3 Trial decision on summary judgment Dec. 4, 2024 in Wmo HH tender

Son en Breugel and Nuenen entered into a framework agreement in 2020 for the provision of Wmo Home Assistance to residents of our municipalities. As of January 1, 2025, both municipalities terminated this framework agreement due to the intention to participate in a new tender Wmo Household Assistance in cooperation with the municipalities of Nuenen, Geldrop-Mierlo, Waalre, Cranendonck and Heeze Leende (also called: Dommelvallei++). The procurement procedure started spring 2024, in August the college adopted a procurement strategy for this purpose. On October 14, just before the closing of the tender period, Actief HuisZorg B.V. and Archipel Rinette B.V. sued the contracting municipalities in summary proceedings. They believe that the domestic help rate offered (for non-zzp) is not realistic. At the hearing, scheduled for December 4, law firm Hekkelman in Nijmegen will put forward a defense on behalf of the defendant municipalities. The strategic advisor social domain of the municipality of Son en Breugel will be present at the hearing on behalf of the defendant municipalities. The enclosed procedural decision provides for the decision to conduct defense and the necessary authorizations for the persons attending the hearing on behalf of the municipalities.

The college decides to adopt the procedural decision, in connection with the defense of the proceedings brought by Actief Huiszorg b.v. and Archipel Rinette b.v. and the appointment of agents.

4 Development of trailer sites

The college has promised to keep the city council informed about developments regarding the caravan sites. A council information letter will be used to communicate the latest state of affairs.

6 Decision on objection rejection of application for urgency decision

On June 19, 2024, the college decides to reject an application for an urgency decision. On July 10, 2024, the college receives a notice of objection from the objector to the above decision. The Objections Committee recommends that the objection be upheld and that the contested decision be rescinded by granting a social urgency.

College Decision:

Declare the objection well-founded;
Revoke the contested decision by granting a social urgency;
Refer to the opinion of the Objections Committee for the reasons for the decision.

7 Regulation on measures Participation Act, IOAW, IOAZ and Wi2021

The current Regulation Measures Participation Act 2020 is no longer in line with national laws, regulations and case law. In the new Regulation Measures Participation Act, IOAW, IOAZ and Wi2021 Son en Breugel 2025 the necessary changes have been made. In addition, the enforcement framework of the Integration Act 2021 is also included in the new Regulation Measures Participation Act 2025. The current Regulation Integration 2022 has become redundant. It is proposed to adopt the new Regulation Measures Participation Act Son en Breugel 2025 and to repeal the Regulation Integration Son en Breugel 2022.
