The college adopts the decision lists.

2. Decision on objection refusal of environmental permit / Hans Gaillard

On October 14, 2021, the college decides to refuse the environmental permit for changing a commercial building for storage units at the location Ekkersrijt 7304 in Son en Breugel. On November 1, 2021, the college receives a notice of objection from the objector against the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.

College Decision:

  • Refer to the opinion of the Objections Committee for the reasons for the decision.

4. Procurement plan Protected Housing 2023-2026 / Paul van Liempd

The Procurement Plan for Protected Living stems from the Regional Vision on Protected Living. It provides a translation of the regional vision into concrete requirements for the procurement procedure. These are then elaborated in a set of specific procurement documents. Because the Municipality of Eindhoven is responsible for the procurement process, the Municipality of Eindhoven should also be mandated to do so. Because the decentralization of Protected Housing has been postponed, Eindhoven remains responsible for the implementation of Protected Housing for the time being.

College Decision:

  1. To agree to the purchasing plan for Protected Housing:
    - On the basis of an open house procedure;
    - for a contract period of 3 years, with twice the possibility of extension for 1 year;
    - for the following forms of support based on the Wmo: a. Protected Housing, b. Protected Home 1 and 2 (with the option for the housing component) and c. Supported Independent Home.
  2. To agree to the granting of a mandate to the Municipal Executive of the Municipality of Eindhoven, each insofar as it concerns its powers, in accordance with the attached draft municipal gazette, to decide, on behalf of the Municipality of Son en Breugel, to enter into, amend or terminate agreements with service providers regarding customized sheltered living facilities (including carrying out selection and awarding), as referred to in decision point 1;
  3. Authorize the Mayor of the Municipality of Eindhoven to sign the agreements mentioned in decision point 2. Those agreements are also binding on the Municipality of Son and Breugel;
  4. Authorize the College of Mayor and Aldermen of the Municipality of Eindhoven, each insofar as its powers are concerned, to grant submandates to subordinates for the powers referred to in decision points 2 and 3;
  5. agree to instruct the Regional Administrative Consultation BW-MO to review the procurement documents resulting from the procurement plan for content before they are adopted by the procurement team;
  6. Agree to adopt budget indications for the period 2023- 2025 for both historical and new clients.

5. Aid request harmony 1st half 2021 / Jos de Bruin

Some time ago we received a request for support from Harmonie Pro Honore et Virtute for damages incurred during the corona crisis. In this college proposal we address the request along the criteria set forth in the grant regulations. On February 8, 2022, your college retained the proposal below. Further explanation was requested from the harmony, these questions were answered by letter on February 13, 2022. On February 21, 2022, a conversation took place with the president and treasurer of the harmony. This conversation revealed a difference of opinion on what is meant by damages suffered. The harmony believes that they did not receive a service for which they paid. The society has been unable to use the rented space(s) due to the forced closure of the Vestzaktheater, the urgent advice from the municipality was to continue to pay the rent. The members of the harmony did not receive any performance for the dues paid, the harmony also considers this to be suffered damage. The previous application of coronasteun of the harmony over the period 2020 was reviewed against the subsidy regulation coronasteun social organizations 2021 that your college adopted on April 6, 2021. The harmony submitted its 2nd application in the same manner as its previous application which was granted on the requested amount of missed income and continued expenses. At the time of the interview, the harmony's annual financial statements were not yet ready. We are unable to verify whether they are operating at a loss for 2021 and do not have sufficient funds to absorb the loss. We would like to ask the harmony to still submit financial statements for the year 2021. We can then assess whether the allocated corona grant was rightly received or take this into consideration when assessing a 3rd corona grant application.

The college decides on the basis of the "subsidy scheme coronasteun social organizations 2021" to support Harmonie Pro Honore et Virtute with an amount of € 9,744 and to cover the costs from the available corona reserves. The harmony still submits the 2021 annual accounts to determine whether there has been a loss-making operation due to the corona crisis.
