3 Decision on objection regarding cost recovery decision

On May 13, 2024, the board decides to send a cost recovery decision. On June 14, 2024, the board receives an objection to the above decision. The objections committee recommends that the objection be upheld and the contested decision be revoked, on the understanding that the contested decision will be withdrawn.

College Decision:

  1. Declare the objection well-founded;
  2. revoke the contested decision, on the understanding that the contested decision is withdrawn;
  3.  Refer to the opinion of the Objections Committee for the reasons for the decision.

4 Chain clause

In the past, the municipalities of Son en Breugel and Eindhoven collaborated in the Ekkersrijt Industrial Association. Among other things, the Industrial Association was responsible for the allocation of commercial plots. This sometimes took place under specific Requirements restrictive covenants in notarial deeds. The council is asked to remove a perpetual clause with restrictive usage options for a specific plot and to notify the notary. 

The council decides to delete the perpetual clause included in the notarial deed dated January 8, 1979, with regard to the plot of land at Ekkersrijt 1001, which was established at the time by the Ekkersrijt Agglomeration Industrial Authority and taken over by the municipality of Son en Breugel.

5 RES Cooperation and Implementation Agenda

In Regional Energy Strategy (RES) 1.0, 21 MRE municipalities, together with the province, water boards, and network operator Enexis, agreed on a set of ambitions. The RES Cooperation and Implementation Program (S&UP) is an elaboration of RES 1.0. Due to a new organizational structure, the S&UP has been updated. The S&UP is a multi-year program that includes the projects we are carrying out, including how we will work together. The S&UP was already discussed at the regional Poho energy transition meeting on September 11. It was agreed that the S&UP would be submitted to each council for approval by October 23. After October 23, the MRE will send an information letter to the clerks to inform the councils about this as well.

College Decision:

  1. to adopt the RES MRE 2025-2027 Cooperation and Implementation Program; 
  2. to confirm the previously made agreements on the deployment of capacity; 
  3. to take note of the RES MRE Dashboard and the RES MRE 2024 Progress Report; 
  4. to adopt the Council Information Letter.

6 Preconditions and principles Ockhuizenweg 14

The site comprises a company house with an attached outbuilding and two former stables that have been converted into spaces for static storage. The initiator wants to create an office farm with a homely atmosphere for local residents, where meetings can be held and work can be done. The existing former stables are used for static storage for small businesses. There will be small-scale parking facilities out of sight, at the rear of the site. This will be integrated into the landscape. This development focuses on living, working, and recreation.

The council decides:

  • to establish the 'preconditions and principles for the development site at Ockhuizenweg 14' for the redevelopment of the development site at Ockhuizenweg 14; 
  • to inform the initiator in writing about the 'preconditions and principles for the development site at Ockhuizenweg 14' and to request that a detailed plan be drawn up that implements these.

7 Preconditions and principles Ockhuizenweg 10 

Since 2018, Merks toilet trailer rental has been located at Ockhuizenweg 10. The initiator wants to use his location for the construction, rental, and storage of toilet trailers. To this end, the existing greenhouses will be demolished, the existing shed will be retained, and an additional storage shed will be built at the rear of the site. This will be integrated into the landscape.

The council decides:

  • to establish the 'preconditions and principles for the Ockhuizenweg 10 development site' for the redevelopment of the Ockhuizenweg 10 development site; 
  • to inform the initiator in writing about the 'preconditions and principles for the development site at Ockhuizenweg 10' and to request that a detailed plan be drawn up that implements these.

8 'Development vision for De Breeakker - northern section -' and partial withdrawal of 'preferential right for De Breeakker'

By decision of April 20, 2023, to establish a right of first refusal pursuant to Article 4 of the Municipalities' Right of First Refusal Act (Wvg) on part of the immovable property in the Breeakker area in Son en Breugel, the municipal council indicated that it wanted to take a decision at the end of 2024 on a development plan (development vision) for this location and the possible consequences for the 'Breeakker' area of preemptive rights.
Since then, an action plan has been implemented to fulfill the municipal council's wishes, and the "Breeakker Development Vision - northern part" has been drawn up. The vision will be presented to the council for approval. Now that the development vision shows that some of the real estate subject to a right of first refusal does not stand in the way of the intended development of the area, the municipality no longer has an interest in continuing to impose a right of first refusal on the real estate in question. This gives rise to a proposal to the council to withdraw the right of first refusal for a number of properties.

The council decides:

  1. to adopt the council proposal "Development vision for De Breeakker - northern section" as a framework document for further elaboration and discussions, and to submit this council proposal to the municipal council for a decision;
  2. to use the "Ontwikkelvisie de Breeakker - noordelijk deel -" (Development Vision for De Breeakker - northern section) as a framework for further elaboration for the purpose of amending the environmental plan so that the established right of first refusal, which applies until April 20, 2026, can be maintained if necessary;
  3. to use the "Development Vision for De Breeakker - northern section" in discussions with the owners and limited rights holders of the real estate on which the right of first refusal is or remains established, as the municipal framework of choice;
  4. to use the "Development Vision for De Breeakker - northern section" in discussions with prospective buyers of buildings/plots/real estate from the owners and limited rights holders of the real estate on which the right of first refusal is or remains established, as the municipal framework;
  5. Based on the "Development Vision for Breeakker - northern section" to adopt the council proposal 'Partial withdrawal of the right of first refusal for the Breeakker area' and to submit this council proposal to withdraw the right of first refusal on part of the immovable property based on the 'Development Vision for De Breeakker - northern section' to the municipal council for decision-making.

9 Permit to establish a special crematorium pursuant to Article 53 of the Burial Act 

On July 19, 2024, the council received an application for a permit under Article 53 of the Burial Act for the establishment of a special crematorium. The application concerns the location Noorderlicht 1 in Son en Breugel. The proposed decision to grant the permit was available for inspection from August 26, 2024, to September 24, 2024. There is no reason to change the proposed decision. The permit can be granted. 

The council decides to grant a permit for the establishment of a special crematorium on the basis of Article 53 of the Burial Act on the Noorderlicht 1 plot in Son en Breugel.

10 Answers to questions from the PvdA political party Accessibility of the Dommelhuis

Written questions have been asked about access to the Dommelhuis.

The council decides to adopt the answers to written questions submitted by the PvdA/GroenLinks political group regarding the accessibility of the Dommelhuis.

11 Vision for Work Locations in Southeast Brabant 

New programming for work locations is being prepared in the Southeast Brabant region. To this end, the 21 municipalities, in collaboration with the province and water boards, have drawn up a long-term vision for work locations in Southeast Brabant. This forms the basis for the elaboration of the programming. The Vision for Work Locations in the Eindhoven Metropolitan Region is ready to be adopted by all municipal councils in the region.

The College decides to propose to the City Council: 

  1. To adopt the 'Vision work locations Eindhoven Metropolitan Region, version 4.1'; 
  2. take note of the Implementation Strategy and the draft Implementation Agenda for the Regional Programming of Work Locations in Southeast Brabant. 
  3. To terminate the financial arrangement associated with the programming of workplaces SGE.

12 Electric charging in Son en Breugel - Charging plan 

In the 2022–2026 administrative agreement, we have indicated that, as a municipality that values sustainability and a clean living environment, we want to promote electric mobility. A local charging plan needs to be drawn up to meet the increased demand for public charging stations. This will provide clarity to residents, businesses, and visitors about the considerations behind
new charging stations are being installed. The long-term goal is to reduce greenhouse gas emissions such as CO2.

The council decides to propose to the municipal council that it adopt the vision on charging and the charging policy as set out in 'Electric charging in Son en Breugel – Charging plan' and use this as a starting point for the further rollout of the public charging infrastructure.
