What is it?
An informal care home is an independent dwelling (in or near an existing residence) in which all facilities are present. This home is intended for the person who receives informal care or the person who provides informal care. A maximum of 1 person may live in with the person who provides or receives informal care.
New rules for permit-free construction came into effect on November 1, 2014. In drawing up these new rules, the consequences of the aging population, the revisions in the Health and the increase in demand for informal care homes were taken into account.The new rules allow an outbuilding or part of the house to be used permit-free as an informal care home. However, there are Requirements associated with this possibility.
What to do.
To enable a home for informal care, an existing structure at a residence may be modified by adding living facilities such as a kitchen, bathroom and sanitary facilities. Upon termination of the informal care need, the facilities must be removed again. A home for informal care may also be built in the rear yard without a permit. However, the requirements for permit-free construction must be met. The requirement that the use of an accessory building (outside a distance of 4 meters from the ear-original main building) must be functionally subordinate to the dwelling is dropped.
Outside the built-up area the requirement for the maximum allowable area of accompanying structures is also cancelled. A condition is that it concerns a fully or partially relocatable informal care facility that does not exceed 100 m2. After termination of the informal care requirement, the relocatable informal care facility must be removed again.
