2. Decisions taken under mandate / Hans Gaillard

The College is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the College or the Mayor.

The board takes note of the overview of decisions taken in mandate week 19, 2021.

3. Decision on objection to environmental permit for construction / John Frenken

On December 16, 2020, the council decides to grant an environmental permit for the extension of a house. On January 27, 2021, the council receives an objection from the objector against the above decision. The objections committee recommends that the objection be declared unfounded and that the contested decision be upheld.

College Decision:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

4. Draft zoning plan Revision of residual green areas 2021 / John Frenken

In 2016, we started selling residual strips of land. One of the steps in this project is to bring the designated use into line with the actual use after sale. The 2021 Revision of the Zoning Plan for Residual Strips of Green Space provides for this legal translation.

The council decides to make the draft zoning plan "Revision of Green Residual Areas 2021," with plan ID IDN NL.IMRO.0848.BP155RESTSTROKEN-ON01, available for public inspection.

5. Council proposal Future Strategy Facilities and Events SGE / Jos de Bruin

The Facilities and Events portfolio holders' meeting at the SGE has drawn up a future strategy entitled "Groots! A high-quality and accessible range of facilities at the SGE." This future strategy will be submitted to the board for approval.

The council decides to submit the Future Strategy Great! Facilities and Events SGE to the council via a draft council proposal.

6. Annual report on compulsory education/RMC school year 2019-2020 / Jos de Bruin

Every year, the municipal council is informed about the implementation of the Compulsory Education Act. The municipal council is informed about the 2019-2020 school year via a section in the council information letter.

College Decision:

  1. take note of the regional annual report on compulsory education/RMC 2019-2020 Combating truancy and early school leaving;
  2. inform the municipal council by including the text from the annual report and the appendices (annual report fact sheetand VSV fact sheet) in the next Council Information Letter.

7. New decision on objection regarding a request for enforcement by Stichting Platform Keelbos / Hans Gaillard

On March 23, 2021, the District Court of East Brabant ruled on the appeal lodged by Stichting Platform Keelbos (hereinafter: the foundation). The court upheld the appeal, considering that the municipal executive had wrongly declared the foundation's objection to the rejection of its enforcement request inadmissible. As a result of the ruling, the municipal executive must take a new decision on the objection, addressing the substance of the foundation's objections.

College Decision:

  1. Declare the objection admissible;
  2. to declare the objection partly well-founded and partly unfounded and to inform the foundation of this in a decision;
  3. take the necessary traffic decision;
  4. to commission the drafting of an enforcement action plan;
  5. to include additional budget for enforcement in the policy document.
