1. Decision on objection decision Wob request / Hans Gaillard

On September 24, 2021, the college decides to disclose documents, except for personal data and personal policy opinions contained therein, in the context of a Wob request regarding reports of nuisance about the gay meeting place on Hoberglaan. On September 28, 2021, the college received a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be upheld and that the contested decision be amended, with the proviso that the council proposal "Gay Meeting Place Hoberglaan" be included in the reconsideration when making a decision on the objection. Otherwise, the contested decision may be upheld. The committee further recommends that the request for reimbursement of travel and subsistence expenses be granted.

College Decision:

  1. Declare the objection well-founded;
  2. Amend the contested decision with the proviso that the draft commission/council proposal "Gay Meeting Place Hoberglaan" be made public. Otherwise, the contested decision is upheld;
  3. Grant the request for reimbursement of travel and subsistence expenses;
  4. Refer to the opinion of the Objections Committee for the reasons for the decision.

2. Appointment of chairman and three members Appeals Committee / Hans Gaillard

The term of office of the chairman and members of the Objections Committee expires on March 29, 2022. The council is proposed to reappoint the current chairman and members for a two-year term.

The college decides to submit the council proposal "Appointment of chairman and three members of the Objections Committee" to the City Council.

3. Ensia BAG, BGT and BRO / Jan Boersma

A self-assessment is carried out annually on the set-up and operation of the basic registration of large-scale topography (BGT), the basic registration of addresses and buildings (BAG) and the Basic Registration of the Subsurface (BRO). In 2020, a center arrangement was established and the tasks in the field of BAG and BGT were transferred. These processes are running well and the minimum scores are met. The above does not yet apply to the BRO. The results of the self-assessment are contained in the accountability report self-assessment 2021. This report will be presented to the college for adoption

The college decides to adopt the 2021 accountability report, BAG, BGT and BRO.

4. Sonnius Park 2022 progress report / Jan Boersma 

Periodically, the current status of the development of the Sonniuspark residential area is presented to the council for information by means of a progress report. Presented to the college is the Sonniuspark 2022 Progress Report.

College Decision:

  1. To approve the contents of the Sonniuspark 2022 Progress Report and provide text mandate to Alderman Jan Boersma;
  2. To submit this progress report to the council for its information.

5. Draft amendment plan Buitengebied; Rooijseweg 61 / Jan Boersma

Rooijseweg 61 is currently still home to an intensive livestock farm. The owner wants to stop the agricultural activities and convert to living. This is possible with an amendment plan. The college has agreed to the principle request and has set preconditions. These have been incorporated into the draft amendment plan to legally regulate the change. It is now up to the college to release the plan for the procedure.

College Decision:

  1. To enter into the antecedent agreement marked 1101677 with promoter and to publish the substantive content of the agreement;
  2. To submit the draft amendment plan "Buitengebied; Rooijseweg 61", with plan IDN NL.IMRO.0848.BPWBUITENGEBIED-ON01 for public inspection, after the agreement has been signed by all parties.

6. Supervisory assessment housing permit holders 2nd half 2021 / Paul van Liempd

In the second half of 2021, the municipality of Son and Breugel did not meet the task assignment of permit holders to be housed. This is excusable.

College Decision:

  1. To agree to the text for the council information letter;
  2. to include the text in the next council information letter.

7. Region standard of commissioning / Paul van Liempd

A regional vision 'Standard of commissioning' has been drawn up by the procurement organization 10 for Youth, which is intended to be adopted by the municipal council. This document anticipates a bill that is pending in the second chamber (Wet verbetering beschikbaarheid Health voor jeugdigen), which includes on what scale municipalities will be obliged to purchase specialized forms of youth care. This could mean that procurement in Southeast Brabant must be scaled up to the level of the 21 municipalities.

College Decision:

  1. Agree to the regional Standard for Commissioning "A 10 for Youth" vision;
  2. Submit the regional vision to the City Council for adoption.

8. Non-public decision list and public decision list dated February 22, 2022 / Hans Gaillard

The college adopts the decision lists.

9. Weserlaan 56 / Hans Gaillard

On December 18, 2019, the college granted an environmental permit to deviate from the zoning plan for the purpose of housing four elderly people with mild dementia at 56 Weser Avenue. This included as a requirement in the permit that the initiator must be resident in the adjacent residence. The initiator has asked us to remove the regulation from the permit. She intends to move, as a result of which the requirement would no longer be met. It is recommended that the regulation be retained.

College Decision:

  1. uphold the relevant permit requirement
  2. inform the initiator in writing of the decision to uphold the requirement in the environmental permit.

10. Digital Amenities Board / Hans Gaillard

In line with the "Legal Status of Decentralized Political Officials Decree", the college provides council, committee and college members with information and communication facilities, in the form of laptops and related accessories, for the performance of their duties. Central to this is the provision of a secure digital facility and organising the digital support for council, committee and college members as efficiently as possible.

The college decides to make laptops available to council members, committee members and college members and notes:

  • That delivered hardware to council members, committee members and college members is under the management of Dommelvallei Service and under the mobile device security policy;
  • That mobile device security policies also apply to private devices that access our environments and data.

11. Budget 2022 - PlatOO / Paul van Liempd

School Board PlatOO, in accordance with its bylaws, has submitted the 2022 budget to the municipality for consultation. The college is proposed to take note of this.

College Decision:

  1. take note of PlatOO's 2022 budget and sees no need for further consultation;
  2. Agree to the text for the council information letter (under what will we do for it) and include it in the next edition.


12. Council information letter (RIB) Award De Bongerd / Jos de Bruin

The tendering procedure for MFA De Bongerd was recently completed and the award is now final. By means of the attached RIB, the council is informed and the webpage of Breugel Bruist is updated.

The College decides to adopt the RIB "Award winning design "The Bongerd" and send it to the City Council.
