1. Non-public decision list and public decision list dated June 8, 2021 / Hans Gaillard
The college adopts the decision lists.
2. College proposal agenda DB June 22 / Hans Gaillard
The daily board of Dienst Dommelvallei includes the mayor and municipal secretary of the participating municipalities. It has been agreed between the municipalities and Dienst Dommelvallei that the agenda and related documents are discussed in advance in the collegiate meetings for information.
The college takes note of the agenda of the Daily Board of Service Dommelvallei of June 22, 2021.
3. Environmental permit for building shelters / John Frenken
An application for an environmental permit has been submitted for the construction of 4 shelters on a plot at De Kuilen in Son en Breugel. There is a conflict with the Provincial Regulation.
College Decision:
- To deny the application for environmental permit for the construction of 4 shelter huts on a plot at De Kuilen;
- set the amount of the fees at €691.79
4. Motion no-cure-no-pay agencies VNG congress 2021 / Jan Boersma
Due to the increasing number of objections by no-cure-no-pay agencies and the associated costs and legalization, the implementation of the WOZ is under pressure. By supporting this motion, we place this issue on the VNG agenda and call attention to the feasibility of the WOZ.
The college decides to support the motion "Objections WOZ via no-cure-no-pay cost the community a lot of time and money!" at the UNG congress on June 16, 2021.
5. Policy Rule Financial compensation for persons with a chronic illness or disability - Municipality of Son and Breugel / Paul van Liempd
For low-income residents who pay a co-payment for the Wmo or have paid the full deductible under the Health Insurance Act for 3 consecutive years, an allowance is provided. Such an arrangement is already in effect from 2015. By not referring in the new regulation to the year to which it relates, it no longer needs to be determined annually.
The college decides to adopt the policy rule Financial allowance for persons with a chronic illness or disability - Municipality of Son and Breugel.
6. Decision on objection withdrawing right to assistance / Paul van Liempd
On January 18, 2021, the College decides to revoke the right to assistance under the Participation Act as of September 1, 2020. An amount is also recovered on the basis of Article 58(1) of the Participation Act. On January 22, 2021, the college receives a notice of objection from the objector against the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.
College Decision:
- Declare the objection unfounded;
- uphold the contested decision;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
7. Decision Wob request / Paul van Liempd
On April 23, 2021, the college receives a request under the Open Government Act (Wob). All communications and documents regarding the departure of the town clerk are requested. The request has been reviewed under the Wob.
College Decision:
- make a decision on the Wob request;
- To disclose part of the requested documents, with the exception of personal data pursuant to Article 10(2)(e) of the Wob and information that could lead to disproportionate prejudice to persons concerned pursuant to Article 10(2)(g) of the Wob, in accordance with the attached decision;
- To refuse disclosure of part of the requested documents pursuant to Article 10(2)(g) of the Wob and Article 11(1) of the Wob, in accordance with the attached decision.
8. Annual accounts 2020 PlatOO / Jos de Bruin
School Board PlatOO, in accordance with its bylaws, submits the 2020 annual report to the municipality for consultation. The financial statements are healthy and do not raise any questions at this time.
The College:
- Notes the 2020 annual report of school board PlatOO;
- Informs the City Council of this through the next Council Information Letter.
9. Political Evening and the list of commitments council meeting June 17, 2021 / Hans Gaillard
The college discusses the documents scheduled for the June 17 political evening.
10. B&W advisory note (re)development site Bijenlaan 60 / John Frenken
On December 22, 2020, a plan initiative was presented to your college for the Bee Avenue 60 site. The initiative envisages the realization of a number of temporary housing units for the duration of 25-30 years, in which, in addition to deployment of its own land, it was also requested to deploy the surrounding municipal land in the form of lease/rent. The college was in favor of such a temporary housing initiative and the deployment of the municipal lands in the form of lease/rental with the duration of up to 30 years. It also beautifully fulfills the amendment "Prefab housing" unanimously adopted by the council on November 11, 2020. With this, in consultation with the initiator, a number of preliminary investigations have been carried out and conversations have been held, which have led to the attached plan proposal in the form of a request in principle.
The college decides to:
- Agree in principle to the initiative to definitively move towards a temporary housing project on and around the Bee Avenue site, whereby the municipal land is used via lease and the initiator carries out all the work and bears all the costs (as per option 2);
- Offer the council the plan initiative for an "image-forming discussion" during political evening;
- to pick up a final draft after the imaging discussion and set a final price.
11. Request for relief from Corona Fund / Paul van Liempd
Relief based on the Corona Fund has been requested. The Corona Fund was established to grant relief in special individual cases. These must be cases where no claim can be made under other schemes. It has been judged that the applicant does not qualify for an allowance on the basis of the Corona Fund because there are other possibilities.
The College decides to deny the petitioner's request for relief under the Corona Fund and to advise the petitioner of outstanding options.
12. Temporary housing elementary schools the Rainbow/Crommen's Corner / Jos de Bruin
For the relocation of the students of De Krommen Hoek to De Regenboog, temporary housing must be realized. Units would be made available for this by a secondary school from Helmond. The budgeted amount of €101,705 for the temporary housing turns out to be insufficient with the adjustments for primary education. A more advantageous alternative is to rent temporary units for the Rainbow location. In addition to the contribution of €35,000 from school board PlatOO, this will require an additional credit of €146,434 to make up the difference. In order to meet the schedule it is not possible to wait for the council decision on the additional credit needed. The college bears the risk for making the additional credit available, so that the schools can move during the summer vacations and start the new school year in the temporary housing.
College Decision:
- before the council has made a decision on this matter, agree to the additional credit needed for the temporary housing of elementary schools the Rainbow and the Krommen Hoek and thus bears the risk;
- cover the capital cost of the additional credit of €146,434 for the temporary housing through the budget balance;
The college agrees in anticipation of the council proposal, to inform the council via a Council Information Letter.
13. Council proposal credit allocation new building De Bongerd/ Jos de Bruin
In order to meet the schedule of the tender, we need a council decision regarding the credit allocation for new construction of De Bongerd by the end of July 2021. Based on the space-statement made, we have been able to make an investment cost estimate. Given the previously described possibilities to cover the investment, it appears that it can be done within the available financial frameworks.
College Decision:
- To agree to the attached council proposal;
- To agree to the attached proposal for the July 1 imaging session;
- To ask the agenda committee to adopt the attached schedule regarding consideration by the city council so that by the end of July 2021 a decision is made on the crediting of the new building
