1. List of non-public decisions and list of public decisions dated October 5, 2021 / Hans Gaillard

The college adopts the decision lists.

2. Compensation for taking up position Population Screening / Hans Gaillard

Bevolkingsonderzoek Zuid has been granted permission to set up a mobile screening center for breast cancer screening. Fees have also been charged for this permission. The fee requested for the use of municipal land may be withdrawn.

The council decides to withdraw the fee charged for the use of municipal land for the breast cancer screening program.

3. SGE Administrative Platform October 15, 2021 / Hans Gaillard

The Administrative Platform of the Eindhoven Urban Area (SGE) is scheduled for October 15, 2021. With this advice, the agenda and underlying documents are submitted to the council for information.

The council takes note of the agenda and supporting documents for the Eindhoven Urban Area Administrative Platform dated October 15, 2021.

4. Public inspection of draft zoning plan and draft environmental permit for (re)development of Ekkersrijt 4088-4090 / John Frenken

On September 24, 2020, the municipal council decided to coordinate the decisions related to the redevelopment of the Ekkersrijt 4088-4090 site. The decisions for this redevelopment, such as the necessary zoning plan and the necessary environmental permits, must be taken in a coordinated manner. As part of the adoption procedure, the draft zoning plan and the draft environmental permit must be released for the period during which opinions can be submitted. The final plan and the prior exploitation agreement were adopted by your council on July 20, 2021.

College Decision:

  • take note of the draft zoning plan "Ekkersrijt; Entrance to Ekkersrijt;
  • take note of the draft environmental permit "Ekkersrijt; Entrance to Ekkersrijt" number S-HZ-2020-0324/21.0004053;
  • based on the "Notification memorandum for informal EIA assessment of the Entree van Ekkersrijt zoning plan" submitted by the initiator, to determine that there is no reason to proceed with an EIA procedure;
  • the draft zoning plan "Ekkersrijt; Entrance to Ekkersrijt" and the accompanying draft environmental permit "Ekkersrijt; Entrance to Ekkersrijt" number S-HZ-2020-0324/21.0004053 to be released for the further adoption procedure (publication for the purpose of obtaining opinions).

5. Second management report 2021 / Jan Boersma

The management report is an interim financial account from the college to the council. Only financial deviations (advantages and disadvantages) are explained in the management report. The alternative use of resources is also explained in the management report. This booklet does not explain delays or deviations in policy.

College Decision:

  • to approve the content of the present second management report for 2021 and to submit it to the municipal council for decision-making;
  • propose to the board that the negative result of the second management report of €214,522 be charged to the discretionary reserve;
  • to approve the various deposits and withdrawals from the reserves and provisions, as proposed in this second management report for 2021;
  • To approve the summary of investments and projects, including:
  •     a. an additional credit of €200,000 for the Omgevingswet charged to the discretionary reserve;
  •     b. an additional credit of €7,000 for the higher costs of purchasing a bus including a crane;
  • to approve the creation of the sustainability reserve and;
  • To agree to the council proposal.

6. Reimbursement of legal costs for objection to rejection of disabled parking permit / Paul van Liempd

On March 23, 2021, the council decides to reject the request for a disabled parking permit as a driver. On May 3, 2021, the council receives an objection from the objector against the above decision. On September 23, 2021, following a positive recommendation from Argonaut, it is decided to issue a disabled parking permit as a driver for a period of one year. Only the request for reimbursement of legal costs remains pending.

The court decides to grant the request for reimbursement of legal costs and awards an amount of €534.

7. Omgevingswet; release of draft environmental vision for Son en Breugel "Looking forward to a bright future!" for the purpose of a dialogue evening and period for submitting opinions / John Frenken

The Omgevingswet, which will come into force on July 1, 2022, stipulates that every municipality must have an environmental vision. Since mid-2019, with input from residents and organizations in Son en Breugel, chain partners (Safety Region, Water Board, province, Environmental Service, and Municipal Health Service), through image-building work sessions with the council and your college, and official input, content and design have been added to the draft environmental vision for Son en Breugel. The draft environmental vision "Environmental Vision Son en Breugel, OOg for a sunny future!" must be released within the framework of the legal requirements and adoption procedure for the period during which opinions can be submitted.

College Decision:

  • take note of the "draft environmental vision for Son en Breugel, OOg for a sunny future!" dated October 1, 2021;
  • to present the "Son en Breugel design environment vision, OOg for a sunny future!" (dated October 1, 2021) during the "Dialogue Evening" on November 2, 2021, and to release it for the period of public consultation starting November 4, 2021.

8. Memo September circular / Jan Boersma

The 2022-2025 Multi-Year Estimate states that the September circular on the 2021 municipal fund has not yet been processed. That budget is based on the May circular for 2021.
The September circular was published on September 27, 2021. With this memo, we are informing the council about the financial consequences and how these will be processed in the first budget amendment for 2022.

College Decision:

  • to approve the memo on the September circular 2021;
  • to present the memo on the September circular 2021 to the council and committee members.

9. Outdoor space design / Jos de Bruin

The design for the outdoor space in the Breugel Bruist planning area is largely complete. This design is an elaboration of the area vision adopted in December 2020. It is now proposed to hold an information/consultation round with stakeholders/local residents (October 14). It will then be submitted to the municipal executive for approval. The municipal executive's decision (including the results of the information/consultation round) will then be submitted to the council for information. Immediately afterwards, work will start on implementing the first parts.

The council decides to take note of the development of the public space associated with the Breugel Bruist project and the process leading to its final approval by the council.
