1. Non-public list of decisions and public list of decisions dated September 7, 2021 / Hans Gaillard
The board adopts the list of decisions.
2. Update to the Joint Arrangement for the Brabant-Zuidoost Safety Region / Hans Gaillard
The current Joint Arrangement for the Brabant-Zuidoost Safety Region has been in force since January 1, 2014. It is appropriate to implement a number of technical (legal) amendments to this arrangement.
At the meeting of the VRBZO General Board on July 7, 2021, it was decided to initiate the update procedure with the participating municipalities.
College Decision:
- to approve the Council proposal to update the Joint Arrangement for the Brabant-Zuidoost Safety Region, in which the following decision point is submitted to the council:
- to grant the council permission to approve the update of the Joint Arrangement for the Brabant-Zuidoost Safety Region.
- to agree to the submission of the council proposal to the council via the agenda committee during the exploratory political evening on October 7, 2021;
- to agree to the adoption of an amended Joint Regulation for the Brabant-Zuidoost Safety Region in accordance with the draft regulation, following approval by the council.
3. Draft zoning plan Keske near Breugel and prior agreement / John Frenken
On September 15, 2020, the council approved the principle request for the construction of one detached house or two semi-detached houses behind Van der Elsenstraat 28 in Breugel on the Keske. In order to recover the costs of this plan and to confirm the principles, the preliminary agreement is now before us, along with the request to enter into it and to initiate the procedure for the draft zoning plan.
College Decision:
- to enter into the prior agreement with reference number 190117 with the initiator and to publish the business content of the agreement;
the draft zoning plan "Breugel; Keske ong," with plan ID IDN NL.IMRO.0848.BP406BREUGEL-ON01, to be made available for inspection after the agreement has been signed by all parties.
4. Decision on objection to not pruning a tree / Jan Boersma
A resident has been informed that a municipal tree next to her garden will not be pruned. On June 4, 2021, the municipal executive received a letter of objection from this resident. The objections committee recommends that the letter of objection be declared inadmissible.
The municipal executive decides:
- Declare the objection inadmissible;
- Refer to the opinion of the Objections Committee for the reasons for the decision
5. Waste Management Ordinance and approval of accession to the Blink / Paul van Liempd joint arrangement
The current waste regulations were adopted by the municipal council in 2004. The regulations no longer comply with current legislation and regulations. The waste regulations are therefore being updated. At the same time, the municipal council is formally requesting permission, subject to conditions, to join the Blink joint arrangement.
College Decision:
- to submit the waste management ordinance to the municipal council for approval, subject to the consent of the municipal councils and executive committees of the participating municipalities within the Blink joint arrangement;
- formally request permission from the municipal council to join the Blink joint arrangement
6. Technical amendment to the Joint Arrangement for the Eindhoven Metropolitan Region 2021 / Hans Gaillard
The 2019–2022 Cooperation Agreement of the Eindhoven Metropolitan Region stipulates that experience should be gained with the renewed governance until the end of 2020 and that, based on this, an amended Joint Arrangement should be adopted in 2021. By amending the Joint Arrangement, the legal basis will be aligned with the way of working together that has taken shape in practice since the adoption of the 2019–2022 Cooperation Agreement.
College Decision:
- subject to the approval of the municipal council, to agree to the implementation of the (technically) amended Joint Arrangement for the Eindhoven Metropolitan Region;
- in anticipation of the entry into force of the Joint Regulation for the Eindhoven Metropolitan Region, to take note of the proposed (technical) amendments to the Statute of Consultative Bodies for the Eindhoven Metropolitan Region;
- until the council proposal is presented to the council during the exploratory political evening on October 7, 2021.
7. Coronavirus measures for fairs (attractions) 2021 / Hans Gaillard
The fair is scheduled to take place from October 8 to 12, 2021. The number of attractions and the applicable coronavirus measures are uncertain for the location with fairground attractions, and therefore the expected visitor numbers are also uncertain. There are two options for regulating visitor numbers.
The municipality is asked to indicate whether one or both (sub)options are acceptable and will therefore not prevent the event permit from being granted in this regard.
College Decision:
- agree to the option of a regulated setup of the location with fairground attractions (with fences around it, including counting at the entrance/exit) at the expense of the organization/operators;
- agree to an option of a 'freely accessible layout' of the location with fairground attractions (without fences around it) if the 1.5-meter measure expires on September 17, 2021, and no other restrictive measures apply;
for a children's fair (with shops) and of limited size, to agree to a 'freely accessible layout' of the location with fairground attractions (without fences around it) for the public, whereby visitor numbers are regulated using a protocol such as that used by the municipality of Zutphen.
8. Council decision to repeal the 2021 precario tax regulation / Jan Boersma
Due to Covid-19 (coronavirus), the hospitality industry had to remain closed until the end of April. As a result, no outdoor seating areas were set up during that period. In May, outdoor seating areas were only allowed to open during the day, and after May, hospitality businesses still had to comply with the 1.5-meter social distancing rule.
Fewer tables and chairs can be placed, or terraces have been expanded in size.
All these measures naturally also have financial consequences for entrepreneurs. It is proposed to give entrepreneurs some financial relief by not levying the precario tax.
The council approves the draft council proposal to repeal the 2021 precario tax regulation.
9. Responses to written questions from the VVD / Paul van Liempd
On August 25, 2021, the VVD political party submitted written questions to the council about forest management by Bosgroep Zuid. These questions are answered in the submitted letter.
The council agrees to respond to the VVD's written questions.
