The college adopts the decision lists.
2 Update of mandate register
On January 1, 2024, the Omgevingswet will come into force. The mandate register must be adjusted accordingly. The mandate register lists powers for which the college and mayor have granted mandates to employees of the organization. These employees are then authorized to act on behalf of the college and/or the mayor.
College Decision:
- To adopt the mandate register dated January 1, 2024;
- To revoke the mandate register dated July 11, 2023.
3 Calamity plan archives
The purpose of this contingency plan is to prevent and limit damage during an emergency situation where archives are damaged or in danger of being lost. It is requested that the Archives Emergency Plan be adopted, thereby implementing one of the Critical Performance Indicators (KPIs) from the Archives and Information Management Improvement Plan 2023-2024.
The college decides to adopt the Archive Emergency Plan.
4 Environment Day Southeast Brabant d.d. Dec. 13, 2023
An Environment Day is organized twice a year for each region in North Brabant. During an Environment Day, agreements are made between the municipalities, the province and the water boards. These agreements can have legal consequences, for example for (yet to be developed) zoning plans.
The college decides to take note of the agenda, related documents and made annotations for the Environment Day Southeast Brabant dated December 13, 2023.
5 SGE Administrative Platform dated December 15, 2023
The Administrative Platform of the Eindhoven Urban Area (SGE) is scheduled for December 15, 2023.
The college takes note of the agenda and underlying documents for the Administrative Platform of the Urban Area Eindhoven dated December 15, 2023.
6 Draft zoning plan Driehoek ong. 6 rvr
In 2022, the College of B&W approved the request in principle to change the zoning at the Triangle to allow residential development. This under a number of Requirements. Initiator has elaborated the request into a new zoning plan, in which the Requirements are incorporated. The plan can be released for the procedure, establish a higher limit value for noise, and enter into the agreement. The plan allows for the construction of six space-for-space homes. Four homes will be accessed via a courtyard and two via the Triangle itself.
College Decision:
- For the change of function and redevelopment of Driehoek ong. and the amendment of the zoning plan required for that purpose, no (further) environmental impact assessment should be drawn up;
- To agree to the agreed "Anterieure exploitatieovereenkomst Driehoek ong." with reference 1935479, to proceed to the signature and to publish the business content of the agreement;
- To agree to the draft zoning plan "Buitengebied; Driehoek ong. 6 rvr" with plan IDN NL.IMRO.0848.BP833BUITENGEBIED-ON01 and to make the plan available for public inspection for a period of six weeks for views, after the agreement has been signed by all parties;
- To approve the "Draft decision on higher limit value Driehoek ong. 6 rvr" and to make the draft decision available for inspection for a period of six weeks for views;
- publish these decisions through the usual channels.
7 Extension of health and safety services
On January 1, 2022, the Dommelvallei organizations entered into cooperation with arbodienst ArboNed for the duration of 2 years, with the option to extend the agreement up to 2 times for 2 years. An evaluation took place in April 2022 and May 2023. The agreement ends on January 1, 2024.
College Decision:
- To extend the service agreement with health and safety service ArboNed for 2 years (from Jan. 1, 2024 to Jan. 1, 2026);
- ending the structural deployment of the coach sustainable employability, freeing up health and safety resources;
- to use part of the released Occupational Health and Safety funds to organize a Social Medical Consultation (SMO).
8 Housing Ordinance 2024-2027
In the Stedelijk Gebied Eindhoven, there is a joint urgency scheme for vulnerable groups who have priority for social housing. This emergency regulation is contained in the 'Housing Regulation 2020-2023'. This regulation expires on December 31. Due to a number of issues that still need to be further elaborated and upcoming new legislation, the updating of the regulation is taking a little longer. In order to still ensure that urgencies can be granted after January 1, 2024, it is advised to propose to the City Council that the Housing Ordinance be readopted.
College Decision:
- To submit the council proposal on the "Housing Ordinance Municipality of Son and Breugel 2024-2027" to the municipal council for decision;
- To adopt the mandate scheme and mandate list for the purpose of implementing the Housing Ordinance;
- To adopt the Rules of Procedure for the Urgency Committee.
9 Method of working Budget accuracy financial statements 2023
Due to developments related to budget legitimacy for the 2023 financial statements, it is appropriate for the City Council to make an additional decision when adopting the 2023 audit protocol.
College Decision:
- To accept for notification the Budgetary Compliance Statement 2023 Municipality of Son and Breugel;
- Request the audit committee to add decision point 3 to the council proposal for the audit protocol: To adopt the agreements as laid down in the "Method of working on budgetary legitimacy of the 2023 financial statements of the municipality of Son en Breugel".
10 Inform council sustainability policy
The municipality of Son en Breugel has ambitious goals in the field of climate and sustainability. In recent years the municipality has been working hard to achieve these goals. Currently there is no overarching sustainability policy, but there is a need for it. That is why the drafting of a new sustainability policy has started. The college will inform the council about this.
College Decision:
- establish new sustainability policies;
- To inform the City Council of the start of drafting new sustainability policies.
11 Amendment general designation decree APV municipality of Son en Breugel 2022
In the General Designation Decree APV Municipality of Son en Breugel 2022, two locations are designated for billboards. These billboards can be used for posting expressions of opinion and announcements. One of the locations will be changed. The billboard at the location Pieter Brueghelplein will be moved to the location Van Gentlaan near the Ruijterstraat.
The college decides to adopt the Amendment General Designation Decree APV Municipality of Son and Breugel 2022.
12 Ockhuizenweg 9 - 18
The municipality purchased the Ockhuizenweg 9 and 18 sites for development in 2023. In doing so, Ockhuizenweg 9 will be a development site for up to 52 homes, including one existing home and one home added to the ribbon Ockhuizenweg. A maximum of 50 dwellings on the yard behind the current company home. At Ockhuizenweg 18 the company residence will be converted to a civilian residence. To make this legally planologically possible, the municipal executive must release the draft zoning plan for views. They do this by making the plan available for inspection for six weeks. We are now releasing an unfinished draft for public inspection so that we can be certain that we can go ahead with the plan after the area vision is adopted. In fact, it is certain that we cannot do this with an environmental plan amendment before we have a municipal-wide environmental plan (expected 2025) and it is unclear whether this is possible with a non-plan environmental plan activity (BOPA).
College Decision:
- To make the draft zoning plan "Buitengebied; Ockhuizenweg 9-18," with plan IDN NL.IMRO.0848.BP832BUITENGEBIED-ON01, available for public inspection for a period of six weeks for views;
- that an Environmental Impact Report (EIR) need not be prepared for this development because significant adverse environmental impacts can be ruled out.
13 Subsidy Swimming Pool Son 2024
The college implements Motion Swimming Pool Facility and decides to propose to the city council to make € 175,000 euros available for the year 2024 with which a public swimming facility can be maintained in 2024. In addition, a perspective for a swimming pool facility in Son and Breugel will be presented during the 2025-2028 budget discussion.
The college decides to propose to the council:
- To provide a contribution of €175,000 for the purpose of maintaining a public swimming facility in 2024;
- For the purpose of conducting a study on the prospects of a swimming pool facility in Son and Breugel, make available a sum of € 40,000.
- In the event that the council decides not to make a contribution available after 2024, to make a one-time contribution available to Zwembad Son B.V. by way of winding down;
- To charge the costs mentioned in decision points 1, 2 and 3, the latter to the extent that these costs arise, to the free-spending reserve.
14 Use of municipal land Van Hallstraat 17
The piece of municipal land, adjacent to the garden belonging to the house at the Van Hallstraat 17 has been unlawfully used by the residents. Also the piece of land at the Van Hallstraat 17 with destination 'Green' has been arranged as a garden. It is proposed to sell the piece of land in question to the owners of the dwelling, thereby eliminating the unlawful situation.
The college decides:
- To sell the piece of municipal land, adjacent to the side of the rear garden at the house on Van Hallstraat 17, to the owners of this house for a land price of €161 per m2;
- Agree to concept agreement for the sale of the piece of municipal land at 17 Van Hall Street.
15 Letter from VNG regarding general allowance
Municipality of Son and Breugel is being disproportionately cut from the general allowance for the number of non-residential properties located in the municipality. We want the VNG to make a strong case for correcting this misfortune.
The college decides to adopt the draft letter addressed to the UNG and have it sent on behalf of the Alderman Finance.
16 Rates of subsidy VVE child places and PM-er in the VE 2024
For a number of years, the municipality of Son en Breugel has provided a subsidized offer for toddlers with (a risk of) a (language) delay and an offer for toddlers whose parents cannot make use of the childcare allowance. For this subsidized supply, the college annually sets the (subsidy) rates for these child places. In addition, as of January 1, 2022, municipalities are required to provide a contribution to the
childcare organizations that offer pre-school education (VE), for the pedagogical policy officer (PM-er) in VE.
College Decision:
- Set the subsidy rate for VE preschool for 2024 at €11.73 per hour;
- Set the subsidy rate for the pedagogical employee in VE for 2024 at €47.63 per hour.
