1. Adoption of non-public decision list and public decision list b&w meeting dated August 4, 2020 / Hans Gaillard

The college adopts the decision list and the public decision list according to the drafts.

2. Request for enforcement regarding manure storage / Hans Gaillard

A request for enforcement has been received regarding a container for the purpose of storing manure. This container containing manure is located a short distance from the applicant's plot. Meanwhile, the container has been moved to another location on the parcel.
The request can be rejected.

College Decision:

  1. deny the request for enforcement;
  2. send the applicant the decision;
  3. send a completion letter to the owner of the manure storage facility.

3. Decision on objection rejection of application for urgency decision / John Frenken

On March 16, 2020, the college decides to reject the application for an urgency decision. On April 10, 2020, the college receives a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.

College Decision:

  1. Declare the objection unfounded;
  2. uphold the contested decision;
  3. Refer to the opinion of the Objections Committee for the reasons for the decision.

4. Apply coordination scheme ex art. 3.30 ff. Wro redevelopment Ekkersrijt 4088-4090 (Entrance of Ekkersrijt) / John Frenken

On December 02, 2019, the college received a request in principle from initiator for the location Ekkersrijt 4088-4090. The request in principle relates to the replacement and expansion of the current building for the realization of approximately 9,155m2 peripheral and large-scale retail establishment in the Home & Living branch, including the realization of parking spaces and layout of the surrounding public space. On April 14, 2020, the college agreed in principle to the redevelopment of this parcel and for this purpose established the necessary "preconditions and principles" that the initiator should take into account when developing the plan initiative. The initiator has requested application of the coordination scheme. It is proposed that the City Council be proposed to apply the coordination scheme under Article 3.30 et seq. of the Wro for this planning initiative.

The college decides, in preparation for the necessary legal-planological procedure, to propose to the municipal council to apply the coordination scheme ex art. 3.30 Wro for the redevelopment of the plan initiative on the parcel Ekkersrijt 4088-4090.

5. (Draft) zoning plan "Revision Provision Living 2019" and development site Boslaan 63 / John Frenken

Mr. Thunnissen, also on behalf of a number of local residents, has submitted a number of comments and/or questions to the college regarding the (draft) zoning plan "Revision Provision Living 2019" and the development site "Boslaan 63". Because the formal procedure against the draft zoning plan "Revision Provision Living 2019" has been completed, a substantive response is waived. With regard to the Boslaan location, no formal procedure is yet underway, so the response is informative only insofar as it concerns topics that have since been determined. The questions have been provided with a response in a letter.

The College:

  1. Notes the letter answering the questions to Mr. Thunnissen and local residents regarding the (draft) zoning plan "Review Determination Living 2019" and the development site "Boslaan 63";
  2. Decides to agree to answer the questions.

6. Development site 'Boslaan 63' in relation to the (draft) zoning plan "Revision determination living 2019; questions VVD group / John Frenken

The VVD group has submitted a number of questions to the college regarding the development site "Boslaan 63" in relation to the (draft) zoning plan "Revision Provision Living 2019". The questions have been answered in a letter. I

College Decision:

  1. Notes the letter answering questions to the council regarding the "Boslaan 63" development site in relation to the (draft) zoning plan
    "Revision Provision Living 2019";
  2. Decides to agree to answer the questions.

7. Decision on objection environmental permit deviating use of dwelling / John Frenken

On December 18, 2019, the college decides to grant an environmental permit for deviant use of a dwelling at Weserlaan 56 in Son en Breugel. On February 7, the college receives a notice of objection from the objector against the above decision.
The objection committee advises to declare the objection inadmissible. The objection was submitted outside the statutory six-week objection period.

College Decision:

  1. Declare the objection inadmissible;
  2. Refer to the opinion of the Objections Committee for the reasons for the decision.

8. Notice of views and zoning plan "Son Zuid; Begoniastraat" / John Frenken

The college has approved the development of 19 row houses on the Begoniastraat in Son en Breugel. To enable the realization of the homes, the draft zoning plan "Son Zuid; Begoniastraat" has been prepared and has been made available for the public inspection period (March 26, 2020 through May 06, 2020). The draft zoning plan was also submitted to, among others, the Province of Noord-Brabant and Waterboard de Dommel to give them the opportunity to respond to this draft zoning plan by means of an opinion. The period of views produced four responses. At the conclusion of this process, the zoning plan "Son Zuid; Begoniastraat" and the "Zienswijzennotitie ontwerpbestemmingsplan Son Zuid; Begoniastraat" can be presented to the municipal council for adoption.

College decision:

  1. To take note of the "views memo draft zoning plan Son Zuid; Begoniastraat";
  2. To take note of the draft zoning plan "Son Zuid; Begoniastraat";
  3. To seek the advice of the council's Ground Area Committee on the adoption of the "Zienswijzennotitie ontwerpbestemmingsplan Son Zuid; Begoniastraat" and the
    zoning plan "Son Zuid; Begoniastraat" in accordance with the draft council proposal and draft council decision;
  4. To propose that the council adopt the "Zienswijzennotitie ontwerpbestemmingsplan Son Zuid; Begoniastraat" and the zoning plan "Son Zuid; Begoniastraat".

9. Bridging agreement animal emergency response / Paul van Liempd

In late 2016, the municipality of Son and Breugel entered into an agreement with the Dutch Society for the Protection of Animals, for the basic provision of animal emergency assistance.
This agreement ends on December 31, 2020. This agreement may not be renewed thereafter. In its place, a bridging agreement will be concluded as of January 1, 2021. This is valid until the commissioning of the new building, which has yet to be built.

College Decision:

  1. To approve the Bridging Agreement Basic Animal Emergency Assistance 2020 between the Municipality of Son en Breugel and the Dutch Society for the Protection of Animals, effective January 1, 2021.

10. Extension of compensation scheme contracted target group transport / Paul van Liempd

To maintain target group transportation during the corona crisis, it was agreed at the national level that until June 1, 2020, contracted providers could be financially compensated. That measure has been extended until July 1, 2020. For the period thereafter, municipalities should make their own agreements to achieve customization. It is proposed to compensate the current carrier of the Wmo transport for the period from July 1 to September 1 for trips not driven. Arrangements will be made with the carrier for the period after September 1.

College Decision:

  1. To extend the term of compensation scheme for contracted target group transportation until July 1, 2020;
  2. Compensate the carrier for contracted Wmo transportation (PZN) for the period July 1 to September 30, 2020 by invoking the de minimis regulation. This is subject to a de minimis statement to be provided by PZN;
  3. for the period after September 1, not to make a decision until additional information is available from the Taxbus municipalities and after provincial coordination.
