3. Legalizing outbuildings Olen 7a
An informal care home has been built on the Olen 7a/7m property. This is not permitted under the zoning plan regulations. The maximum square footage for outbuildings has been exceeded. It is now proposed to Requirements from the zoning plan under Requirements .
The municipal executive has decided to grant approval for a deviation from the environmental plan for Olen 7a/7m through an off-plan environmental plan activity (BOPA) and under the following Requirements:
- A permit must be applied for within 4 months;
- landscaping is regulated;
- the number of m² of other buildings will be reduced to a maximum of 200 m²;
- the additional driveway will be removed;
- a soil survey is being conducted around the site of the assisted living facility.
4. Loan forgiveness Wolfswinkel
For many years, the Wolfswinkel Cemetery Foundation has managed the cemetery and funeral services in our municipality. This responsibility has now been taken over by Respectrum Son en Breugel BV, which operates the new crematorium and cemetery. The foundation has requested that the municipality forgive the portion of the loan that it is unable to repay.
The municipal executive decides:
- To agree to the waiver of the municipal loan to the foundation and to charge this to the provision of the Wolfswinkel subordinated loan. This completes the liquidation of the foundation;
- release the remaining provision to income.
5. Mobility collection-RIB
Mobility is a dynamic field. To keep the council informed, a consolidated Council Information Letter has been prepared that provides information on several current topics.
The Executive Committee has decided to approve the text on Mobility and include it in the next Council Information Letter.
6. Adopt green gray management plan
The Green-Gray Management Plan is a follow-up to the *Basis in Beeld* report. The management plan provides a practical and comprehensive implementation of the 2021 Green Policy Document. It includes agreements regarding the management of public green spaces, playgrounds, and paved areas. The guiding principle is to create a good living environment. The management plan aims for a clean, intact, and safe Son en Breugel, with a focus on healthy, biodiverse, and climate-resilient public spaces. An integrated approach to green, gray, and other disciplines—such as sewer systems and traffic—forms the basis for optimal management.
The municipal executive decides:
- Adopt the Green-Gray Management Plan 2025-2035;
- Adopt the text on the Green-Gray Management Plan and include it in the next council information letter.
7. Aldermanic pensions ABP
On January 1, 2028, all aldermanic pensions will be transferred to the ABP and all pension payments will no longer take place through the municipality but will be made through the ABP. A value transfer must take place. In order to estimate the amount to be transferred, we participated in a study initiated by the Ministry of the Interior and Kingdom Relations. These results are now known.
The college decides to adopt the text on Aldermanic pensions ABP and include it in the next council information letter.
8. Nyrstar discharge permit appeal.
An appeal has been filed on behalf of the municipality of Son en Breugel against the decision by the Province of (Belgian) Limburg to grant a discharge permit to the company Nyrstar. This decision upholds the appeal.
The Municipal Executive decides:
- uphold the appeal lodged against the decision of the province of (Belgian) Limburg to issue a discharge permit to the company Nyrstar;
- to be represented during the aforementioned proceedings against the province of (Belgian) Limburg by Hekkelman Advocaten (and Belgian lawyers acting on its behalf) and to authorize them to speak on behalf of the municipality and to do whatever they deem to be in the interest of the municipality;
- adopt the process decision.
