2 Updating the mandate register
The Omgevingswet will come Omgevingswet force on January 1, 2024. The mandate register must be amended accordingly. The mandate register lists the powers for which the municipal executive and the mayor have granted a mandate to employees of the organization. These employees are then authorized to act on behalf of the municipal executive and/or the mayor.
College Decision:
- to adopt the mandate register dated January 1, 2024;
- to revoke the mandate register dated July 11, 2023.
3 Contingency plan for archives
The purpose of this contingency plan is to prevent and limit damage during an emergency situation in which archives are at risk of being damaged or lost. You are requested to adopt the Contingency Plan for Archives and thereby implement one of the Key Performance Indicators (KPIs) from the Archive and Information Management Improvement Plan 2023-2024.
The board decides to adopt the Contingency Plan for archives.
4 Southeast Brabant Environment Day on December 13, 2023
An Environment Day is organized twice a year for each region in North Brabant. During an Environment Day, agreements are made between the municipalities, the province, and the water boards. These agreements may have legal consequences, for example for zoning plans (yet to be developed).
The council decides to take note of the agenda, the accompanying documents, and annotations made for the Southeast Brabant Environment Day on December 13, 2023.
5 SGE Administrative Platform dated December 15, 2023
The Administrative Platform of the Eindhoven Urban Area (SGE) is scheduled for December 15, 2023.

6 Draft zoning plan Triangle approx. 6 rvr
In 2022, the Municipal Executive agreed to the principle request to change the zoning of the Driehoek area to allow for residential construction. This was subject to a number ofRequirements. The initiator has developed the request into a new zoning plan, which Requirements the Requirements . The plan can be released for the procedure, a higher noise limit can be set, and the agreement can be entered into. The plan allows for the construction of six space-for-space homes. Four homes will be accessed via a courtyard and two via the Driehoek itself.
College Decision:
- not to prepare any (further) environmental impact assessment for the functional change and redevelopment of Driehoek ong. and the necessary amendment to the zoning plan;
- to approve the agreed 'Anterieure exploitatieovereenkomst Driehoek ong.' (Prior exploitation agreement Triangle area) with reference number 1935479, to proceed with signing it, and to publish the substantive content of the agreement;
- to approve the draft zoning plan "Buitengebied; Driehoek ong. 6 rvr" with plan ID NL.IMRO.0848.BP833BUITENGEBIED-ON01 and to make the plan available for inspection for a period of six weeks for comments, after the agreement has been signed by all parties;
- to approve the 'Draft Decision on Higher Limit Value Triangle approx. 6 rvr' and to make the draft decision available for inspection for a period of six weeks for comments;
- publish these decisions through the usual channels.
7 Extension of occupational health and safety services
On January 1, 2022, the Dommel Valley organizations entered into a two-year partnership with occupational health and safety service ArboNed, with the option to extend the agreement twice for two years. Evaluations took place in April 2022 and May 2023. The agreement ends on January 1, 2024.
College Decision:
- to extend the service agreement with occupational health and safety service ArboNed for two years (from January 1, 2024, to January 1, 2026);
- terminating the structural deployment of the sustainable employability coach, thereby freeing up health and safety resources;
- to use part of the health and safety funds that are being released to organize a Social Medical Consultation (SMO).
8 Housing Regulation 2024-2027
In the Eindhoven Urban Area, there is a joint urgency scheme for vulnerable groups who are given priority for social housing. This urgency scheme is contained in the 'Housing Regulation 2020-2023'. This ordinance expires on December 31. Due to a number of issues that still need to be worked out and upcoming new legislation, the update of the ordinance will take a little longer. To ensure that urgent cases can still be granted after January 1, 2024, it is recommended that the city council be asked to re-adopt the Housing Regulation.
College Decision:
- to submit the council proposal regarding the 'Housing Regulation for the Municipality of Son en Breugel 2024-2027' to the municipal council for decision-making;
- to establish the mandate scheme and mandate list for the implementation of the Housing Regulation;
- to adopt the Rules of Procedure for the Urgency Committee.
9 Methodology Budgetary regularity of the 2023 financial statements
Due to developments relating to budgetary regularity for the 2023 financial statements, it is desirable that the municipal council take an additional decision when adopting the 2023 audit protocol.
College Decision:
- To take note of the Budgetary Legality of the 2023 financial statements of the municipality of Son en Breugel;
- Request the audit committee to add the following to the council proposal for the audit protocol, decision point 3: Adopt the agreements as laid down in the "Procedure for budgetary regularity of the 2023 financial statements of the municipality of Son en Breugel."
10 Informing the council about sustainability policy
The municipality of Son en Breugel has ambitious goals in the areas of climate and sustainability. In recent years, the municipality has been working hard to achieve these goals. At present, there is no overarching sustainability policy, but there is a need for one. That is why work has begun on drafting a new sustainability policy. The municipal executive will inform the council about this.
College Decision:
- draw up a new sustainability policy;
- inform the city council about the start of drafting a new sustainability policy.
11 Amendment to the general designation decision APV municipality of Son en Breugel 2022
In the General Designation Decree APV municipality of Son en Breugel 2022, two locations have been designated for billboards. These billboards can be used for expressing opinions and making announcements. One of the locations will be changed. The billboard at Pieter Brueghelplein will be moved to Van Gentlaan, near Ruijterstraat.
The council decides to adopt the Amendment to the General Designation Decree APV municipality of Son en Breugel 2022.
12 Ockhuizenweg 9 - 18
In 2023, the municipality purchased the locations at Ockhuizenweg 9 and 18 for development. Ockhuizenweg 9 will become a development site for a maximum of 52 homes, including one existing home and one home added to the Ockhuizenweg ribbon. A maximum of 50 homes will be built on the land behind the current company home. At Ockhuizenweg 18, the company home will be converted into a private home. To make this legally possible in terms of planning, the mayor and aldermen must release the draft zoning plan for public inspection. They will do this by making the plan available for inspection for six weeks. We are now presenting an unfinished draft for public inspection so that we can be sure that we can continue with the plan once the area vision has been adopted. It is certain that we cannot do this with a change to the environmental plan before we have a municipality-wide environmental plan (expected in 2025), and it is unclear whether this is possible with an environmental plan activity outside the plan (BOPA).
College Decision:
- the draft zoning plan "Buitengebied; Ockhuizenweg 9-18," with plan ID IDNNL.IMRO.0848.BP832BUITENGEBIED-ON01, will be available for inspection for a period of six weeks for comments;
- that no Environmental Impact Assessment (EIA) needs to be prepared for this development, because significant adverse effects on the environment can be ruled out.
13 Subsidy for Son Swimming Pool 2024
The council is implementing the Swimming Pool Facility Motion and has decided to propose to the municipal council that €175,000 be made available for the year 2024, which will enable a public swimming facility to be maintained in 2024. In addition, during the 2025-2028 budget discussions, a proposal will be presented for a swimming pool facility in Son en Breugel.
The board decides to propose to the council:
- to make a contribution of €175,000 available for the maintenance of a public swimming facility in 2024;
- to make €40,000 available for the purpose of conducting a study into the prospects of a swimming pool facility in Son en Breugel.
- if, when discussing the budget, the council decides not to make any contribution available after 2024, to make a one-off contribution available to Zwembad Son B.V. by way of phasing out;
- to charge the costs referred to in decision points 1, 2, and 3, the latter insofar as these costs are incurred, to the discretionary reserve.
14 Use of municipal land at Van Hallstraat 17
The piece of municipal land adjacent to the garden belonging to the house at Van Hallstraat 17 has been unlawfully occupied by the residents. In addition, the piece of land at Van Hallstraat 17, zoned as 'green space', has been converted into a garden. It is proposed that the piece of land in question be sold to the owners of the house, thereby remedying the unlawful situation.
The council decides:
- to sell the piece of municipal land adjacent to the side of the backyard of the house at Van Hallstraat 17 to the owners of this house for a land price of €161 per m2;
- to approve the draft agreement for the sale of the municipal land at Van Hallstraat 17.
15 Letter from VNG regarding general payment
The municipality of Son en Breugel is disproportionately affected by cuts to the general subsidy for the number of non-residential properties located in the municipality. We want the Association of Netherlands Municipalities (VNG) to take a strong stance in correcting this systemic error.
The council decides to adopt the draft letter addressed to the Association of Netherlands Municipalities (VNG) and to have it sent on behalf of theAlderman .
16 Subsidy rates for VVE childcare places and PM-er in the VE 2024
For a number of years now, the municipality of Son en Breugel has been providing subsidized childcare for toddlers with (or at risk of) a (language) delay and for toddlers whose parents are not eligible for childcare allowance. For this subsidized provision, the municipal executive sets the (subsidy) rates for these childcare places each year. In addition, as of January 1, 2022, municipalities are required to contribute to the Childcare Organizations Fund (
)
for childcare organizations that offer preschool education (VE), for the pedagogical policy officer (PM-er) in the VE.
College Decision:
- to set the subsidy rate for VE toddler care for 2024 at €11.73 per hour;
- to set the subsidy rate for pedagogical staff in early childhood education for 2024 at €47.63 per hour.
