3. Legalizing outbuildings Olen 7a

On the plot Olen 7a/7m a home for informal care has been built. This is not allowed according to the rules of the environmental plan. The number of m2 of outbuildings is exceeded. Now it is proposed to deviate from the environmental plan under Requirements .

The college decides to grant cooperation to deviate from the environmental plan to Olen 7a/7m by means of an out-of-plan environmental plan activity (BOPA) and under the following Requirements:

  1. A permit must be applied for within 4 months;
  2. landscaping is regulated;
  3. the number of m² of other buildings is reduced to a maximum of 200 m²;
  4. the additional driveway will be removed;
  5. a soil survey is being conducted around the site of the assisted living facility.

4. Loan forgiveness Wolfswinkel

The Wolfswinkel Cemetery Foundation has taken care of the cemetery and funeral services in our municipality for many years. This task has now been taken over by Respectrum Son en Breugel BV, which operates the new crematorium and cemetery. The foundation has requested the municipality to waive the part of the loan they cannot repay.

The college decides:

  1. To agree to the waiver of the municipal loan to the foundation and to charge this to the provision of the Wolfswinkel subordinated loan. This completes the liquidation of the foundation;
  2. release the remaining provision to income.

5. Mobility collection-RIB

Mobility is a dynamic playing field. To inform the council, a bundled Council Information Letter has been prepared sharing information on several current topics.

The college decides to adopt the text on Mobility and include it in the next council information letter.
 

6. Adopt green gray management plan

The Green-Gray Management Plan is a follow-up to the Basis in Beeld report. The management plan contains a practical and integral elaboration of the Green Policy Document 2021. The management plan includes agreements regarding the management of public green spaces, playgrounds and paving. The starting point is a good living environment. The management plan focuses on a clean, whole and safe Son en Breugel with attention for a healthy, biodiverse and climate-adaptive public space. In which integral approach of green, gray and other disciplines such as sewerage and traffic is the basis for optimal management.

The college decides:

  1. Adopt the Green-Gray Management Plan 2025-2035;
  2. Adopt the text on the Green-Gray Management Plan and include it in the next council information letter.

7. Aldermanic pensions ABP

On January 1, 2028, all aldermanic pensions will be transferred to the ABP and all pension payments will no longer take place through the municipality but will be made through the ABP. A value transfer must take place. In order to estimate the amount to be transferred, we participated in a study initiated by the Ministry of the Interior and Kingdom Relations. These results are now known.

The college decides to adopt the text on Aldermanic pensions ABP and include it in the next council information letter.
 

8. Nyrstar discharge permit appeal.

An appeal has been lodged on behalf of the municipality of Son en Breugel against the decision of the province of (Belgian) Limburg to issue a discharge permit to the company Nyrstar. This decision ratifies the appeal lodged.

The college decides:

  1. uphold the appeal lodged against the decision of the province of (Belgian) Limburg to issue a discharge permit to the company Nyrstar;
  2. to be represented during the aforementioned proceedings against the province of (Belgian) Limburg by Hekkelman Advocaten (and Belgian lawyers acting on its behalf) and to authorize them to speak on behalf of the municipality and to do whatever they deem to be in the interest of the municipality;
  3. adopt the process decision.
