2. Decisions taken in mandate / Hans Gaillard
The College is periodically informed of decisions made in mandate. The summary includes decisions made on behalf of the College or the Mayor.
The college takes note of the overview of decisions taken in mandate week 19, 2021.
3. Decision on objection to building permit / John Frenken
On December 16, 2020, the college decides to grant an environmental permit to expand a residence. On January 27, 2021, the college receives a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.
College Decision:
- Declare the objection unfounded;
- uphold the contested decision;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
4. Draft Zoning Plan Revision Restripes Green 2021 / John Frenken
In 2016, we started working on the sale of remnant strips. Within this project, one of the steps is to align the zoning with the use after the sale. The Zoning Plan Revising Residual Lanes Green 2021 provides this legal translation.
The college decides to submit for public inspection the draft zoning plan "Revision of Residual Lanes Green 2021," with plan IDN NL.IMRO.0848.BP155RESTSTROKEN-ON01.
5. Council proposal Future Strategy Provisions and Events SGE / Jos de Bruin
Future Strategy "Grand! A high-quality and accessible supply of facilities in the SGE" has been drawn up. This future strategy will be presented to the council for adoption.
The college decides to present the Future Strategy Grand! Amenities and Events SGE to the council through a draft council proposal.
6. Annual report on compulsory education/RMC school year 2019-2020 / Jos de Bruin
Annually, the City Council is informed about the implementation of the Compulsory Education Law. The City Council is informed about school year 2019-2020 through a paragraph in the council information letter.
College Decision:
- To take note of the Regional Annual Report on Compulsory Education/RMC 2019-2020 Combating school absenteeism and ESL;
- To inform the City Council by including the text from the annual report and appendices(annual report fact sheet and vsv fact sheet) in the next Council information letter.
7. New decision on objection regarding a request for enforcement from Platform Keelbos Foundation / Hans Gaillard
On March 23, 2021, the district court of East Brabant ruled on the appeal of Stichting Platform Keelbos (hereinafter: the foundation). The court upheld the appeal, considering that the college had wrongly declared the foundation inadmissible in its objection to the rejection of the enforcement request submitted by the foundation. Following the ruling, the college must issue a new decision on the objection, which must address the substance of the foundation's objections.
College Decision:
- Declare the objection admissible;
- Declare the objection partly well-founded and partly unfounded and inform the foundation in an order;
- make the required traffic decision;
- commission a plan of action for enforcement;
- bring in additional budget for enforcement at the time of the framework memo.
