1. Non-public list of decisions and public list of decisions dated June 8, 2021 / Hans Gaillard

The college adopts the decision lists.

2. College proposal agenda DB June 22 / Hans Gaillard

The daily board of Dienst Dommelvallei includes the mayor and municipal secretary of the participating municipalities. It has been agreed between the municipalities and Dienst Dommelvallei that the agenda and related documents are discussed in advance in the collegiate meetings for information.

The council takes note of the agenda of the Executive Committee of Dienst Dommelvallei dated June 22, 2021.

3. Environmental permit for the construction of shelters / John Frenken

An application for an environmental permit has been submitted for the construction of four shelters on a plot of land on De Kuilen in Son en Breugel. This is in conflict with the Provincial Regulation. 

College Decision:

  1. to refuse the application for an environmental permit for the construction of four shelters on a plot of land at De Kuilen;
  2. set the amount of the fees at €691.79

4. Motion on no-cure-no-pay agencies VNG congress 2021 / Jan Boersma

The increasing number of objections by no-cure-no-pay agencies and the associated costs and legalization are putting pressure on the implementation of the WOZ. By supporting this motion, we are placing this topic on the VNG agenda and drawing attention to the feasibility of the WOZ.

The council decides to support the motion "WOZ objections via no-cure-no-pay cost the community a lot of time and money!" at the VNG congress on June 16, 2021.

5. Policy rule Financial compensation for persons with a chronic illness or disability – Municipality of Son en Breugel / Paul van Liempd

Residents on low incomes who pay a personal contribution for the Social Support Act (Wmo) or who have paid the full personal risk under the Health Insurance Act (Zvw) for three consecutive years are eligible for compensation. Such a scheme has been in force since 2015. By not referring to the year to which it relates in the new scheme, it no longer needs to be determined annually.

The council decides to adopt the Policy Rule on Financial Compensation for Persons with a Chronic Illness or Disability – Municipality of Son en Breugel.

6. Decision on objection to withdrawal of right to social assistance / Paul van Liempd

On January 18, 2021, the council decides to withdraw the right to social assistance under the Participation Act as of September 1, 2020. An amount is also reclaimed on the basis of Article 58(1) of the Participation Act. On January 22, 2021, the council received an objection from the objector against the above decision. The objections committee recommended that the objection be declared unfounded and that the contested decision be upheld.

College Decision:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

7. Decision Wob request / Paul van Liempd

On April 23, 2021, the council received a request under the Government Information (Public Access) Act (Wob). The request was for all communications and documents relating to the departure of the municipal secretary. The request was assessed in accordance with the Wob.

College Decision:

  1. make a decision on the Wob request;
  2. to disclose part of the requested documents, with the exception of personal data pursuant to Article 10(2)(e) of the Wob and information that could lead to disproportionate harm to the persons concerned pursuant to Article 10(2)(g) of the Wob, in accordance with the attached decision;
  3. to refuse disclosure of part of the requested documents on the basis of Article 10(2)(g) of the Wob and Article 11(1) of the Wob, in accordance with the attached decision.

8. 2020 Financial Statements PlatOO / Jos de Bruin

In accordance with its articles of association, the PlatOO school board submits its 2020 annual report to the municipality for consultation. The financial statements are sound and do not currently give rise to any questions.

The College:

  1. takes note of the 2020 annual report of the PlatOO school board;
  2. will inform the municipal council about this in the next Council Information Letter.

9. Political Evening and the list of commitments from the council meeting on June 17, 2021 / Hans Gaillard

The council discusses the items on the agenda for the political evening of June 17.

10. Municipal Executive advisory memorandum on the (re)development of the Bijenlaan 60 / John Frenken site

On December 22, 2020, a plan initiative for the location at Bijenlaan 60 was presented to your council. The initiative involves the construction of a number of temporary homes for a period of 25-30 years, whereby, in addition to the use of the owner's own land, a request has also been made to use the surrounding municipal land in the form of lease/rental. The council was positive about such a temporary housing initiative and the use of municipal land in the form of lease/rental for a maximum period of 30 years. It also beautifully fulfills the 'Prefab Homes' amendment unanimously adopted by the council on November 11, 2020. In consultation with the initiator, a number of preliminary studies were carried out and discussions were held, which led to the accompanying plan proposal in the form of a request in principle. 

The college decides to:

  1. in principle, to agree to the initiative to definitively work towards a temporary housing project on and around the Bijenlaan site, whereby the municipal land will be used on a leasehold basis and the initiator will carry out all the work and bear all the costs (in accordance with option 2);
  2. to present the plan initiative to the council for an "informative discussion" during the political evening;
  3. after the exploratory meeting, to finalize the details and determine a final price.

11. Request for compensation from the Corona Fund / Paul van Liempd

A request has been made for compensation from the Corona Fund. The Corona Fund was established to grant compensation in exceptional individual cases. These must be cases in which no claim can be made under other schemes. It has been assessed that the applicant is not eligible for compensation from the Corona Fund because other options are still available.

The council decides to reject the applicant's request for compensation from the Corona Fund and to inform the applicant of the options still available.

12. Temporary accommodation for De Regenboog/Krommen Hoek primary schools / Jos de Bruin

Temporary accommodation must be found for the pupils moving from De Krommen Hoek to De Regenboog. Units would be made available for this purpose by a secondary school in Helmond. However, the €101,705 budgeted for the temporary accommodation appears to be insufficient given the adjustments required for primary education. A more economical alternative is to rent temporary units for the De Regenboog location. In addition to the €35,000 contribution from the PlatOO school board, an additional credit of €146,434 is needed to cover the difference. In order to meet the schedule, it is not possible to wait for the council's decision on the additional credit required. The council bears the risk of making the additional credit available so that the schools can move during the summer holidays and start the new school year in the temporary accommodation.

College Decision:

  • before the council has made a decision on this matter, to agree to the necessary additional credit for the temporary accommodation of the Regenboog and Krommen Hoek primary schools and thereby bear the risk;
  • to cover the capital costs of the additional credit of €146,434 for temporary accommodation via the budget balance;

In anticipation of the council proposal, the college agrees to inform the council via a Council Information Letter.

13. Council proposal for credit vote on new construction De Bongerd/Jos de Bruin

In order to meet the tender schedule, we need a council decision at the end of July 2021 regarding the credit vote for the new construction of De Bongerd. Based on the space statement that has been drawn up, we have been able to make an investment cost estimate. Considering the options for covering the investment described above, it appears that this can be done within the available financial frameworks.

College Decision:

  1. to approve the attached council proposal;
  2. to approve the attached proposal for the exploratory session on July 1;
  3. to request the agenda committee to adopt the attached schedule for discussion in the municipal council so that a decision can be made by the end of July 2021 on the credit vote for the new building
