric mobility. A local charging plan should be drawn up to meet the increased need for public charging stations. This will provide clarity to residents, business owners and visitors based on which considerations
new charging stations will be installed. The longer-term goal is to reduce greenhouse gas emissions such as CO2.
The college decides to propose to the city council to adopt the vision on charging and the charging policy as contained in 'Electric Charging in Son en Breugel - Charging Plan' and to use this as a starting point for the further rollout of the public charging infrastructure.
