What is it?

An environmental plan contains rules about the use of land and buildings on it. It is always about a specific area. The environmental plan provides you with answers to questions such as:

  • Is building or remodeling allowed in the area?
  • How may a piece of land be used?
  • May roads be built?
  • Are businesses allowed to locate in the area?
  • What building regulations apply, for example, to the (re)construction of a building?

If you want to use land or buildings differently from what is allowed in the environmental plan, the municipality can cooperate in some cases. This can be done by granting a deviation with a deviation procedure or by amending the environmental plan. The municipality is not obliged to cooperate with a deviation or amendment of an environmental plan.

Initiative Proposal

If your plan deviates from the environmental plan, you can submit an initiative proposal. We will then investigate the feasibility of your plan. You will receive a statement of principle from the municipal executive whether or not they are willing to cooperate with your plan. Change or deviate

If you are planning something, which does not fit into the environmental plan, it is best to contact Team RED, Spatial Planning Cluster at (0499) 491491. When you have an appointment, please bring the following documents with you:

  • description of building project
  • building plans (old and new situation)
  • situational drawings and/or floor plan.

It is possible (under certain Requirements) to deviate from the environmental plan or amend the environmental plan. When the environmental plan is amended, this means that a new environmental plan is drawn up. The procedure for preparing a new plan involves the following steps:

  • draft environmental plan: this plan is available for inspection for 6 weeks in the town hall and on the website for environmental plans. Everyone then has the opportunity to submit an opinion (written or oral).
  • After the inspection period (of 6 weeks), the municipal council adopts the environmental plan within 12 weeks. The municipality can deviate from this deadline.
  • adopted environmental plan: the adopted environmental plan is again available for public inspection for 6 weeks. Those who have submitted a view, or have a good reason why they have not done so, can appeal to the Administrative Law Division of the Council of State.
  • the environmental plan enters into force the day after the appeal period ends. If no appeal is filed, the environmental plan is irrevocable.
  • if an appeal has been filed with the Council of State, the Administrative Law Division of the Council of State will decide within six to 12 months from the end of the appeal period (depending on the procedure).
