3 Letter of intent Sandwyck
The municipalities of Best, Meierijstad, Son en Breugel and Waterschap de Dommel conclude a letter of intent for cooperation within area process Sandwyck.
College Decision:
- Establish the objectives for cooperation within project area Sandwyck with the municipalities of Best, Meierijstad, Son and Breugel and Waterboard de Dommel in a letter of intent;
- share the letter of intent and goals for Sandwyck with the City Council in a council information letter;
- To request the Mayor to entrust the signing of the letter of intent to Alderman De Jong.
4 Decision on objection tree canopy
On July 2, 2024 the college decides not to issue an environmental permit for the felling of a tree on the plot, locally known as Hendrik Veenemanstraat 94 in Son en Breugel. On August 2, 2024, the college receives a notice of objection against the above decision. The Objections Committee recommends that the objection be declared unfounded and that the contested decision be upheld.
College Decision:
- Declare the objection unfounded;
- uphold the contested decision;
- Refer to the opinion of the Objections Committee for the reasons for the decision.
5 Management letter 2024
The auditor issued the management letter following the interim audit in recent weeks. The auditor's opinions in that management letter are accompanied by management commentary. The auditor's opinion on budget regularity affects the October 29, 2024 college decision on the council's 2024 audit proposal.
College Decision:
- Revoke the college decision dated October 29, 2024 on the council's 2024 audit decision for the 2024 budget legitimacy process section;
- accept the 2024 management letter for notification;
- adopt the management comments in the 20024 management letter;
- To accept the council proposal for audit 2024 for notification
6 Statement of defense Order under penalty Panther Avenue 8
On June 20, 2024, the college decides to impose an order under penalty for building the left front facade of the house at Panterlaan 8 in Son en Breugel without an environmental permit. On July 31, 2024, the college receives a notice of objection against the above decision. The Objections Committee advises to uphold the contested decision with adjustment of the motivation regarding the technical building activity and to reject the request for reimbursement of costs pursuant to Article 7:15 paragraph 2 of the Awb.
College Decision:
- Declare the objection well-founded;
- uphold the contested decision, subject to the amendment of the statement of reasons with respect to the construction activity;
- Reject the request for reimbursement of costs under Article 7:15 (2) Awb;
- To refer in part to the opinion of the Objections Committee for the reasons for the decision.
7 Environmental vision and "Son en Breugel Environmental Plan"
The Program Team Omgevingswet informs with the RIB 'Omgevingswet; stand van zaken d.d. November 2024 regarding the omgevingsvisie (next version), the (draft) "Omgevingsplan Son en Breugel" and other matters.
The college decides to inform the council via a RIB text about the state of affairs regarding the next version of the omgevingsvisie, our draft omgevingsplan Son en Breugel and other matters Omgevingswet.
8 Breeakker preferential right
To create better conditions for the development of the 'Breeakker' area (northern part), the council established a right of first refusal on April 20, 2023, pursuant to Article 4 of the Wvg. Establishing a preferential right allows the municipality to play an active and directing role in the implementation of its plans. By establishing a preferential right, an owner is in fact obliged, when he wishes to sell his immovable property or property, to first offer it for sale to the municipality. Based on that obligation, Stichting Woonbedrijf SWS.Hhvl offered the Registergoed property owned by it to the municipality by registered letter dated November 1, 2024. The Municipal Executive must decide within six weeks of receiving the invitation whether, in principle, the municipality is willing to purchase the Registergoed property against further Requirements to be agreed upon or to acquire it by virtue of another title. The Municipality decides to initiate talks on the amicable acquisition of the Registered Property with Woonbedrijf. This allows the negotiations to start. During the negotiations, Woonbedrijf and the Municipality will see if they can agree on the price and other Requirements.
College Decision:
- be willing, in principle, to purchase the Registrable Property from Woonbedrijf for Requirements to be agreed upon, or to acquire it by virtue of another title;
- to instruct to initiate talks on amicable acquisition of the Registry Property with Woonbedrijf;
- to instruct that, in parallel with the talks with Woonbedrijf referred to under decision point 2, talks should also be initiated with the prospective buyers Wooninc./Stayinc. desired by Woonbedrijf;
- prepare for the financial and management situation after purchase by the municipality;
- Inform the council of this decision through a RIB text;
- Agree to a budget of €49,000 for the first steps for the negotiation process and process this in the 1st administrative report 2025.
9 Sale of residual strips
An energy transition is underway in the Netherlands, which requires the energy network to be overhauled. For the municipality of Son en Breugel, Enexis has indicated that they have to increase the capacity of the grid and install a large number of transformers. According to initial expectations, they will also use green areas in the municipality for this purpose. This may conflict with the sale of the residual strips. Therefore, the proposal is to take the residual strips map offline and, with the exception of those already in progress, not to sell any more residual strips during the works.
The college decides to stop the sale of residual strips in principle until further notice.
10 Memorial
On July 25, 2024, an application for an environmental permit was submitted for the installation of a memorial. Several sites in the vicinity of the canal and bridge were investigated for this purpose. These locations are not suitable for placing the memorial. It is recommended that the applicant be suggested to find a suitable location elsewhere in the municipality.
The college decides to approve the draft letter to the applicant for the permit.
