Temporary rental of vacant property (Leegstandwet)

What is it?
You may temporarily rent out your vacant property. For example, if your home or office building has been for sale for a while or is going to be demolished. You apply for a permit for this from the municipality.
How does it work?
You can apply for the permit for the following vacant properties:
- a property that is for sale and has never been occupied
- a property for sale in which the owner has lived during the 12 months before it became vacant
- a home for sale that has not been rented for more than 3 years in 10 years
- A rental property that is being demolished or refurbished
- a rental property for sale
- A building not built for living in (e.g., an office, school, group housing building)
Until when do you get the permit
- property for sale: 5 years
- rental property being demolished or refurbished: 2 years (extension up to a maximum of 7 years)
- housing in office, school or group housing: 2 years (extension up to a maximum of 10 years)
- housing for which you have a zoning exemption: for as long as the exemption lasts (maximum 10 years)
What are the requirements and documents necessary to apply for a permit?
- A fully completed and signed application form.
- There must be vacancy of the property.
- Proof that you are (co-)owner of the property.
- All owners must certify that they are jointly filing an application for the Vacancy Act.
- If potential tenants are known: enter address information and (possible) effective date of lease.
- Mediation agreement with the broker for sale of this property. If multiple brokers have had the property for sale state this and attach agreements.
- Indicate as of what date the house will be offered for sale.
- Data showing, that you have offered the property at a market purchase price in the past period. This statement can be prepared by the selling broker.
- If using an intermediary, you must provide a written power of attorney.
What to do.
You apply for the permit from the municipality.
What does it cost?
The cost of applying for a permit is €136.45 (dues 2023)
You must transfer the fees. The IBAN number is NL34BNGH028.50.07.955 stating "Vacancy Act and the address of the vacant property". Upon receipt of the fees, your application will be processed.
