1. Internal (non-public) list of decisions and public list of decisions dated June 7, 2022 / Hans Gaillard
The college adopts the decision lists.
2. Mandate Register 2022 / Hans Gaillard
The current mandate register was adopted by the municipal executive on April 6, 2021. The mandate register lists the powers for which the municipal executive and the mayor have granted mandates to employees of the organization. The mandate register is updated annually.
The council and the mayor decide, each within the scope of their powers:
1. to adopt the Mandate Register of June 14, 2022;
2. to revoke the Mandate Register of April 6, 2021.
3. Legal services agreement / Hans Gaillard
An agreement is entered into with Adriaanse van der Weel Advocaten for the provision of legal services.
The board decides to adopt the framework agreement for legal services in accordance with the draft.
4. Southeast Brabant Environment Day on June 17, 2022 / John Frenken
An Environment Day (formerly Development Day) is organized twice a year for each region in North Brabant. During an Environment Day, agreements are made between the municipalities, the province, and the water boards. These agreements may have legal consequences, for example for zoning plans (yet to be developed). The documents for the Environment Day on June 17 will be submitted to the council.
The council decides to take note of the program, the accompanying documents, and the annotations made for the Southeast Brabant Environment Day on June 17, 2022.
5. Political Evening Program and list of commitments June 16, 2022 / Hans Gaillard
The council discusses the items on the agenda for the political evening of June 16.
6. Urbanization Agreement SGE / John Frenken
In November 2020, the MIRT study on Urbanization and Accessibility in Brainport was finalized. This MIRT study details the regional urbanization and accessibility challenges up to 2040. The MIRT study is based on a regional target of
62,000 homes and 72,000 jobs by 2040. During the BO MIRT of 2020, this led to follow-up agreements between the national government and the region. One of these agreements is the drafting and signing of an Urbanization Agreement between the regional municipalities of SGE, the province of North Brabant, and the national government.
The council decides:
1. to adopt the SGE Urbanization Agreement;
2. to authorize the Alderman to implement changes following consultation with other organizations involved;
3. to inform the municipal council by means of the draft council information letter;
4. to authorize the portfolio holder for Spatial Planning to make adjustments to and publish the council information letter.
The mayor decides to assign the signing of the Urbanization Agreement to the portfolio holder for Spatial Planning of the municipality of Eindhoven so that he can sign the agreement on behalf of the SGE municipalities.
7. Development Strategy for Southeast Brabant / John Frenken
At the Southeast Brabant Environment Day on December 8, 2021, a mandate was given to develop a widely supported spatial development strategy for the entire Southeast Brabant region, building on the MIRT study Urbanization and Accessibility Brainport 2040 and the agreements made at that time, both internally and with other partners. In addition, the four sub-regions have each drawn up a (draft) development strategy, which also serves as a
basis for the development strategy drawn up for Southeast Brabant. This joint development strategy focuses on living, working, and mobility.
The council decides to approve the 'Development Strategy for Southeast Brabant: a balanced scale increase'.
8. Nomination for reappointment of Mr. F. van Engelen to the Supervisory Board of PlatOO / Jos de Bruin
On May 23, 2022, the PlatOO school board submitted a request to approve the reappointment of Mr. F. van Engelen for a second—and also final statutory term—as a member of the Supervisory Board. The municipal council has mandated the college to give its approval for such a reappointment.
The board approves the reappointment of Mr. F. van Engelen as a member of the Supervisory Board of the PlatOO school board.
9. Compensation for PlatOO extension Krommen Hoek for after-school care / Jos de Bruin
In 2008, the board of the Krommen Hoek school association secured financing for an extension to the school building to accommodate the legally required after-school care facility. In 2008, the municipal executive decided to pay the school board a
compensation for the costs incurred for the extension if the building were to be withdrawn from education before 2024. In connection with the new construction of the Krommen Hoek and Regenboog primary schools, the building was indeed withdrawn from education before 2024. In 2015, De Krommen Hoek, including the costs incurred for the extension, was taken over by the PlatOO school board. The costs incurred at the time for the extension
could not be fully and easily traced in connection with the takeover. It remains reasonably plausible that compensation of €50,118.54 remains for the residual book value of the extension. This amount will be paid to the PlatOO school board.
The council decides:
1. to pay compensation of €50,118.54 to the PlatOO school board for the remaining book value of the extension to the Krommen Hoek primary school for the purpose of after-school care;
2. to inform the municipal council of this in the next Council Information Letter.
