General

What is the Wvg?

The Municipalities Preferential Rights Act (Wvg) means that the municipality establishes a first right of purchase on certain plots of land (land and buildings). Owners are then no longer free to sell their plot (land, house and the like) to anyone. If an owner chooses to sell, an offer must first be made to the municipality.

Where is the Wvg applied in Son and Breugel?

It is applied to a number of plots in part of the Breeakker neighborhood. On April 20, 2023, the City Council definitively decided to establish the right of first refusal in part of the Breeakker neighborhood.

Why the right of first refusal?

The Wvg allows us as a municipality to get a better grip on the land market so that we have more opportunities for redevelopment in the future.

What does the municipality of Son and Breugel do with the homes it purchases?

We take charge of the properties and temporarily rent them out. If this is not possible because of the condition of the property, we look for another solution.

What is the status of plans for the redevelopment of De Breeakker?

There are no plans yet. We expect to be able to inform the area around the summer about how we want to shape the plan with them.

For owners

You remain master of your own home

The preferential right does not mean expropriation or that the companies established in the premises have to leave. So you remain in charge of your own plot/house/property.

How long does the municipality's right of first refusal rest on my plot?

The preferential right applies for a period of 3 years. During this three-year period, a plan for the area must be developed in the form of an adopted zoning or environmental plan. It was agreed that the plan should be in place by the fourth quarter of 2024.

If no zoning or environmental plan is adopted, the preferential right will expire. If the plan is adopted within three years, the right of first refusal will continue for an additional 10 years.

In the meantime, the municipality may decide not to purchase offered properties/plots/residences and thus, the preferential right for those properties/plots/residences will lapse.

Does the right of first refusal stand in the way of self-realization by me as owner?

The preferential right only applies if you intend to sell your plot/house/property. As long as you have no plans to do so, you are free to do what you want with your property.

Do I have to compulsorily offer my house to the municipality and move?

You are not required to offer your plot/house/property. You are not obliged to sell. The right of first refusal means that if you want to sell your property/home, we have the first right of purchase.

Should I sell?

No. You are not obliged to sell your plot/house/property. If you do want to sell your plot/house/property, you are obliged by the establishment of the preferential right to first offer it to us. If the municipality refrains from buying, you, the owner, may sell your property freely for three years.

Why am I obligated to possibly sell to you? If someone else buys it, I'll probably get more money for it.

By establishing the right of first refusal, you cannot sell to any party other than the municipality unless we decide not to buy it. The value we offer you is based on an appraisal report prepared by an independent, certified real estate appraiser.

Suppose I want to sell. Then how does this work?

If you decide to offer your property to us, we will discuss the purchase of the property with you. We will have the value of your property appraised by an independent, licensed real estate appraiser. The appraised market value is the basis of the offer we make. After this, you will meet with the handling official, your further contact, to discuss the sale of your property.
 

What does the right of first refusal mean for the sale price?

The appraised value is the starting point. It is based on an appraisal report prepared by an independent, certified real estate appraiser. The right of first refusal does not affect the sales price.

I have invested a lot in my home. What guarantee do I get on the return of this investment?

The purchase price is based on the market value of your home based on an appraisal prepared by an independent real estate appraiser. The market value is determined based on the condition as determined by the appraiser at the time of recording. This takes into account finishes and amenities in the home. If your investments lead to an increase in value or retention of value, this is included in the appraised market value.

I disagree with the appraised value. What steps can I take?

For the municipality, the appraised value is the basis for the offer. If you cannot come to an agreement with us, there is the possibility of starting a price-fixing procedure. You can then ask us to ask the court to make a final judgment about the value of your home. It will still be your decision whether you want to sell. Will I be helped to find a new home to buy or rent?

We are happy to advise you. You are responsible for finding yourself another home.

I am renting out my property. If I am going to sell, what does this mean for my tenant?

You can offer your property to us in rented condition. The tenant can then continue to rent the property from us. If we purchase a property in rental condition, our goal is to eventually have the tenants move out. This depends on future plans for the area. If there is a fixed-term lease, we can give timely notice of the lease. If the lease is for an indefinite period of time, we will eventually discuss relocation with the tenant, depending on the chosen interpretation of the area.

I am an investor. Will I be helped to find another owner-occupied property that I can rent out?

We do not mediate the reinvestment of your assets.

What if I am left with a residual debt from the sale of my home?

If in the current market you still have residual debt when you sell your home, it is best to discuss this with your bank. The appraised market value is the starting point for purchase by us. You decide whether or not to sell your home.

If I want to rent after the purchase by the municipality, how do I get a rental property?

You can find rental housing through a private landlord and through a housing association.

Will I get a moving allowance even if I find something else myself?

The sale is voluntary. Therefore, there is no relocation fee.

For tenants

My property is part of an MoU, what does establishment of the Wvg mean for me?

There are no direct consequences for CoEs. If we become owners within your CoE because we purchase a property within the CoE, we take an active role within the CoE.

Do I have to move out of my home?

Your landlord cannot simply terminate the lease. Buying does not break a lease. If the owner of your property wants to sell the property, he must offer the property to us. If he offers the property in rented condition, and we buy, we become your landlord.

What can I expect from the municipality as a tenant?

In apartment complexes where we are given a position in the owners' association (VvE), we actively engage in the proper management of the VvE. Depending on the lease, we will discuss the future situation with you.
